I have 2 old drug felonies, nothing violent. Last conviction was in 2006, been clean and sober ever since so it's been nearly 20 years and I've been a law abiding citizen the entire time. I've changed my life but the law won't let me. Texas allows felons to own a firearm in our home after 5 years have passed since your last conviction however, where in the hell can I purchase one? They all want to do background checks and refuse. I also don't want the corrupt Biden ATF in my business. The criminals in Houston all have guns. This seems very unfair. Well, I'm a felon and I own many guns. Also as a person who studies the Constitution and the Bill of Rights. There is nothing in the 2nd Amendment of the Constitution that says who can and can't own a gun. It's very simple The right if the people to bear arms SHALL NOT be INFRINGED. So what is so hard for the Federal and State Governments not understand about that part of the Constitution. The Government Federal or State is not going to tell me if I can own a gun or not. So yes I own guns as a felon. ALL Gun Control Laws are Unconditional PERIOD. My conviction was way back in 1992 when I was 23 I'm now 54 , so I will not let the Federal Government or State Government tell me whether I can own a firearm or not, it is my God given unalienable right to own a firearm.
Couldn,t agree more! In Ma. at age 51(2007) I lost my gun license when the computer caught up to me because of a violent misd.! Simple assault!(1974). To this day I am a prohibited person, and, NO felony convictions. All because of a state law called the violent crimes act of 1988! if you have been convicted, and I was, of a violent crime, no gun license! They made it retro to when you became an adult. Millions like me lost their license. I even joined a class action lawsuit calling it double jeopardy, the state called it regulatory, and some gun hating far left democrat judge ruled in the state,s favor! Why should it just be nonviolent felonies? What about violent felonies that didn't include a firearm? What about any felony for people that haven't been in trouble in 10-20 years? Try 40 yrs ago for me. At 19 yrs old. I made bad choices, due to people I was around, and the use of drugs and alcohol, no excuse, but is the why. Still paying for childhood young adult mistakes, and I just turned 65 !
imo, any infringement on anyone's right to bear arms is unconstitutional. Making any kind of felon ineligible to bear arms, makes their punishment life long, when it should be clear that once convicted of a crime, and having served the penalty for that crime, the person should be able to return to society free of taint, like anyone else.
Great I’m non violent 35 years ago I asked New York to give me my gun rights back five times and five times they said no hallelujah hallelujah I’ve been set free. I’ve been set free after 35 years one mistake in my life. I’ve been set free. I raised three children. Two of them are police officers one is a dermatologist. I work for the MTA for decades and they still looked at me as a second class citizen. I am a Christian God has forgiven me, and so should the United States.

Texas state law allows you to own a firearm and possess it in your home and on your property five years after the completion of your sentence. This is contrary to the federal law, so you could still be charged federally but I would rather be judged by 12 than carried by six. Obviously you will have to utilize a private sale from someone who is not a federally licensed dealer in the state of Texas. But as I said under Texas state law, for home defense only, you are legally allowed to possess within your own home.
I had a bunch of deferred Felonise in 2009 for selling pot in Colorado. I completed probation no problem I now live in New Hampshire and I actually work for a big-name gun manufacturer. I recently tried to buy a gun and got denied and just today I lost that appeal. Anyone know what I should do? I’m just baffled that I can build them and carry them by the thousands, but not legally protect myself with one.
In Texas (state law), a felon can legally own a firearm in their home 5 years after their release from prison. However, they cannot transport the weapon or buy from a FFL. Under this new ruling, I wonder if non violent offenders could constitutional carry or get a permit.
@trav7125 careful, federal law supersedes state laws. I’ve seen people get hammered 15 years federally for possession in a state where it was legal for an ex felon to own a weapon 10 years after a non violent felony conviction. The state isn’t going to stop the feds from prosecuting someone. Hopefully this case will change that but, until then the feds will prosecute you even if it’s legal in your state

