On Friday, May 24, the Supreme Court of India declined to instruct the Election Commission of India (ECI) to provide the total votes along with the percentage from all polling booths. The court advised the petitioners to submit their applications after the completion of the elections.
The stance of opposition parties has left many wonder why are opposition parties harping on ECI to upload form 17C. Is their contention rooted in a lack of faith in the ECI, or is it a matter of genuine concern? DMK’s Rajya Sabha MP, Senior Counsel, and head of the party’s Lok Sabha Election war room, NR Elango, discusses these issues with TNM’s Shabbir Ahmed, providing insights into what happens at the booth level and the opposition’s perspective on the matter.

Eci acts at the instructions of its masters .eci is like ed,cbi,nia,or any deciplinary body.
14:20 the reason why 17C data should be announced is. Not every booth agent goes to counting. People who goes to counting don't have the resources to collate data across all the booths.
If it is announced before hand, each booth agent will be able to verify the released data. Which prevents from tampering with number of votes polled.
Who asked the agent to not go to booth? You go shopping leaving your house unlocked and cant blame police for not preventing the robery.
@@shielaroberts I didn't say booth agents will not go to Booth. I said not all booth agents will go for counting.
@@yukthiprasad3383 Booth agents will not go for counting, that is the jop of poll agents (sometimes same person does both). So the effect is each candidate has an agent with 17C at time of counting. If 'agent' does not go, it is not ECI fault.
@@shielaroberts Thats what I said it is not easy for the candidate/people who go for counting to collate from all booths.
Also all the data is readily available to ECl which can be uploaded in their website. Don't know whats the problem for them to upload booth wise data.

The EVMs control unit can be designed in such a way that the unit can behave differently during mock polling and actual polling.
To increase the confidence of the voters,
-- not just fixed 50 votes and 1 mock polling round should be done
--instead polling agents should agree upon a random number of times the mocking to be done. (Say, lets test the EVM 4times/ 2times)
One thing Mr Elango explained well was why a copy of form 17c is vital to every booth and to every candidate in a constituency. For transparency, every Indian voter should also know the number of votes polled daily and the number of votes recorded. The two should be an exact match.

NOTA doesn't have any agent, so Form 17C should be uploaded on the Website of Election Commission.

Why are these people reassuring that the 17C and educate the candidates or polling agents so on the counting day they are familiar with figures on the EVM
Vast section of Indian feel that court's decision on recent election related matter like ECI, EVM are itself not free and fair...How could a EVm rejected by advanced countries democratic election be free and fair in its use in India ?? Hon'ble court have failed to answer this question raised by all thinking citizens of the country...In this context people reacts to use of EVM in this election as an imposition on people of India....
Rools are not updated there are so many loop holes
Supreme Court always backs election commission.. if election commission don't give actul vote get by candidate and just declares winner candidate, Supreme court would say we should believe election commission. They are proper authority. I just waiting for day when election commission give reason that there are lots of count to collect and so we are directly declaring winner with percentage vote.

One doable suggestion for disclosing 17c at booth level :
Nowadays, railways is giving electronic pads to their travelling ticket checkers, who mark the presence or absence of a reserved passenger, thereby updating the berth availability status in real time. The vacant berths are thus made available for reservation under "currently available" category.
Every presiding officer should be given such a device, who will directly upload the count every hour, and also, finally after finalization of 17c. All the relevant data of booth no, constituency name, every technical detail of every, control unit, vvpat, slu etc can be captured.
Hope bynext election, this is implemented.

It is the responsibility of the candidates to collect Form C from their Polling Agents and collate the data at the time of counting the votes polled

The thing is not every booth has polling agents from all parties. Also, some polling agents of parties don’t know that they have to collect 17 C. Usually they note down the total number of votes polled in a particular booth. Sometimes election officers doesn’t give 17 C to the agents.

Machine/ EVM can't make error. What ever the activities they are recorded in the EVM, the ECI has to disclose the activities. This is his liability. The electing machinary is in his hand.

