It was a good decision by SC but it needs certain amendment for avoiding the immediate divorce , like SC should make the provision under article 141 that for divorcing , all have to take permission by the local court of their jurisdiction and punishment should be for 2 year of jail..

Muslim Women Rights Day 2023 - 1st August
मुस्लिम महिला (विवाह पर अधिकारों का संरक्षण) अधिनियम, 2019 के अधिनियमन के उपलक्ष्य में 1 अगस्त को पूरे भारत में मुस्लिम महिला अधिकार दिवस मनाया जाता है, जो भारत में तीन तलाक की प्रथा पर प्रतिबंध लगाता है।
• 1 अगस्त 2023 को चौथा मुस्लिम महिला अधिकार दिवस मनाया जाता है।
• कानून ने घोषणा की कि तीन तलाक एक संज्ञेय और गैर-जमानती अपराध है और ऐसे किसी भी अपराधी को तीन साल की कैद की सजा भी दी जाएगी।
• पहला मुस्लिम महिला अधिकार दिवस 1 अगस्त 2020 को मनाया गया।
तीन तलाक:--
1. 'तलाक' शब्द अरबी कविता से लिया गया है जिसका अर्थ है 'गांठ को खोलना या खोलना' जो तलाक या विवाह के विघटन को संदर्भित करता है।
2. यह मुस्लिम समुदाय में प्रचलित प्रथा है जो एक पति को तीन बार 'तलाक' कहकर तुरंत अपनी पत्नी को तलाक देने की अनुमति देती है।
3. मुस्लिम कानून के तहत, तीन तलाक का मतलब अंततः या तुरंत विवाह के रिश्ते से मुक्ति है।
4.इस तत्काल तलाक को ट्रिपल तलाक कहा जाता है, जिसे तलाक-ए-बिद्दत भी कहा जाता है।
पृष्ठभूमि:--
अगस्त 2017 में, सुप्रीम कोर्ट की पांच-न्यायाधीशों की पीठ ने तलाक-ए-बिद्दत (पति द्वारा लगातार तीन बार तलाक कहने पर आधारित तलाक का एक विधर्मी रूप) की प्रथा को असंवैधानिक घोषित कर दिया था। इस विधेयक को राज्य में विरोध का सामना करना पड़ा। सभा, जिसके कारण शुरुआती रुकावट आई, लेकिन इसे जुलाई 2019 में संसद के दोनों सदनों द्वारा फिर से पेश किया गया और सफलतापूर्वक पारित किया गया।
# ट्रिपल तलाक बिल जिसे मुस्लिम महिला (विवाह पर अधिकारों का संरक्षण) अधिनियम, 2019 के रूप में भी जाना जाता है, 30 जुलाई 2019 को भारतीय संसद द्वारा पारित किया गया था, ताकि किसी भी रूप में तत्काल ट्रिपल तलाक जैसे कि मौखिक, लिखित या इलेक्ट्रॉनिक द्वारा दिया गया तीन तलाक अमान्य और आपराधिक की सूची में आएगा और इसके खिलाफ दंडनीय अपराध लागू होगा.
# तत्कालीन राष्ट्रपति राम नाथ कोविंद ने 1 अगस्त 2019 को विधेयक पर अपनी सहमति दी और भारत में तीन तलाक को अपराध घोषित कर दिया।
# 2020 में, अल्पसंख्यक मामलों के मंत्रालय ने 1 अगस्त को 'मुस्लिम महिला अधिकार दिवस' (मुस्लिम महिला अधिकार दिवस) मनाने की शुरुआत की थी।
अन्य देशों में तीन तलाक:--
• मिस्र पहला सबसे अधिक मुस्लिम आबादी वाला देश था जिसने 1929 में तीन तलाक को समाप्त किया। सूडान ने 1929 में, पाकिस्तान ने 1956 में, बांग्लादेश ने 1972 में, इराक ने 1959 में, सीरिया ने 1953 में और मलेशिया ने 1969 में तीन तलाक की प्रथा को समाप्त कर दिया।
• साइप्रस, जॉर्डन, अल्जीरिया, ईरान, ब्रुनेई, मोरक्को, कतर, संयुक्त अरब अमीरात (यूएई) ने भी कई साल पहले तीन तलाक को असंवैधानिक घोषित कर दिया था।
नोट:--अन्य मुस्लिम देशों जैसे कि सऊदी अरब पाकिस्तान अफ़ग़ानिस्तान सीरिया और अन्य प्रमुख मुस्लिम देशों में तीन तलाक़ प्रथा अपराध घोषित किया गया है।