Im in the middle of restoring my rights...no trouble in 17 plus years...i finally got all my info submitted to the parole board,3 letters of reference,notorized the whole 9 yards...a few weeks later had my home interview by a parole board member investigator...now its the waiting and wondering part!! Been 5 months and from what i hear theres no way to check on the process which can take up to 10 more months they say!! Got my fingers crossed!! Just want to protect my family,collect firearms like my dad and i did when i was a kid,and hunt!! Im not the bull headed teen i was when i caught felonies!! If you do your time and complete the sentencing, you SHOULD have rights restored...but u don't! You have to petition for those rights! Even then, don't expect all law enforcement agencies at every level to keep that updated record! They'll still likely have you in the system as a convict. Keep those expungement/right's restored/after-the fact dismissal decision's paperwork WITH YOU or at least on your phone. Get a CWP! Yes, they'll deny you at first, but you can fight it if you get your rights back! Once you have that card, makes it much more difficult to justify even an arrest if their own Dept. of Public safety has issued you a CWP. Until the law changes for certain, cover your butt! Don't let them lock you up for something you've already paid for (a non-violent conviction 30years ago!) because it can happen.

I didnt know 2a has carve outs for violent offenders. Where in "shall not be infringed" does it say this? Basically all gun laws violate 2a without exception.
Back in the late 1700s when they wrote the declaration of Independence and the Constitution there were already laws in place that stated that if you used a firearm while committing a crime you lost your right to own a firearm. It was the standard at the time so it was left in place. It was also the standard that if you commit murder you would be hung by the neck until pronounced dead by a physician. The supreme court has ruled in the bruen decision that all laws pertaining to firearms as of 1791 when the Constitution was ratified are the standard measure for all gun rights.
so for a prison sentence of 1 year and one day over 50yrs ago in a federal facility, low security,, for mail fraud, would i qualify. i ask because about 25yrs ago i was threatened with a minimum of 10 years added to something i was charged with to make me plead guilty. i received a probated sentence of 5yrs which i discharged with no problems. it just seems like these things never go away.

The ninth circuit ruled today in favor of this. I’m a Californian with a non violent felony. I can’t wait. I have a 10 year old daughter and having a gun in this state is a must for protection.

What about if I was wrongly involuntarily committed? I was assaulted by my ex-fiancé, and I called the police. To protect herself from assault charges, she lied and told them that I held a handgun to my head earlier in the day. Common sense would suggest that IF I had done that, she would have called the police herself instead of waiting until I called them on her. So now my gun rights are gone, and the corrupt Judge denied my petition to have my rights restored and the commitment record expunged.
Felons never lost their right to own a firearm. I was in a Florida court. When the judge was hearing a case. The defendant was being charged with possession. He was petitioning the court to release his firearms. As he claimed to have transferred ownership to his daughter. The judge granted the release, and explained he could continue to own firearms. He just wasn't allowed to be in possession. Also means Felons cannot buy from an ffl, but can buy where private sales are allowed. As long as they never take possession. There's a big distinction between ownership and possession. So hopefully the courts will fix the unconstitutional prohibiting of Felons from possessing firearms.

@narendra7817 the point there's many but one very valid point. Johnny owns ten firearms. He's a collector of guns. Some of his firearms are worth thousands of dollars today. Tomorrow they could be worth double or triple. What they're worth today. If Johnny goes to trial and is convicted. As soon as the jury Foreman reads guilty. If it was illegal to own. Johnny would already be guilty of owning a firearm as a felon. If it's illegal for him to own them. He's immediately going to need to not own them. Trying to sell something quickly. Means you'll rarely get full value, but if it's only illegal to possess them. He can have a trusted friend or relative take possession of them. He can then retain his ownership of his property, and maybe sell them at a later date. He can hold them or rather his whomever can hold them. Who knows maybe Johnny will win on appeal or maybe he'll have his record expunged. He might even get a pardon from a friendly governor. Maybe some day the unconstitutional law will be struck down by the court or repealed by congress. Maybe some day the USA will be invaded and Johnny will need his weapons to defend his nation. Maybe there will be a societal break down and the laws will no longer matter. Maybe just maybe Johnny just wants to own his property.

