Hi - what about if the property/land is owned by several tenants and the area in question is a greenery area which is at a meter high from the ground and no one can actually walk on it. Would any tenant have any easement rights to that piece of land?
I have a vacant rural property that is land locked. A few years ago the Utility company came through and cut a road sized trail back to my property and put up powerlines on the trail. They used the neighboring property off the main road. Can I use that utility road as an easement to my property?
Look up local easement laws of your location. Focus on the type no of easement called a public right of way.. local government maintains a formal record of public Right of Ways.
The local power company has power lines running over the middle of my property, as low as 20 Feet above my property. They cut half of my cherry tree growth annually for clearance. However, there is no easement for them. Title search shows no easement and there are no easements of record that I can find. Doesn't every easement, regardless of origin, required to be defined legally?
@@mark97213 easement by condemnation, and/or eminent domain. They should have given you a notice they were going to do that and went through the proper steps. At any rate, they owe you compensation for it. Depends in your state laws of course, but sounds like they're trying to squeak by without notice, and then claim squatters rights. That would be the easiest route for them,.
I had an easement question, and wanted to know if the following scenario falls under "an easement of necessity." If I was to purchase land that was inaccessible, except through a security gated driveway that the adjacent land owner paved onto the property that I am to purchase, and I checked city records and discovered no registered easements from the seller of the land, nor the adjacent property owner allowing him to pave a driveway onto that land, if I purchase the land, am I automatically granted an easement of necessity? If not, what type of easement am I granted, or will I need the city to force the adjacent property owner to enter into some other sort of easement (right of way, reciprocal, etc.)?
