If any wife's intense just ruined husband life by not given divorce then what husband has to do for divorce in our country bcoz government also not make focus on this type of misuse of law.

Hi, can understand your apprehensions. Laws can be unfairly advantageous to women these days. Alimony agreement is not enforceable in India, unfortunately. Working women who are well paid do not get maintenance, but they are eligible to get permanent alimony during or post divorce proceedings.

what if the man is delaying the divorce on purpose and never attends any court dates and keeps changing the mutual divorce conditions and even the mediation failed? what to do when the case is with the senior bench court and the divorce case is going on for past 3 years with no outcome...?

Hi. I m employed and having salary around 30000 per month. Exparte divorce has been passed on 22/ 08/ 2023. Today is 24/01/2024. My husband currently having salary around 90000 per month. We are not having any child. My in laws are Government employees so my husband's responsibility is only towards me. Can I claim maintenance and shreedhan from him ? Asking because exparte divorce has been order against me. Guide me . I m in highly need. No one give right advice.

Section 24 recovery can be done through civil proceedings, no vasuli warrant here. Regards

3. ladki apni shaadi me kitna bhi kharch kare, that is her issue, alimony ka usse koi direct relation nahi he....but yes, agar divorce mutual consent se he aur ladka ladki aapas me matter ko solve kartein hein...toh shaadi ke kharchon par discussion ho sakta he.....

Divorce ke baad me bhi maintenance dena hota he, agar court order kare to. Otherwise divorce ke pehle one-time settlement means alimony deke bhi case to khatm kiya ja sakta he. Ye depend karta he ki husband aur wife aapas me kya settlement kartein he. Thanks for your comment!

It makes sense when u said that alimony is one-time settlement, so there would remain no supervision of the court after it's paid in lumpsum but in case of maintenance, many other things need to be ensured by the beneficiary (adultery etc) and court needs to supervise becoz the respondent has still to pay periodically so it's completely understood that one needs to mend his ways...But I'd like to ask that this distinguishing feature as highlighted by you(b/w maintenance and alimony) is not recognised in the section itself, then how do i understand this? Bcz section 25(3) says that the court may rescind the ORDER AS PASSED UNDER THE SECTION if the beneficiary wife becomes unchaste or husband if commits adultery, which means that the order of alimony can also be rescinded(which doesn't make sense actually)...Any precedent on this? Pls help..
Maintenance orders can be rescinded, vary, or modify; should circumstances change after the maintenance order has been passed by the judge.
However, permanent alimony once ordered cannot be revoked. That is why the word "permanent" is so obvious with the word alimony, but not maintenance.

One more doubt- if decree of RCR is passed on wife's petition, can she later seek maintenance under S.25 HMA?
There are no clear cut answers to this question. Any claim for maintenance by the wife is a subjective issue, and courts have the discretion to pass orders of maintenance even after a decree of RCR has been passed, provided that the circumstances and evidences of the case favour wife's claim to maintenance.
@@advocatenileshpaneri i guess i got it...may b if the parties are cohabiting again after decree of RCR, it's hardly possible that she would need maintenance for her sustenance coz eventually her husband is there by her side..but even after RCR decree, they don't resume cohabitation, wife then might need maintenance money..

What if the party obtain decree of divorce under section 13 and the husband is ordered to pay monthly installments of a sum in order to maintain his wife under section 25? Would the wife still need to follow the provision of being chaste i.e.after divorce? Please tell sir

If the wife receives monthly payments for maintenance, she is expected to remain chaste and lead a moral life, because she is being maintained by her husband. Thus remarrying or leading an adulterous life post-divorce would render the wife disqualified for asking any further maintenance from her husband.
However, this is not the case with permanent alimony, because it is a one-time settlement, and it gives freehand to both husband and wife to lead their life after divorce, as they wish to. And there are no restrictions, whatsoever, after they obtain a decree for divorce.

But when wife simply refused to not return...it's benificial....make some evednece and proof she her self don't want to come...shell paid nothing as maintenance...!!

Since your wife refuses to stay with you, you can use this fact in the courtroom to your advantage. As to maintenance, this is something that the family court will decide under section 125 crpc or the provisions of the DV Act, and the date of the execution of the maintenance order depends on the order of the court.

If a wife of a declared void(or voidable) marriage is entitled to maintenance or alimony under section 25? 25(1) is confusing a bit
In voidable marriage the wife is entitled to maintenance, if the marriage is voidable at wife's option.
In case of a void marriage, she is not entitled to any maintenance. However, any child born out of such a void wedlock is entitled to maintenance or any other benefit that is derived from such relationship.

Maintenance aur alimony dono separate ideas hein. Agar aap maintenance de rahe he to phir alimony nahi deni hoti he....aur agar aapne soch liya he ki ek baar me hi pura payment dekar matter to finalize kiya jaaye toh aap alimony dekar matter ko finish kar sakte he....mostly me ne experience kiya he ki divorce ke time par alimony dekar case ko close kar diya jata he.

Yes, wife maintenance ya alimony claim kar sakti. Family court me iska relief wife ko milega. Iske alawa wife ko marne ke liye aur bhi sections apply honge joki indian penal code aur domestic violence act ke dwara sanchalit honge.