The US "justice system" is the worst- we imprison 400% more people per capita than the next closest countries, which is like El Salvador or something. 15 years ago, I pled guilty to a felony I did not commit to avoid a potential 12-year sentence if I lost at trial. My roommate had brought drugs into our apartment without my knowledge, and when the cops showed up, they just *assumed* I was involved and charged me too. Since the prosecutor didn't care about the truth, I said whatever they wanted me to say to get control of my life back as quickly as possible. I would have confessed to shooting Abraham Lincoln if it would have allowed me to avoid a prison sentence. If the courts don't care about reality, why should I???
I got a vehicular assault conviction in 2022. It’s a felony. It was in Colorado. The charge is “driving recklessly causing serious bodily injury” however in Colorado it’s not considered a “crime of violence” because there was no intention. I’m wanting to get my gun rights back and I’m interested in how to do it. I still have parole.. but I’m more then comfortable to explain to the courts how this charge isn’t considered violent even though the word “assault” is in the conviction..

That's not what the 2nd says. 2nd says everyone has the RIGHT, NOT PRIVILEGE, and it says inalienable, and shall not be infringed period. The law is unconstitutional, and therefore null and void. You can not lose a right, you can only lose a privilege.
This is huge but it’s not enough. Someone that made some bad decision when they were in their teens, went to jail served their time did their probation, should have gun rights restored. If the did the time for the crime then your rights shouldn’t be taken for life. That’s still an infringement on our rights.

Being that your 2nd amendment rights are inalienable you retaun your right regardless of the antecedent laws as they are not legitimate. I retain my rifle regardless of any felony convictions because I uphold the Constitution instead of just simply doing as I'm told.
i haven't watched this video yet but in Ohio, if you have a Felony, there are certain felonies where you can still legally own a firearm. Most people, police, even prosecutors, out of ignorance, will tell you "felony = automatic bar form firearm".... however, the ORC (ohio revised code) tells a different story. It basically says any criminal offense with a maximum punishment of 1yr or less imprisonment does not bar an individual from owning a firearm. The exceptions are violent crimes, I think drugs, fire arm offenses, etc.. So, for breaking & entering (gain entry by force or by stealth into an unoccupied structure) is a F5 in Ohio.. Maximum punishment of 1 year in prison. If that was your crime, you can still own a firearm. If your conviction was burglary (gain entry by force or by stealth into an occupied structure), that is generally a F3 and also considered a violent crime, so you're technically double barred by that (punishment is maximum of 3yrs in prison)... so even without the violence add-on, you're done with a burglary charge. Again, education is key. Getting police or prosecutors or judges or basically many many people to even understand that, even if you're walking around with the almost 1ft thick ORC book, and you show them the section, they'll still roll their eyes because they're brainwashed and arrogant and are afraid to admit they've been wrong their whole entire life.

To this day I am a prohibited person, and, NO felony convictions. All because of a state law called the violent crimes act of 1988! if you have been convicted, and I was, of a violent crime, no gun license! They made it retro to when you became an adult. Millions like me lost their license. I even joined a class action lawsuit calling it double jeopardy, the state called it regulatory, and some gun hating far left democrat judge ruled in the state,s favor! I can have anything I want if I move to NH or Maine but why should I have to? Jeff D.

Why should it just be nonviolent felonies? What about violent felonies that didn't include a firearm? What about any felony for people that haven't been in trouble in 10-20 years? Why are people that did their time, completed every step the court imposed, aren't on any kind of probation or parole not getting ALL of their rights back? imo, any infringement on anyone's right to bear arms is unconstitutional. Making any kind of felon ineligible to bear arms, makes their punishment life long, when it should be clear that once convicted of a crime, and having served the penalty for that crime, the person should be able to return to society free of taint, like anyone else.
Great I’m non violent 35 years ago I asked New York to give me my gun rights back five times and five times they said no hallelujah hallelujah I’ve been set free. I’ve been set free after 35 years one mistake in my life. I’ve been set free. I raised three children. Two of them are police officers one is a dermatologist. My understanding has been, according to a CHL class I took in 2012, that non-violent felons were not restricted though state felons in TX (my state) were restricted whether violent or non-violent.

I live in Philadelphia, is a 1983 burglary charge considered a non-violent crime. I'm 65 years old.
I got sentenced as adult at 16 in fl and then arrested at 28 sent to feds for possession of firearm by convicted felon. No charges over 18 but they used state psi and ran me up the road regardless of laws
The same thing happened to me did 18 months n the state then yrs later found a few bullets n my car the feds picked it up gave me 30 months Florida on some other sh#t.

