      15:00 It's easy, they always leave the cars running so that they're nice and cool when they get in in the summer, nice and warm in the winter and basically because they don't have to pay for it personally. As simple as that.
      Oh yes, here in Europe it is an environmental misdemeanor and is punished with a fine. Even if the police do it! Yes, of course the taxpayer also pays for it, but it's not a given to leave the car running without a legitimate reason. And having it cool or pleasantly warm is not recognized as a reason here.

      Abuse of power? How about aggravated assault, aggravated kidnapping, and violation of rights under color of law? The possession of a firearm in the commission of a violent felony? This "cop" should be facing life in prison or the death penalty. Stop letting them off lightly. Charge them with the crimes they commit.

      Not even mentioning the man was on his own property. It had nothing to do with disorderly conduct. It was because the cop still thinks and acts like it’s 1950’s Arkansas and didn’t like the tone or words being used. He is a fool, and apparently so is everyone else associated with that department and prosecutors office.

      It's commonplace for an officer to detain for disorderly conduct, THEN search for a complainant. That is not what happened here, and in my opinion bad policing anyway.

    I remember about 25-,30 years ago I was walking home with my dad & we saw a guy unconscious & not breathing, we performed cpr & phoned an ambulance. Police turned up first & treated us like we'd done something to the man. My dad looked at me & said "Dont speak to them (police)". So dad & I went silent & one copper grabbed my dad by the neck & tried to fold him over a wall. Problem was my dads retired parachute regiment & you just couldn't get him down like that. My dad actually kept his hands in his jacket pocket the entire time. The copper realised quickly he was dealing with someone he couldn't physically intimidate. The ambulance appeared thankfully & the paramedics were disgusted with the cops, they told them the man was heavily intoxicated & blood pressure had dropped so low because of excessive alcohol consumption that his system began shutting down. Paramedics thanked dad & I & police said "On yer way". But aye we've got our tyrants & bullies here in Scotland too. Its not right the police having these type of people supposedly policing society ✌️

      Yes they can according to Police across the United States. We unfortunately do live within a police state. A long time FBI officer stated that the largest threat to freedoms in American are police departments across the country. The smaller the department the more dangerous to civil liberties. Our country is in a very sad shape.

      ​@@tanker335check state statutes for disturbing the peace, causing a public disturbance, etc, they will frequently state that a law enforcement officer cannot be a complainant as they are not of the public while in uniform. You need public witnesses to say their peace was disturbed in order for there to even be an inkling of an offense.

    The follow-up is simple: First: File an ABI, FBI, and DOJ complaint. When you have the case numbers, make a press release for every T.V. station, every radio station in 150 miles, and every citizen news reporter in the state (including auditors).
    Finally, hold a press conference and say that both a state and federal investigation have been demanded.
    Then sue the hell out of them because you will already have more than enough public and political traction.

      They won't take your case if they think the award will be too little to cover their costs plus some. They don't make you pay up front in civil rights lawsuits. There wouldn't be many if you had to pay them first.
      The case of the man being tasered on his property for disorderly conduct is BS and most likely will be thrown out because cops can't be the complainant in a disorderly conduct charge.
      The use of a Taser was not legal because the charge was not legal.
      Cops really should be wary of Taser use on older people because there are a lot of health issues.

    Wow, I'd either move or run for office if I lived in that town. And they are wrong: you can resist an unlawful arrest. It's risky and costly, but you are allowed to resist, even up to lethal force if needed to resist an unlawful arrest. But the judges will rule against you and you'll only "win" by taking it to higher courts.

      you need to sue now before your chance times out. an arrest on your property is unlawful by default. the chief needs to show why he acted without warrant. disorderly doesn't get him there. and loud speech on private property is also not a thing. so a warrantless arrest with 18:242 felony by the chief including taser ending in losses of property house and business should be a good payday. - pity he wont go to jail and the ADA should get a bar complaint for malicious prosecution.

      Excellent video. Freedom of Information Act (FOIA) is usually only to obtain copies of already existing documents or recordings. Does Arkansas have an opens records law like FOIA? It is amazing the BPD actually took the time to answer your questions. Of course, they fired that officer probably because he was the only voice of reason on that police force.     Failing to provide identifying information is obstructing a complaint. This itself warrants a complaint to a higher authority.
    A force that willfully obstructs complaints should be reported to the Attorney General.

