    I'm glad the Petito family are pursuing this. They need to know; the Laundries need to come clean! I suspect they DID know, otherwise they wouldn't have got a lawyer involved so early! As a parent, I'd know if my child was hiding something from me.

      GABBY’s Parents have already got her Possessions back. They got them when her Parents went to the FBI headquarters for that Meeting. The Dirty Laundries were there also from what I have heard.

      Lawyers always say call a lawyer first, and then guilty or innocent they'll say to stfu. It makes anyone look guilty and in my opinion hinders the truth from being known. The reasons the lawyers give is that anything you say can be twisted and used. And in court that's absolutely true. Bcuz the immoral will be defending and prosecuting. Most ordinary people can't fathom the levels to which a lawyer will stoop on either side. I'm not anti lawyer but I am anti immoral twisting and that's a lake attorneys have often dipped.

      There are FBI offices in every major city in the US. They are called "field offices". So no reason to get snarky. I don't know what the Petito family.was given but to back the post you are replying to, it was released on media that the all parents agreed on who belonged to what. What the FBI and other law enforcement agencies kept as part of their evidence we don't know. I wonder if the real reason for this lawsuit is to push for the revelation of exactly what was said in the journal etc found near Brian's remains. Because even if his parents knew before he was found dead 1) how would they prove that and 2) how is that grounds for litigation? Gabby was dead by the time Brian got home so they can't say if they had revealed any information it might have saved her life. I can see why the LEOs might want to charge them with obstruction but apparently they aren't going to. I can't see how it's grounds for a lawsuit and it won't bring her back. I have to believe there is some reason other than just vengeance.

    I believe Brian Laundrie's parents did cause Gabby's parents undue pain and suffering and should be held accountable. This again is only my opinion!

      @@sr2291 they're not responsible for his behaviour but they're responsible for their own behaviour in all of this, which wasn't exactly stellar. They're not being charged with murder, they're being sued for causing pain and suffering by their behaviour, i.e. avoiding, blocking Gabby's parents when they were trying to contact them to get answers; lawyering up, most likely aiding and abetting a murderer. So please.

    #HeyJB I think everyone of us have thought at one time or another that Brian's parents knew what happened. The camping trip I believe was sort of a last family get together for them.

    I am so glad Gabby’s parents are suing the Laundries. They are saying the Laundries knew that Brian killed Gabby but would not say anything.

    It makes a lot of sense now that the FBI filed the bank fraud charges against Brian. If they believed the Laundries were going to help Brian escape overseas, it becomes a crime to do so once he is wanted for a crime.

    Civil law is alot different then criminal law! Civil law takes less evidence to prove. Let this Jury decide this lawsuit!

      This is both true and false, the plaintiff has the burden and obligation to prove the case with stronger evidence than the defendant has. This is called the “preponderance of the evidence” standard. If the Petitos have strictly hearsay and circumstantial evidence even a jury would not rule in their favor. Personally I see why they want a jury trial versus a bench trial, judges are much harder to please than a jury specifically in civil trials.

      I believe if the Plaintiffs' can convince that jury that the greater preponderance of the evidence proves what is alleged in their complaint, they win. I believe a jury trial was a smart move, every parent can sympathize with the Plaintiffs'.

The jury is simiply suppose to be unbiased and use the evidence to come up with a verdict, do they have a better chance with a jury over a bench trial, yes but it is still going to be hard to win this civil suit.

      @@theguy81642 Emotion should not enter into the greater weight of the evidence but no one can turn on the full spectrum of emotions that come from being a parent and sympathizing with parents that lost their 22 year old. This would be the same scenario you would use peremptory challenges for. If you are defending a murderer and a potential juror has had a family member murdered, you would want them removed. Those jurors will absolutely have emotions about this. We hope this does not factor into their decision but having been on a jury many many years ago, emotions are a topic in that jury room. I believe it will be in this case.

      Read the aiding and abetting law in Florida. It talks about aiding and abetting an offender. Brian wasnt even an offender.
      777.03 Accessory after the fact.-

      (b) Any person who maintains or assists the principal or accessory before the fact, or gives the offender any other aid, knowing that the offender had committed the offense of child abuse, neglect of a child, aggravated child abuse, aggravated manslaughter of a child under 18 years of age, or murder of a child under 18 years of age, or had been an accessory thereto before the fact, with the intent that the offender avoids or escapes detection, arrest, trial, or punishment, is an accessory after the fact unless the court finds that the person is a victim of domestic violence.
      (c) Any person who maintains or assists the principal or an accessory before the fact, or gives the offender any other aid, knowing that the offender had committed a crime and such crime was a capital, life, first degree, or second degree felony, or had been an accessory thereto before the fact, with the intent that the offender avoids or escapes detection, arrest, trial, or punishment, is an accessory after the fact.
      (2)(a) If the felony offense committed is a capital felony, the offense of accessory after the fact is a felony of the first degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.