Texas state law allows you to own a firearm and possess it in your home and on your property five years after the completion of your sentence.
This is contrary to the federal law, so you could still be charged federally but I would rather be judged by 12 than carried by six.
Obviously you will have to utilize a private sale from someone who is not a federally licensed dealer in the state of Texas. But as I said under Texas state law, for home defense only, you are legally allowed to possess within your own home.
I had a bunch of deferred Felonise in 2009 for selling pot in Colorado. I completed probation no problem I now live in New Hampshire and I actually work for a big-name gun manufacturer. I recently tried to buy a gun and got denied and just today I lost that appeal. Anyone know what I should do? I’m just baffled that I can build them and carry them by the thousands, but not legally protect myself with one.

In Texas (state law), a felon can legally own a firearm in their home 5 years after their release from prison. However, they cannot transport the weapon or buy from a FFL. Under this new ruling, I wonder if non violent offenders could constitutional carry or get a permit.

I’ve seen people get hammered 15 years federally for possession in a state where it was legal for an ex felon to own a weapon 10 years after a non violent felony conviction. The state isn’t going to stop the feds from prosecuting someone. Hopefully this case will change that but, until then the feds will prosecute you even if it’s legal in your state

Im in the middle of restoring my rights...no trouble in 17 plus years...i finally got all my info submitted to the parole board,3 letters of reference,notorized the whole 9 yards...a few weeks later had my home interview by a parole board member investigator...now its the waiting and wondering part!! Been 5 months and from what i hear theres no way to check on the process which can take up to 10 more months they say!! Got my fingers crossed!! Just want to protect my family,collect firearms like my dad and i did when i was a kid,and hunt!! Im not the bull headed teen i was when i caught felonies!! If you do your time and complete the sentencing, you SHOULD have rights restored...but u don't!
You have to petition for those rights! Even then, don't expect all law enforcement agencies at every level to keep that updated record! They'll still likely have you in the system as a convict.
Keep those expungement/right's restored/after-the fact dismissal decision's paperwork WITH YOU or at least on your phone. Get a CWP! Yes, they'll deny you at first, but you can fight it if you get your rights back! Once you have that card, makes it much more difficult to justify even an arrest if their own Dept. of Public safety has issued you a CWP. Until the law changes for certain, cover your butt! Don't let them lock you up for something you've already paid for (a non-violent conviction 30years ago!) because it can happen.

Back in the late 1700s when they wrote the declaration of Independence and the Constitution there were already laws in place that stated that if you used a firearm while committing a crime you lost your right to own a firearm. It was the standard at the time so it was left in place. It was also the standard that if you commit murder you would be hung by the neck until pronounced dead by a physician. The supreme court has ruled in the bruen decision that all laws pertaining to firearms as of 1791 when the Constitution was ratified are the standard measure for all gun rights.
so for a prison sentence of 1 year and one day over 50yrs ago in a federal facility, low security,, for mail fraud, would i qualify. i ask because about 25yrs ago i was threatened with a minimum of 10 years added to something i was charged with to make me plead guilty. i received a probated sentence of 5yrs which i discharged with no problems. it just seems like these things never go away.

What constitutes a violent crime ? Murder, assault, rape, robbery, car jacking, are factual violent crimes. Selling drugs is another in my opinion, as a lot of people die from those everyday ! Where does theft, burglary, ccw ( before the age of legal concealed) fit in ? Late 70's I went to prison for 5 yrs, out in 84, for b&e been law abiding since, driving truck since.
What about if I was wrongly involuntarily committed? I was assaulted by my ex-fiancé, and I called the police. To protect herself from assault charges, she lied and told them that I held a handgun to my head earlier in the day. Common sense would suggest that IF I had done that, she would have called the police herself instead of waiting until I called them on her. So now my gun rights are gone, and the corrupt Judge denied my petition to have my rights restored and the commitment record expunged.

Felons never lost their right to own a firearm. I was in a Florida court. When the judge was hearing a case. The defendant was being charged with possession. He was petitioning the court to release his firearms. As he claimed to have transferred ownership to his daughter.
The judge granted the release, and explained he could continue to own firearms. He just wasn't allowed to be in possession. Also means Felons cannot buy from an ffl, but can buy where private sales are allowed. As long as they never take possession.
There's a big distinction between ownership and possession.
So hopefully the courts will fix the unconstitutional prohibiting of Felons from possessing firearms.