I wonder how can parties keep uneducated or ill-educated people as polling agents who are the key personnel in the voting verification process? Do parties also take the elections casually? Or they want some ill-educated polling agents to rig the elections if possible? Yes DMK leader correctly said - the people of India are the stakeholders not political parties. Parties are only our representatives. Also why there should be 1 or 2% variation at all? Aren't the votes polled recorded from the EVMs itself? If so why discrepancy between the votes polled on the EVMs and counted from the EVMs? Were the votes on EVMs manipulated in between polling and counting. Also at least 2 lakh votes are polled in each assembly constituency and among them 1% means 2000 votes. This plays a key role where margins of winning are less than 4000. Also this may mean that EVMs could have been programmed between polling day and counting day also and that too when VVPATs are not counted. Of course if EVMs are programmed between polling and counting then printing new VVPATs also is not impossible. It's not the lack of trust in the ECI that people have become vigilant but due to lack of trust in the EVMs especially due to these kinds of discrepancies.
Of course ECI also will be monitored by the parties and public to conduct free and fair elections. When there is corruption in the government offices and systems and when bureaucrats and even judges are having political affiliations these days how can one just trust in the systems without proofs. Don't the courts also judge based on the proofs or will they give judgements just like that based on trust or intuition? Asking us to trust umpires is just ridiculous and that too when we are using the technology as third umpire. But the technology of the third umpire is very accurate and very transparent if so why is the technology of the EVMs neither 100% accurate nor 100% transparent for human judgement? Why ECI and SCI are fearing transparency and accuracy in the matter which decides the fate of 1.4 billion people on this earth?

I have worked in current elections all representatives of political parties are present after completion of poll till it's collection in strong room where all the machines are kept 24*7 under CCTV surveilince under govt officials

@@avinashpalve9821 Morphing is a silly argument by the EC which I think can be easily found out if presiding officers give part-1 of the form 17c to all polling agents or at least to the candidates after the voting. The tampering of the EVMs can only be suspected if there is a mismatch between the votes polled and votes counted from any particular EVM. The technology of EVM is still being probed and the mismatch could be due to erroneous EVM or due to tampering during the transfer or not sure if any EVM can be programmed remotely also. Also wondering if real EVMs can be replaced with duplicate EVMs during transfer from polling booth to strong room? But these are only few angles to be probed in case of mismatch between the votes polled and votes counted for any EVM. Some of these can be ruled out if the mechanisms are fool proof. But if things are fool proof there should not be any difference between the votes polled and counted. Hope there are no discrepancies and may we improve our system to much better one. Thank you.
Happy to know that our ECI has taken the first step towards transparency of the functioning of the EVMs. But there is a long way to go for electoral reforms. There are still many issues that need to be improved in our election system - Voter absenteeism, Rigging, impersonation, Black mailing of the voters by the Landlords or employers, Postal ballot system, educating polling agents, Linking voter id and aadhar, removing duplicate votes to name a few. Democratic Election process should be 100 % correct
Without 100% VVPAT, there is always a chance of fudging. The total number of votes polled may be perfect, the logic can be built into EVM system where any day before the actual counting day, the % polled votes are taken from multiple parties to one single party as per the plan by EC and the ruling party.
Forget everything how many times you proved EVM is wrong.
Country like india how many in terms of percentage panchayat result was declared by toss.

@@juncando Pls read English correctly. Polling Agents (not officers) are represetnatives of candidates stationed at each booth by candidates to ensure that operations are performed as required. The DMK guy is the one who said they (at least some of them) are illeterate. Whose fault is it if candidates send illiterated agents? Why should ECI uploade becasue candidates send unqualified agents? And, he says they may lose 17C. Come on if you cant take care of 1 piece of valuable people you cant expect ECI to your rescue. And do we mean to say if 10 candidates are there in a constituency, all 10 will lose it? joker.
@@shielaroberts You are correct. The polling agents are from the party and yes surely they can find or train educated people for the post. So the next question is. Why the paper form ? It should be digital from the start. This election has been done in a hurry and not planned with such a massive expenditure.