    The Laundrie's were absolutely cruel to the Petito's/Schmidt's. I'm so happy to hear that they are going after them. I believe that the Laundrie's did know that their son had murdered Gabby and I pray that this can be proven. I think that the Laundrie's need to get jail time and fines for what they did to Gabby's family. If we don't punish wrongdoing like this it will continue to occur. I don't think that I would have been able to handle this as gracefully as they have, I can't imagine their pain and suffering. I have 2 children and 3 grandchildren, and if something happened to one of them I would have fallen completely apart and handled it very badly. It is the Laundrie's cruelty that really gets to me here. They should rot in hell for that.

    Unfortunately there’s not enough money in the world from any lawsuit that can make up for what the Laundries unnecessarily put Gabby’s family through ..., it was beyond unconscionable & morally deprived. The Laundries only match for friends are the parents of Ethan Crumbley.

      Is there evidence that the Laudries knew that Brian killed Gabby?
      That's a sticking point that would blow this case wide open if there's evidence that his parents knew what he did and deliberately covered it up.
      Since the Laudries haven't commented, we don't know anything for sure, yet

    She was gorgeous and full of life, sharing her adventure with the world. Her life was ahead of her, who knows what she would have created and what we were all robbed of. No hair on her head should have been harmed for any reason, let alone from her fiance. It's despicable what he did and it's despicable the way his parents treated hers. Brian and his parents are cut from the same cloth; evil people who need to be punished, for their gross immoral behaviour which is reprehensible to society. My heart extends to her family and those who were truly close to her as obviously the Laundries were not.

      So... this is a tad gas lighting. Let me explain why. Gabby is the one who was charged as the abuser. Its possible that Brian reacted as any abused partner would. Does this sound reprehensible? It IS a possibility. Facts are that we just don't know the entire dynamic.
      And similarly, this family, as much as they are hurting, its coming out in an unhealthy anger. Since they can't blame Brian, they are going after his parents. Its just wrong. Like so much else here, WE do not know so, so, so many facts. And Brians family is suffering already too, on a whole other level. I hope this lawsuit is tossed because its emotionally based, inappropriately in my estimation, and not legally based. The Laundrie Family is not liable for anything that I can see.

Can’t help but also assume Brian was trying to avoid the last known area of Gabby and send that in hopes that the focus of any search would be far from where they actually were.

      Wives, lawyers, priests, and psychologists I believe are exempt from prosecution; otherwise everyone else would be. There's a case in Florida where a family hid a man (after killing his pregnant girlfriend and a female officer) and they were sent to prison, so I would think the Laundries would as guilty as they were.

    Gabby lived with Brian and his parents for 2 years and Brian confessed to killing her to them and their attorney stated that the Laundries "... have no OBLIGATION to Law Enforcement... or the Petito family". This is why MORAL OBLIGATION comes into play and the lawsuit needs to proceed. ⚖

    We were all told about the blunt force trauma to the head and neck in the posted coroner affidavit. We also heard John Walsh slip information prior to the report release where he said she was beaten, will never forget those words.

    As a mother I sit here wondering if this was my child then what would I feel was justice. I don’t know that answer because Brian is dead.
    I’ve always felt his family helped his hinder the investigation into gabbys disappearance - I believe they helped him clean the van - ( there’s pictures) I believe he told them what he had done and I believe they advised him to stone wall via a lawyer.
    I also believe he’s no longer living because his parents helped him avoid talking to the police which have lead to his arrest and sui watch would have been in place. So they have to live with that on them and gabby. So idk what is enough for them.
    Having the world know what they knew and did would be some little form of justice but nothing will bring their daughter back and nobody is serving a single day in jail. It’s awful. I can’t imagine and I feel horrible for her family.

His parents think that we as the public forgot, details : Brian’s friend in New York worked with Him, at some kind of Garden Center, and Brian was fired due to his temper tantrum…. Also, was stated : That Brian was a patient in a Mental Hospital, in New Jersey, years ago ! Now, those are public records, they should be searched out, and do some research on his Past ! Just why was Brian in a Mental Hospital, His parents have to have knowledge of that Record ! His mother worked for an attorney years ago ? Something to that effect ? His parents have covered up everything very well !

