Then he says there was NO damage to his car, when indeed there was, then when caught in that lie, he says the damage was from another incident. He screwed himself right out of a plea deal. Now the plea deal is off the table and he’ll be found guilty at trial because he’s already admitted to having been driving impaired and his BAC backs that up. I know there's no way for jurisdictions in N. America to enact a complete ban on drinking and driving, or taking licenses away on a first offense, but I think a reasonable compromise on that front is if you have a DUI conviction in your past, and you blow basically anything above trace, your license should be given up.

Drunk in the middle of the afternoon and he cannot recall when he started drinking that day. My experience is that only alcoholics start drinking in the morning. He does not seem the kind of person to be drugged by girls. For what reason? They could not move such a large man to abuse him. He had a .20 BAL which would explain everything. Who drinks two glasses of gasoline tasting alcohol.
I did too. I worked out of town and was about to miss the bus I rode to cut down on my commute. When the LEO pulled me over, I was honest and courteous. He gave me a ticket but knocked the speed down a bit to lower the fine. I will never forget and made sure to give myself plenty of time going forward. If I was unexpectedly held up, I called work and told them I would be late. I was in the military, so 15 min early is considered late. 😂 Why give LEO a hard time when it was my fault. Drunk driving is an entirely different issue. You not only risk your own life, but that of others. And too often, the innocent die.

But HE doesn't know that. He thinks he f'd up his deal (and he did) and now he's getting significant jail time after a jury convicts the hell out of him. So when the offer is "generously" provided again at final conference, he'll know to just admit it(!). 0.20, dude. You blacked out. Own it. Also, this accountability will serve him well in sobriety court. (We called it DUI wellness court). He goes into that program with this "I was drugged) BS and he's not lasting long anyway. During the acceptance of a plea the defendant HAS TO answer questions from the Court to establish a factual basis for the plea. The defense attorney doesn’t have a choice.
Imagine if other counties/states had judges that help prosecute criminals, ones w serious crimes that did result in bodily harm to others. Now he’ll get a small chance to plead the 5th.
I may misunderstood what you were saying, but it is the judge’s job to ensure that the defendant actually did the crime for which they are taking a plea to; since he plead ‘guilty’ and not ‘no contest’, the defendant has to state what he did that makes him guilty. Also the prosecutor cannot use his statements while taking a plea against him during the jury trial.

I do this shit every day. the judge was doing a standard plea colloquy, including probing deeper into inconsistent answers… which every judge does in a plea colloquy. they need to confirm factual basis and that the plea is knowing and voluntary. he wasn’t “prosecuting.” if the prosecutor didn’t withdraw the plea offer, he was almost certainly going to reject the plea. that’s not prosecuting. that’s the basic role of a judge in a plea.
Withdrew because this guy is not willing to simply accept his responsibility. It’s simple really. Rather than try and explain things away as if he wasn’t really to blame. Say, “ I drove drunk. I drank this, I chose to drive. I can’t remember all that I did because I was too drunk.” This guy is claiming a date rape drug. He’s claiming four or five beers. He’s then going back to Jungle Juice. He claims to have driven back looking for a mail box he “didn’t” hit. His car wasn’t damaged but now has damage but that damage is caused by something completely different. If you want a plea, allocution needs to be as exact and as accepting as possible. If you can’t remember, simply say that you were too drunk to remember. This guy is a joke and a liar. He is minimizing his actions and deflection responsibility right after he says that he accepts responsibility. The court needs to hear what he is accepting responsibility for. This guy cannot do that. It’s not within him to do that. Yet he claims to be some sort of professional.

Im a retired County Law Enforcement Officer from West Michigan, Ottawa County. Our neighbor NEWAGO County does have some of West Michigan s more dumb defendants. Just saying from 25 yrs in law enforcement. 😅

He was charged with this drunk driving offense recently. But they can go WAY back in the past to upgrade the penalties for a current charge if you have any of the same type of prior offences . It's not just alcohol related offences either. I think they can do that with just about any type of offence!

During the acceptance of a plea the defendant HAS TO answer questions from the Court to establish a factual basis for the plea. The defense attorney doesn’t have a choice.

I may misunderstood what you were saying, but it is the judge’s job to ensure that the defendant actually did the crime for which they are taking a plea to; since he plead ‘guilty’ and not ‘no contest’, the defendant has to state what he did that makes him guilty. Also the prosecutor cannot use his statements while taking a plea against him during the jury trial.

I do this shit every day. the judge was doing a standard plea colloquy, including probing deeper into inconsistent answers… which every judge does in a plea colloquy. they need to confirm factual basis and that the plea is knowing and voluntary. he wasn’t “prosecuting.” if the prosecutor didn’t withdraw the plea offer, he was almost certainly going to reject the plea. that’s not prosecuting. that’s the basic role of a judge in a plea.

Withdrew because this guy is not willing to simply accept his responsibility. It’s simple really. Rather than try and explain things away as if he wasn’t really to blame. Say, “ I drove drunk. I drank this, I chose to drive. I can’t remember all that I did because I was too drunk.”
This guy is claiming a date rape drug. He’s claiming four or five beers. He’s then going back to Jungle Juice. He claims to have driven back looking for a mail box he “didn’t” hit. His car wasn’t damaged but now has damage but that damage is caused by something completely different.
If you want a plea, allocution needs to be as exact and as accepting as possible. If you can’t remember, simply say that you were too drunk to remember. This guy is a joke and a liar. He is minimizing his actions and deflection responsibility right after he says that he accepts responsibility. The court needs to hear what he is accepting responsibility for. This guy cannot do that. It’s not within him to do that. Yet he claims to be some sort of professional.
The defence lawyer was very ignorant ,he did not stand when talking to the court unlike the prosecution lady. Maybe with his knowledge of blackouts he admitted to he too was under the influence and was unsteady on his feet.

@ lol all of your youtube watching? talk to literally any practicing lawyer. no one is saying that while in a hearing being filmed. they’re norms that are discussed among attorneys and with judges off the record. you have no idea what you are talking about. the vast majority of judges do not want or expect you to stand when no jury is present.
