The Top 3 Mistakes Made by National Interest Waiver Applicants in 2021 (and how to prevent them!)

The Employment-Based Second Preference National Interest Waiver Visa (EB2-NIW) is an exceptionally popular mechanism for professionals to obtain residency in the US -- and for good reason. Despite efforts by the Trump Administration to curtail immigration in many other ways, the NIW continues to have an extremely high approval rate overall. With no employer sponsor required and with standard processing times dropping well under a year this path has become extremely attractive to many professionals.
However, over the last several months we have noticed several patterns creating issues with approvals of NIWs or leading to Requests for Evidence at the very least. While we have been fortunate to have not received a denial of a NIW during 2020 we have had to refile several Petitions for new clients whose prior representation lacked the diligence, creativity or sometimes the basic competence necessary to obtain approval.
After seeing several EB-2 National Interest Waiver denials based on the same patterns we felt it best to lay out a video diagnosing the most common mistakes we see on a daily basis in evaluating and filing NIW Petitions. thanks for the video. I am struggling to work out if i meet the requirements for the NIW. I have worked in my job role sector for 8 years but only have a Bachelors degree. Is there only specific job roles which will allow a EB2 NIW?

Option 1: Joint Application - Both individuals apply simultaneously.
Option 2: Principal-Dependent Application - One applies as the primary applicant, while the other applies as a dependent, also qualifying for a green card.

Hi, Can I apply for EB Greencard if i'm out of status.
I'm Civil Engineer, my work visa is expired, I did a lot of job experience here, i have a lot of request job by our client to design the project and they like it and significant achievement with the Engineers, they really need this kind of my job for the construction to create job, the contractors can't start the job without any design, l have a lot of experience of Bridge design, urban planning, Structural, etc. i did a lot of city permit approval, i have created a lot of as built plan required by city engineers to get permit and the client don't have any records at the city to provide, so i help the client to make an existing plan of their property, including site plan and more.

You don't need any employer to file a labour certificate for you in the case of an EB2 NIW PETITION

Hi, Thanks for the very informative video on NIW. I have an approved self-sponsored I140 EB2 NIW petition being processed via Consular Processing in Mumbai India. The Affidavit of Support (AoS) is exempt for this petition. Do I need to submit AoS support documents to NVC such as IRS Tax Transcripts, Federal Tax Returns, Forms W-2?