    I have said from the beginning, the biggest red flag about this tragedy was the fact the Laundrie's ignored calls/texts from Gabby's family during those first couple of weeks. The ONLY reason they would do that is because they knew. There is no other reason they would have not communicated with Gabby's family and try and help in any way they could, during that time to try and find Gabby.

    If they had made Brian turn himself in right away and be open and honest that entire circus that costed millions would not have been necessary and their son may still be alive. Their silence caused a huge mess. Gabby would not have been left to rot for weeks. They stayed silent to preserve their egos, and sacrificed their own son in the process.     We had speculation that the Laundries knew that Gabby was dead and not telling anyone and trying to help Brian flee persecution. It’s a MORAL law to tell LE and the family of a deceased person, that their loved one is dead. But, obviously Chris and Roberta Laundrie, along with Bertilino, don’t have any MORAL law to their characters. They live within their own law which makes them subhuman to me. My heart and prayers are with Gabby’s family and I can’t wait for them to win their lawsuit. It probably won’t make any difference to the Laundries and Bertilino, but I don’t care. I want the Petito’s and Schmidt’s to win. Go for Gabby !!! ♥️♥️♥️♥️♥️♥️♥️

      On the contrary, there was plenty of evidence that Gabby often 'went after' Brian when she'd lose her temper. And it was not in 'self defense'.
      Moab police has photo's of Brian's, scratched up face. Rose, Gabby's best friend, described this physical violence of Gabby toward Brian...not the other way around.
      That interview of Rose describing how Gabby would lose her temper and go after Brian's face with her nails - was televised. I watched it. she added that Brian would either push her away, or put a hand over her mouth and get her off him that way.

    I am still so upset about Gabby Petito"s murder. From the moment I watched the traffic stop, I knew Gabby was in grave danger. I totally hold the police officers culpable because of their handling of the incident, especially in light of that female officer correctly reading the situation. This just should not have happened and the Laundries are guilty of helping their son if not legally, then most definitely morally.

      Gabby was an adult. She made some bad choices but did not deserve to be murdered. The officers did what they could. The outcome was not their fault. She had multiple chances to escape without Brian - including the night of the vehicle stop. The vehicle was hers.
      She could have left him there and headed back to her parents or contacted them for help. There was also the time in Utah where Brian flew to Florida and left her in Salt Lake. She could have booked then as well.

There are changes that occur in the brain and physiological and psychological effects associated with both physical and emotional/psychological abuse.     I am so glad Gabby’s parents are suing the Laundries. They think the Laundries knew that Brian killed Gabby but would not say anything.

      That charge may come if it can be shown they lied to investigators. (And then if a prosecutor wants to charge them.)
      As I understand the Florida statutes, you can help a close family member after they've committed a crime but you cannot mislead the investigators.
      For example, you can know your son killed his girlfriend. You can know he ran off in the swamp. When the investigators ask you if you know where he is you can answer truthfully or you can refer them to your lawyer (remain silent) and you'll still be within the law.
      You cannot say, for example, he went to Mexico.

The "related person's exemption" covers obstruction because in the scope of "accessory after the fact" is lumped into helping your immediate relative in any way including evading LEOs, lie about whereabouts of that person, fund, provide shelter etc it is all considered after the fact. Here is the statues exact wording.
      Florida Statute 777.03 defines what it means to be an accessory after the fact in Florida. When you violate this law, you assist someone after he or she has committed a felony by helping in his or her evade arrest, trial, conviction or punishment. In so doing, you yourself commit a felony offense.
      However, there is an important exception written into the law, known as the “related person exemption.” This provision holds that an individual can’t be charged with accessory after the fact if they are the suspect’s:
      Wife
      Husband
      Parent
      Grandparent
      Child
      Grandchild
      Brother (by blood or marriage)
      Sister (by blood or marriage)
      Lying to LEO would be considered as "helping evade arrest"

    My daughters boyfriend murdered my daughter. I sort of understand his parents' "problem" but to not say ANYTHING to her parents is inexcusable. I never understood how the mother of my daughters murderer couldn't at least say something to me....some type of apology...just something💔

    #HeyJB - Cassie is probably not included in the lawsuit because she might have been the one to have furnished information behind the lawsuit's allegations. She may have told them her parents knew certain things and when and may have found out since that they were trying to find a way to help him leave the country. She might become the chief witness for the Plaintiffs!