@narendra7817 the point there's many but one very valid point. Johnny owns ten firearms. He's a collector of guns. Some of his firearms are worth thousands of dollars today. Tomorrow they could be worth double or triple. What they're worth today. If Johnny goes to trial and is convicted. As soon as the jury Foreman reads guilty. If it was illegal to own. Johnny would already be guilty of owning a firearm as a felon. If it's illegal for him to own them. He's immediately going to need to not own them. Trying to sell something quickly. Means you'll rarely get full value, but if it's only illegal to possess them. He can have a trusted friend or relative take possession of them. He can then retain his ownership of his property, and maybe sell them at a later date. He can hold them or rather his whomever can hold them. Who knows maybe Johnny will win on appeal or maybe he'll have his record expunged. He might even get a pardon from a friendly governor. Maybe some day the unconstitutional law will be struck down by the court or repealed by congress. Maybe some day the USA will be invaded and Johnny will need his weapons to defend his nation. Maybe there will be a societal break down and the laws will no longer matter. Maybe just maybe Johnny just wants to own his property.

I was convicted of a violent crime 15 yrs ago in Canada but recently got a Record Suspension. I'm planning on moving to the States but supposedly the Record Suspension doesn't carry over to the States.

The US "justice system" is the worst- we imprison 400% more people per capita than the next closest countries, which is like El Salvador or something. And your punishment is never over with records and background checks. With so many laws, 1 in 3 Americans has a criminal record and so much of your experience depends upon luck, lawyers, judges, and money.
15 years ago, I pled guilty to a felony I did not commit to avoid a potential 12-year sentence if I lost at trial. My roommate had brought drugs into our apartment without my knowledge, and when the cops showed up, they just *assumed* I was involved and charged me too. Since the prosecutor didn't care about the truth, I said whatever they wanted me to say to get control of my life back as quickly as possible. I would have confessed to shooting Abraham Lincoln if it would have allowed me to avoid a prison sentence. If the courts don't care about reality, why should I???
I got a vehicular assault conviction in 2022. It’s a felony. It was in Colorado. The charge is “driving recklessly causing serious bodily injury” however in Colorado it’s not considered a “crime of violence” because there was no intention. I’m wanting to get my gun rights back and I’m interested in how to do it. I still have parole.. but I’m more then comfortable to explain to the courts how this charge isn’t considered violent even though the word “assault” is in the conviction..

That's not what the 2nd says. 2nd says everyone has the RIGHT, NOT PRIVILEGE, and it says inalienable, and shall not be infringed period. The law is unconstitutional, and therefore null and void. You can not lose a right, you can only lose a privilege.

This is huge but it’s not enough. Someone that made some bad decision when they were in their teens, went to jail served their time did their probation, should have gun rights restored. If the did the time for the crime then your rights shouldn’t be taken for life. That’s still an infringement on our rights.

Being that your 2nd amendment rights are inalienable you retaun your right regardless of the antecedent laws as they are not legitimate. I retain my rifle regardless of any felony convictions because I uphold the Constitution instead of just simply doing as I'm told.

i haven't watched this video yet but in Ohio, if you have a Felony, there are certain felonies where you can still legally own a firearm. Most people, police, even prosecutors, out of ignorance, will tell you "felony = automatic bar form firearm".... however, the ORC (ohio revised code) tells a different story. It basically says any criminal offense with a maximum punishment of 1yr or less imprisonment does not bar an individual from owning a firearm. The exceptions are violent crimes, I think drugs, fire arm offenses, etc.. So, for breaking & entering (gain entry by force or by stealth into an unoccupied structure) is a F5 in Ohio.. Maximum punishment of 1 year in prison. If that was your crime, you can still own a firearm. If your conviction was burglary (gain entry by force or by stealth into an occupied structure), that is generally a F3 and also considered a violent crime, so you're technically double barred by that (punishment is maximum of 3yrs in prison)... so even without the violence add-on, you're done with a burglary charge. Again, education is key. Getting police or prosecutors or judges or basically many many people to even understand that, even if you're walking around with the almost 1ft thick ORC book, and you show them the section, they'll still roll their eyes because they're brainwashed and arrogant and are afraid to admit they've been wrong their whole entire life.