    Another example of the huge problem caused by the go along to get along crowd. They have bowed to the self-appointed authority of these people to the point they just expect it. Its a blow to their ego anytime someone questions it or stands on their rights. They dont know or care about the law because they have never had to. People really need to wake up.

    Those engines are not designed to be idling all day. The cams dont get sufficient oil and will destroy an expensive piece of equipment . This will cost more money than the gas they waste. Moreover, idling laws are for environmental reasons. The police are needlessly polluting the air.

    Notice how "command presence" (meaning assert your percieved authority) is their first priority.
    This is a huge problem between the people and police. There used to be respect for police and policing, they continually undermine any small amount of respect they have recieved

    It's kind of funny how all these cops insist they know the law and they're not breaking it, until it judge tells them otherwise and they either get fired or given a chance to resign, and move to another department where they don't know the laws either.
    I would think just a little bit of research would save them a whole lot of trouble relocating or getting fired all the time. I guess they just like the change of scenery every now and then.

      The problem is 99.9 % of the time people either don’t know the cop is wrong in law or if the do they don’t have the resources to take it to court therefore the cops keep doing it . “ Justice” and the “ Law “ has to be bought and paid for .

I think just about no one enjoys being called out for being wrong, especially if it makes them look bad, so it's important not to be swayed by excuses. Ego taming, sort of like snake charming lol.       He was showing an example that he can unlawfully arrest someone and them still get charged with resisting arrest if they resist even though the initial arrest wasn't lawful. He's wrong but he was giving an example of an unlawful arrest

      No recordings. The department supposedly can’t afford body cameras. But they can afford to leave cars running and wasting copious amounts of gas never mind the wear and tear and maintenance all the added extra running time costs.

    Qualified Immunity is slowly losing its power with cases like this. Keep reporting on this. We are making progress. It's just sad that we have to experience egregious behavior before someone takes notice. The definition of “clearly established” laws is becoming more and more apparent.

    Every single person that has seen this video needs to be calling the ignorant prosecutor for actually attempting to go through with these charges. We need to rid the public of these complicit prosecutions, judges, chiefs, sheriffs. Every last one of them that thinks this corruption will be allowed to continue. We the People have had enough and we are fighting back. This prosecutor needs to hear from every single person. The mayor, town council, everyone. This is going to stop and he will receive a settlement.

    You have two years from the date of the incident to file a lawsuit in federal court under the 1983 act.. it is very common for them to keep postponing your criminal trial until after that two years so that you're not able to sue them. Most civil attorneys will not file until you are found not guilty or the charges are dismissed because if you are found guilty they have no case.

    I've never seen a clearer case of contempt of cop. Stokes is an embarrassment and a stain on that department. It's completely disgusting that the other officers would support what he did. Police can't be the victim of a disorderly, and this arrest perfectly illustrates why. If they could, tyrant cops like Stokes would abuse their power by arresting anyone they don't like who might raise their voice, cuss at them, or say something that hurts their feelings, in retaliation. Raising your voice and cussing at a cop is your first amendment right, you have the right to redress your government and they don't get to chill your speech by arresting you.
    There was no justification for the use of a taser, Stokes pulled it out early, you can tell he was looking for an excuse to use it, that level of force was never warranted. With such egregious violations, Stokes needs to lose his job, his qualified immunity and his freedoms for several years, never to be permitted to work in law enforcement ever again.

    In this day and age the amount of money a law enforcement agency would likely save in lawsuits will easily pay for body cams and - cams. There is only one logical reason a law enforcement agency has for not having cameras, and that is it would hinder their own criminal activities. It is therefore reasonable to believe that any law enforcement group that does not have cameras is a criminal organization. FBI, DEA, ATF, are all great examples of the criminal organizations that do not use cameras.

      Very true when dealing with a Criminal flash corrupt law enforcement agency. A professional and well-trained agency that respects the rights of the people that they purportedly Serve and Protect, would actually save money by being able to prove frivolous accusations or lawsuits are unfounded. On the other hand and agency that realizes they would have evidence of their wrongdoing on many lawsuits, obviously wouldn't want evidence of their criminal Behavior.

Then again, if the same case came to the court system with documented video evidence, then the balance of justice would truly be balanced, and justice would be more likely to serve its purpose.