      Civil lawsuits have a much lower burden of proof than criminal indictments. I cannot see a jury or judge for that matter letting Brian Laundrie's parents off Scott free for doing what they did.
      In discovery motions as well as depositions the attorney for the Petito family can get the court to order text messages, emails, as well as voice mail which can be obtained messages with a court order from a judge. Also materials and reports from the
      police and FBI that may have uncovered proof the Laundrie knew.
      In Fla. an immediate family member who resides in the same home is not obligated to report it to the police...But in a civil court, the Laundries can be held accountable for not disclosing that they knew Gabby was deceased. I think the Petito family has a very good chance of winning this lawsuit and I hope they do!

    I'm not saying I'm glad that Brian did what he did to himself. And I feel the pain of his family. But reality is BL created the situation by killing gabby. And he created (in his mind) the solution. No one forced him to end his life. I'm sorry for loss of the parents but he created everything. Even putting parents into the situation. He should have never killed her in the first place but after he did, he should have manned up and turned himself in. But I doubt he has never been required to man-up.

      I kinda understand his mindset and why Brian killed Gabby.
      My ex abused me for years. There were times I wished him dead all day long. I never mean to hurt my ex, but i was never strong enough mentally to leave my emotionally abusive relationship. I thought "his death" was the only solution and option left. I only wanted to end my pain and suffering.
      I left him in the end, I never killed him. Brian probably felt the same way I did when he killed Gabby - that was the only solution and option left.
      It may not be easy or quick to end a dysfunctional relationship, and things get more complicated from the inside.
      When someone you love hurts you, you can hold on to anger, resentment, and revenge, but most "weak" people can't do it. Emotions make us feel but they also make us act. Emotions can play an important role in how we think and behave.

      @@Cautionary_Tale_Harris Florida statue states that it is illegal to aid a criminal if you know of the crime, and aiding and abetting after the fact, whether or not you witnessed the crime.
      The penalty given depends on the level of crime. If he was charged with a capital offense them aiding him would be a 1st degree felony, and considering it was murder in the first degree because he clearly had intent to end her life it would be considered capitol therefore his parents could be charged with a felony if this truly is what happened and it can be proven. But if they knew she was dead and let it drag on for weeks, they will definitely be brought up on some sort of charge. Id hope.
      However at the time of his and her disappearance he hadn't been charged with any crime, which may interfere. I'm not sure how that is going to be viewed if it's taken to a court room.

    This is a civil lawsuit. That means no criminal charges are being pressed but they are seeking financial compensation. A person can be found not guilty in a criminal matter but held responsible in a civil suit. Good for them. They may eventually have grounds for a criminal case with obstruction, aiding, or conspiring.

    At this point, there can't be much justice for Gabby, but more importantly, there CAN be for her parents and their families, who were forced to spend thousands of dollars and likely leave their jobs temporarily because the Laundrie family (including Brian) wouldn't cooperate with them and tell them where Gabby was for all of those weeks, wouldn't tell them what happened, and we know that Brian stole money from Gabby's card on his trip back home. I'm also assuming that the Petito family was forced to pay impound fees for the van and took a loss on the vehicle due to its condition after it was customized. This lawsuit could be the only way that the families of Gabby's parents can recover those monetary losses; sadly, they will never regain her life, which was priceless.

    The Gabby and Brian's family spent 8 hours with the FBI sorting through both of their belongings. I believe that's when the Petito family read the notebook of Brian's. I truly believe they know they can back up this lawsuit with overwhelming evidence. This is going to be so interesting and maybe the answers we are all looking for. I hope this reveals the truth and gives justice for Gabby and her family. Xxx

    The attorney will conduct discovery if the Complaint survives a Motion to Dismiss. The burden is less in civil court than criminal court but you can't sue on speculation. I doubt Brian's family will admit anything.

      Lets hope they have evidence, the call to retain attorney is pretty damning. Attorney will also have to testify in a jury trial and hopefully can no longer represent them. If they knew, they knew and were aiding and abedding, how can the attorney say the parents didnt have to speak to anyone? This whole case is such a cluster.

      I hope thatvthis case goes to court and all ofbtheir actions be scrutinized. Because I believe they planted those bones....and the personal belongings found. Now the mother is still asking for Brian's notebook.....seriously.
      Let's pray, that thus goes to court so we can all hear the truth.....and hopefully evidence to support these allegations.

    The parents need to be jailed ASAP!!! THEY KNEW ALL ALONG!!!
