It shows who owns the property and if the taxes have been paid up on the property. If the taxes haven't been paid the government can claim ownership of the property. This is not entirely true although the law allows it. For example, normally a title would be inherited and should be divided to the eligible children. Sometimes those individuals are unable to agree on a division or a price to sell the property. Family members are sometimes unable or unwilling to cooperate as a group to pay the yearly tax. If one family member in fact pays the tax for a number of years they have a lien that may lead to outright ownership. Especially if they have a qualified connected attorney to walk the paper work through a friendly judge and bureaucrats. There have also been cases we know of that after a sale a family member was able to nullify the sale or contest the ownership tying up the property making it unusable. This has also been done in a calculated way by the entire group as a scam.

My wife and I bought a house and lot in Cantile 2 years ago. My wife’s uncle is a lawyer there in Dumaguete but we did not use him to process our title. My wife knows a lady she works as a legal assistant at a law firm and knows the in/out on getting title work completed. Our lot 3000k sq meter and house we paid her 25k pesos and she did all the legwork, and only took us a couple months to get our title. She knows everyone and how to get your paperwork to the top of the pile.
We're seriously looking at 3 houses, right now. 2 are in secured subdivisions, and 1 is in a more provincial setting. I did my last video on 1 in the secured subdivision, and next video will be on the provincial house. My favorite, by the way ❤️ The 1 in the secured subdivision (my last video) there's no question about title, since it's finishing construction with a known builder. The other secured house won't be too complicated for the title, but we would still have an Attorney look everything over. The provincial house has a lien against it from Pag-Ibig (mortgage), and we're confident the title will be good, but we would still have an Attorney handle everything. I'm also looking at a lot to build a house on. Prices here are 5+ times more expensive than when you stated! The cheapest lot I can find, in a good flood-free location (subdivision) is around P12K/sqm, and I was excited to find that! The lot is 250sqm, and that's big, for around here. If I decide to build, of course an Attorney will handle the due diligence of the lot title. I applaud you guys for being cautious with land purchase! Too many horror stories! 😮

I would highly recommend you set yourself up with a good Lawyer so you are fully prepared, if you are serious look at providing a small retainer so you are good to go. Also get a Reputable Survey company - I would highly recommend the property of interest to get a survey if it doesn't already have so you know exactly what you are buying - this this should be apart of your purchase Agreement Conditions along with that very important having a proper Documented RIGHT AWAY! Survey - most won't have those MUHONS which are small cylinder concrete blocks used to mark the parcels of the land - survey put in your legal purchase documents so this cost you initially put out of pocket in the end get back - apart of your Purchase Agreement. Don't bother trying to explain, best to put in that Legal Purchase Agreement. Also don't get caught buying landlocked property. I would recommend to look into electricity and water sources - you can do a lot of the foot work yourself going to the appropriate City Branches find out about the water conditions. BEST OF LUCK IN YOUR JOURNEY!
Sometimes you get burned even having an attorney. A Russian and his Filipina up here in Apolong Valencia used an Attorney the owners recommended absolutely never do that ! It was a hectare Mother title for 900k the mother and daughter signed off on it at the Attorney’s office and he thought that was that till the son who was abroad shows up. They Mother and Daughter lied and the Attorney didn’t do his job the son then demanded 500k from the Russian because he felt them ripping him off all the money the Russian should pay for it. The Lawyer for some reason back out of it makes you wonder was he in on it also but the Russian ended up loosing 900k because he refused to pay another 500k to the son
Of course ALWAYS get a lawyer to handle ALL the “Deed of sale” documents or any other documents needed like “time agreements” that are attached to the contract. Mother’s title? It doesn’t matter! In the Philippines the “deed of sale” is the law of legal ownership! Westerners always get all hung up about a land title. If you can get it? That’s fine, but if you can’t? That’s fine too. As long as the current legal land owner or owners all show up at the lawyers office on signing day! My Filipina wife and I have made 5 land purchases here in the Philippines! 2 of them have titles and deed of sale. 3 of them only have deed of sale. Ten hectares in total. Or 25 acres. 5 hectares of which is in my 4 year old son’s name because one person can not own more than 5 hectares in the Philippines. One deal we had 7 adult children that were Aires of the mothers title signing in the lawyers office that day. We just showed up with the CASH and signed!

Your best bet is a long-term lease; that way, you actually own the property for the length of the lease. Otherwise, you can buy all the property you want, but you can never own more than 40% - even if you become a citizen. If you buy, the land can easily and simply be taken from you if that 60% wants it. But if you lease, you own 100% of the terms of the lease. I have given money to help a land-owner in exchange for lease on property. It is easy and foolproof, AND, if you make the lease long enough, you can turn right around and sell the lease to a third party.
Old dog had an attorney who searched title on the first property he was looking at. Sounds like the right of way is similar to in California. Yep Location location.Location the further from the main road the less it will be. You will need to run electricity and water to the property and the further from the main road the more expensive it may be. The attorney should not be according to the size. It is based on the complication of perfecting the title. On the mother title some of the relatives who could possibly contest the sale need to sign off and they might be hard to track down like in America for a generation etc. Maybe get an engineer to do a subdivision map to solve the mother title. The price / value of the land before and after the recording of the map could be in your advantage if you hire the engineer. There is a lot involved. We can chat more if you have questions
Mike & Janet, a subdivision in most cases have a clean true land Title. Understood that your guys are not keen on subdivision living. I'm no expert but a Mother Title should be avoided even with an attorney. During the sale or especially after the sale random family members could contest the Title or try to extort you. In extreme cases your life could even be endangered. Many of the murders within families have to do with land disputes or long held grudges from land distribution.

Old dog had an attorney who searched title on the first property he was looking at. Sounds like the right of way is similar to in California. Yep Location location.Location the further from the main road the less it will be. You will need to run electricity and water to the property and the further from the main road the more expensive it may be. The attorney should not be according to the size. It is based on the complication of perfecting the title. On the mother title some of the relatives who could possibly contest the sale need to sign off and they might be hard to track down like in America for a generation etc. Maybe get an engineer to do a subdivision map to solve the mother title. The price / value of the land before and after the recording of the map could be in your advantage if you hire the engineer. There is a lot involved. We can chat more if you have questions

Mike & Janet, a subdivision in most cases have a clean true land Title. Understood that your guys are not keen on subdivision living.
I'm no expert but a Mother Title should be avoided even with an attorney. During the sale or especially after the sale random family members could contest the Title or try to extort you. In extreme cases your life could even be endangered. Many of the murders within families have to do with land disputes or long held grudges from land distribution.
