Yep, Saber hasn't died yet so she isn't a heroic spirit from the throne of heroes. She was able to achieve great enough feats in life without needing to make a contract with the world to do so, but she still made her contract with the world to attempt to acquire the holy grail. Once she gets it, she will become a heroic spirit as part of that contract. I think that's everything, been a while since reading Fate.
So, all Heroic Spirits summoned for the war are usually balanced to a degree due to which class they're summoned as and to which master they're assigned. Basically, the grail will give a stronger servant to a weak master and a weaker servant to a stronger master because it will directly affect the stats of the servants and keep everyone around the same power level. However, each class has things they're supposed to be the best at in the war they're summoned for, and each class has special abilities of at least a certain rank gained from their temporary class vessel instead of their legend. Archer always has Independent Action. Assassin always has Presence Concealment. Saber always has Magic Resistance. Rider always has Riding. Caster always has Territory Creation. Berserker always has Mad Enhancement. Lancer usually has the highest Agility of all summoned servants. Caster the highest Mana. Rider usually has the strongest Noble Phantasm. The reason why Saber is considered to be the strongest class is because Saber will always be good at everything and bad at nothing, while other classes have their low points that can be taken advantage of. Saber's Riding comes from her legend tho. There are however exceptions to all these rules. For example Saber's Excalibur is way stronger than pretty much everything else that can possibly be summoned, but it's true power is restricted behind multiple seals so it's not recognised as the strongest NP. Gilgamesh's EA is so unique and so intertwined with his being that he CAN"T be summoned without it and NOBODY ELSE can have it, and this overrules the grail's system's rules.
It's not close to true magic, true magic is praised by the mage's association and only acquired through a unique root pathway and is inheritable by that mage's offspring. Ubw is unique to the individual and seen as heretical by the mage's association.

But he's basically trying to train himself to betray Iri and use her as the Grail by forcing himself to repeatedly betray her and go against her, so that when the time comes he doesn't hesitate to let her become the Grail and use her for his wish, rather than see her or try to preserve her as his wife. ( Which is just dumb)
Maiya backstory is very tragic too man. It won't be explained in the anime but in the Fate Strange Fake novel, her backstory was expanded more. Irisviel backstory is sad but I feel like Maiya's backstory is more sad and tragic that she deserves all the love but it was actually unrequited here despite you see them kissing.
That's not the reason why she accepts it though. She knows Kiritsugu is broken and needs all the glue in the world to hold him together, and Maiya helps with that. She also knows she's dying within 2 weeks, and Maiya to her knowledge will stay to anchor him beyond that.