In Hindu marriage act it is important to give divorce which is settled in court and women are entitled to alimony as well, if children present the question of custody and again support for child everything is discussed and settled.. Here in case of Muslim marriage if the man gives triple talaq to women in writing , SMS or on face and will not be entitled to anything w.r. t his wife or kids it is a serious offence. Since these were carried out in large scale, the necessity to stop this act also becomes serious in nature. If not for punishment there must be a proper way to setup the divorce for that religion. All this came into picture when India could not have a uniform civil immediately after independence. What was the need for separate marriage acts as well ?
How are they protecting women by making them live with a person who is not willing to live with that women
It will only result in more crime if someone is forced to live with some other person.
It's better to get separated if one of them in any relation doesn't want to make it go further.
Giving divorce shouldn't be criminal when it's civil in nature
Govt action over triple talaq is not more than political tactics. Supreme court is enough to take proper action on it. So, it's my personal opening that the instant triple talaq must be removed with sort of financial penalty but not by criminal order like 3 years jail and etc since it's not a super crime. If govt wants to do something for Muslim women then provide them monthly maintenance after talaq to support them financially.

Aapne ye nhi btaya ki art 141 mei ye bhi likha hai ki jb kisi vishaya pr law nhi exist krti, uss case mei jb tk Parliament koi law nhi law payi hai, then, sirf uss samay tk k liye hi ( for the time being) jo law Supreme Court nei art 141 ko exercise krtei huey bnayi hai, wo hi chalegi/ prevail kregi.. Ye toh niyam hi hai ki Parliamentary law Judge made law se oopr hogi.

अल्लाह के रेहम से किसी शादीशुदा महिला को तलाक़ ना मिले, हर परिवार में सब सदस्य अपने जीवन काल में राजी ख़ुशी रहे. और किसी अन्य विवाद के कारण आपसी रज़ामंदी से कोई अलग होना चाहे तोह उस कार्रवाई में मानवता के आधार पर और सरल निर्णय घर से नज़दीक सुविधाजनक स्थान पर लिया जाये.
शायद किन्ही कारणवश कई घोर सजाओ का ज़िक्र भी है किताबो में, ताकि सभी पुरुष और महिलाये अपनी शादीशुदा जिंदगी कठीण परिस्थिति में भी सज़ा के डर से जारी रखे. इस्लाम में कठीण सजाओ का डर ही दुसरो को अन्य जुर्म करने से रोकता है. पर अब समय बदल गया है, इस शांतिप्रिय वैश्विक दौर में किसी भी मनुष्य को ऐसी सज़ा नहीं देनी चाहिए, अगर किन्ही परिस्थिति में देनी आवशयक है तोह दूसरे सामान्य शांतिप्रिय लोगो को न्यूज़ आइटम बनाकर बतानी नहीं चाहिए. संगीन जुर्मो की कहानियो की बजाय धार्मिक प्रचार ज़्यादा उचित रहेगा
क्योंकि मैं स्वयं मुस्लिम परिवार से नहीं हूँ, उनकी कुरान में कुछ यक़ीनन बहुत अच्छी हिदायते है. पर समय के हिसाब से कुछ परिवर्तन जरुरी है, जो धार्मिक किताबो में संभव नहीं है, जो वास्तव में खेदजनक विषय है
दुनिया में कई भिन्न धर्म है, क्योंकि कोई भी वास्तव में सम्पूर्ण नहीं है, हालाँकि सभी अपनी कुछ ख़ास हिदायतों के लिए लोकप्रिय है. उम्मीद करते है सभी धर्म अपनी धार्मिक किताबो को समय के हिसाब से अपडेट कर लेंगे, जो की बहुत जरुरी है, क्योंकि दुनिया के विभिन्न प्रांतो और सभयताओ के लोग अब साथ में मिलकर कुछ बेहतरीन काम करना चाहते है.
मुझे क्षमा करे अगर किन्ही लोगो की कट्टर भावनाये आहत हो गयी हो. ऊपरवाला सब जानता है की मेरे जैसे हिन्दू व्यक्ति के लिए कुछ अन्य धरम के संतो को अपनाना बहुत आसान है, क्योंकि हिन्दू धरम में तोह हमें लाखो करोडो संतो को झेलना पड़ता है, तोह 7-8 धर्मों के 12-13 संत और सही धन्यवाद् 🤗🙏👍
