5:45 since you are a law expert and not religion expert, then be humble enough to ask the scholars of that religion whether hijab is because of religion or because of desert. If you had done some research before making such a comment, you would find very specific understanding of the words 'Hijab', 'Niqab', 'Jilbab' (burkha), 'Satr', 'Aurah(t)' in the Quran and Hadith from where religious rulings/opinions are derived. The Arrogant/Dishonest judges of the Ktka HC failed to call in scholars of Islam as expert witnesses on this basic procedure before giving their ignorant/political unjust decision.

with due respect,dont expect too much, outcome will be the same.when everything is clear regarding minority rights in constitution,still every aspect of muslim life ,religion,culture is discussed in media and courts.later its proved to be waterloo of muslims. its not a matter of fundamental rights,customs,personal liberty or choice etc.its purely political issue and intolerance towards muslim girls,othrwise it would have been settled in single hearing because there are various precedence and case laws of multiple judges bench,where hijab being custom and essential practice ,cant be denied.

The essence of yesterday's argument, is competitive interests, one pitted against other's purported right of uniformity. The questions posed reveal the girth of the argument to be limited to technical arguments of notifications and facades of the state's plea of secularist mandate to run the government schools and technical interpretation of the term curricula etc. The case is certainly not a case of essential practice, and the technical arguments would lead the case to such ambivalent mix of technicalities and uncharted domain of essential practice. I guess mr. Dhavan understands where this will lead to, and that's why the constitutional issue and bench thereof. The sexist comment that can the girls be allowed to wear a mini, midi etc., was posed, was innately disturbing, and reveals the prejudice. The case is here is not whether they can wear anything. The case here is whether the girls have the right to modesty, because they believe in it, not necessarily by the assumed mandate of religion but by the assumed mandate of their belief system, culture and constitutional right. Questions of the said nature is a preemptive and therefore prejudicial mode to defend uniformity.

Personal choice cannot override the discipline of an educational institution. Dress code, if legally prescribed, takes precedence over personal choice. No institution can be run without some reasonable disciple imposed on it's participants and dress code in one of them. Even the Bar Council of India has a dress code. Will SC allow the lawyers to be present in SC without that dress code? Besides, privacy issue comes where there is compulsion. The student has a choice to study at another institution which has a dress code of it's choice and hence privacy is not affected in this case.

Can't we see that these girls are not rejecting the uniform, instead they are requesting for a reasonable accommodation on top of uniform to exercise their religious practice, without any threat to public safety, public order, health or morals, and the rights and freedoms of other people. The ayyappa devotees wear complete black dress nothing close to uniform and we accept it, Sikhs wear turban and we accept it, what's wrong with Hijab?

It is unfortunate that neither muslim political leaders nor religious leaders have clear cut idea about the role of madrasha in present India.
There are two types of madrash -
1) Govt aided , under the control of madrasha board where modern education are provided at par with state matriculation board.
2) private, self financing madrasha known as darool uloom madrasha where only religious text are taught to produce - immam, moulana, hafeez, kazi etc who provides the religious service to the community.
In hindu community, there is a particular cast who provides such service from generation to generation - last rites of a hindu perform by a brahmin and burning of body takes care by dom.
But in muslim community there is no specific cast available for performing such religious service. They are made available in community by imparting training through this darul uloom madrasha.
If govt decide to close down all such Institute in the name of terror link, that days will not be far away when no religious service provider - immam, moulana, hafeez, kazi will be available for this community. Muslims will not find out any immam for performing last rite for any dead muslim person.
It may happen in near future if the political and religious leaders fail to convince to govt about the purpose of darul uloom madrasha for muslim community.
The uniforms were introduced in schools and colleges 15/20 year back why it’s a issue now. It is simple if people don’t want uniform then opposition should bring a bill in parliament addressing that there should be no uniform to any one in any where.
Simple either rules for all or all should be free.
You can’t discount one community for every thing but impose the rules on others.

If someone says Sikh turban is not a religious clothing (and goes on equating with a pagri worn by advocates and royal servants) and equates right to dress with right to undress, do we call him sane? What kind of a judicial person do not know that right to undress is not protected by article 9. Right to religious practice including clothing has boundaries to protect public safety, public order, health or morals, and the rights and freedoms of other people. If someone in one of the highest judicial authority equates right to dress with right to undress, what can we say? Won't they teach in law school whether or not right to dress include right to undress?

Sir,all Central Administive Tribunals are almost defunct now. After much of effort of out going CJI Justice Ramana ministry of law only given posting of only few judicial members but no single administrative member posted till now. So CAT function remain as before function as single bench in most of CATs and few available administrative members are doing make shift arrangements through virtual mode in some other CAT benches affecting their parent CAT forced to conduct division bench in one shift only.So huge cases are pending finalisation. Moreover the existing division bench functions not more than 2hours a day per shift practically even they don't sit full cession.It is strange to notice then how there will be progress unless atleast they conduct entire period of the shift to clear atleast some cases.The available division bench only passing time hesitant to do final hearing.This pity situation is prevailing in CATs and litigants deprived of justice for years together.The cases filed in 2019 are still pending not appearing in regular cause list.

But there are different law and different institutions for a special community. Now they are demanding for separate dress code. Because they think them as 1st class citizens and exempted from all law and regulations.
It is only because of failure of government to deliver them adiquate treatment as Gujarat government does in 2002 .
Govt schools celebrate Hindu festivals that are related to education and students like Ganesh and saraswati festival. And btw no one is forced to attend this celebration in schools.
Those who are against these celebrations then tell me what good festivals you have in your religion which can be celebrated among the school children.

hijab is ok with school color but bhurka , nakab should not allow inside the school or school that there community also not support but they do. and in hijab also proper checking should be there sometime hiding earphone copying in exams many time caught that time girls complain how they can touch our hijab etc if they dont agree on this ban everything regarding religion wearing inside school
Dr Faizan sahab .. In a secular society as of ours traditions do have special place . Other religious communities do have right for turban kripan. Why not hijab .Does it gives harm to any other. Mask is allowed . But hijab not.
