    You cannot be evicted without a court order. If I paid my rent. I would wait for my day in court.

      Correct. Most landlords do not have to give you a new lease when yours expires tho.

    This happened to me last year, I was paying $750. Once I moved the landlord rerented the place for $1400. I left the place spotless with the yard manicured but still never got my $550. deposit back. Congress needs to do something about these price gouging landlords asap.

      That's a state issue not one for the federal government. People seem to love the governor in Texas which emboldened him to do even more crazy stuff. In New York the landlord would have to go to court for hearing and get an eviction notice. Also it's illegal to withhold the security deposit unless they can show proof of damage.

      In most states, the landlord is required to inform you in writing with 21-30 days, dependent on your state, why they withheld your deposit or they are responsible to pay you double the deposit. You have to file in a certain time too

    ANYONE WHO RECEIVED RENTAL ASSISTANCE AND STILL GOT AN EVICTION LETTER, THE RENTAL ASSISTANCE PROGRAM SHOULD GET ITS MONEY BACK FROM THE APARTMENTS.

      They Aren't getting evicted because they didn't pay rent. They're getting evicted because they're on a month to month without a current lease (or this wouldn't be possible) and the complex wants to get new tenants in. This can happen to ANYONE at ANYTIME if you don't have a lease stating otherwise in Texas. It sucks I know but it's TX

THE ACTION THE APARTMENT IS TAKING IS BECAUSE THEY DO NOT WANT THEIR PROFITS DETERMINED BY THE GOVERNMENT; THAT IS THE REASON THEY DO NOT WANT VOUCHERS. THE GOVERNMENT SHOULD GET THEIR MONEY BACK OR AT LEAST A PERCENTAGE TO HELP THE FAMILY MOVE SOMEWHERE ELSE SINCE THE EVICTIONS WERE UNFORESEEN.       @@Allpie_isgoodpie happened to my family after landlord was paid in Texas rental relief. We were all of 16 days late on rent (basically the time we were waiting for the funds to arrive) Landlord filed. JP Abated for 60 days to allow funds to arrive, clear the bank account and be paid out to landlord. All was done 48hrs after hearing. Once funds paid in full to landlord we had a lease termination posted and in jeopardy of being homeless. Even though we had a 60 day Abatement per the 44th Emergency Order, landlords attorney did some backdoor filing with JP and amended the original case to now show as a lease termination. We tried to fight it because it was not done or filed properly. (we should have had all records sealed and if he wanted to terminate lease a whole new case should have been started) Because rental relief funds were accepted the lease was not allowed to be changed, terminated, or rental amounts increased for the time that rental relief was taken... Ex. Dec and Jan were paid by TRR so at the earliest any changes or termination of lease could not have been set in motion until March 1st.... (lease states that we were to be given 30 day notice of any changes, termination or increases to rent... so February1 was the start of 30 notice...
      This is not how anything was handled, instead the JP allowed him to amended and go against the 44 and 47 Emergency Orders and we were "evicted" in March.
      Myself, my disabled veteran partner, and my disabled mother (bedbound, o2 dependent, many health care needs) were left with no where to go. It was impossible to find a rental that fit our needs ( layout and location were very important because of wheelchair accommodations and community services also in place that would fit out price range. 1600-1950.... Everything was either not available until April or May, already under a new lease, or plain out dirty dumps and not worth 100s let alone 1000s a month.
      Texas JPs have done a lot of wrong to TRR renters. Landlords should not be allowed to get away with what they have done. We have been without a residence now since March... DEPRESSED AND UNSURE OF THE FUTURE... And to make matters completely worse... We found out, after my mom was taken to the hospital for issues with her diabetes and extreme pain in her back and lower stomach that she has stage 4 cancer... it is on her liver, stomach and colon. She has refused any treatment measures... she had a colonic tunnel procedure and is entering hospice services. We have been completely uprooted, and have no where to go as of yet... How can we be shut out like this when we were current on rental payments (we were 3 months ahead in payments when most landlords were 3 months in the hole) We have be let down by Texas and the courts... WE want change... TRR was ment to lower the eviction rates.... but I believe it has allowed for greedy landlords to cash in on large upfront payments and still do evictions by deceptive practices... Would love to see changes and have no problem sharing our situation. Maybe the press can reach out to us and can help me brainstorm a way to help my family and others navigate a horrible housing situation and the resources that should be in place for our Veterans and disabled seniors!!!!

      It pays BACK rent which currently makes you up to date. Because you have not willingly paid rent get out because you are a tenant that can’t be trusted with a rental.

    Also that area is off Bissonnet St. No one is going to pay extreme rent costs to live in that area. It’s high in crime and prostitution. They’ll do better keeping any resident who’s willing to stay and keep money flowing. Once everyone leaves that property will go down. That area is undesirable.

      Crazy enough the landlords don’t seem to get that. They’ll charge the same amount as places that are high end or close to it and apparently people will pay it. Probably people from out of town not knowing any better.

    If they are on rental assistance they can NOT be evicted for the months that rent assist paid for. And rent assist typically pays back rents and several months ahead. Yes it takes time for rent assist to pay out, but if approved they do pay. I have several residents all owing.over $14,000.00 each in back rent, and since were waiting for funds from the state, I can not start eviction. This management company is about to get a very rude awakening.

      The JP courts are not following this rule. They are also carrying out the 44th, 45th and 46th Emergency Orders however they want to... or maybe its their office staff that is making their own rules. We have been evicted after landlord was given TRR funds and the JP Abated our case for 60 days so that funds could be received and paid to landlord.... however the Attorney did some backdoor unethical (In my eyes) filing and was allowed to amend the original case to be a lease termination.... THIS WAS NOT ALLOWED yet we were still being evicted.... Myself, my partner who is a disabled veteran and my mom, a handicapped senior citizen have been without a roof since March 9th. And on top of all this we have been informed that my mom have stage 4 cancer... its on her liver, parts of her stomach, and in her colon... This is not what should be taking place in our lives, especially when we were current on rent and even 3 months ahead at times... We only became 16 days late because we were waiting for the TRR funds to arrive... we have been victims of shady courts, JPs who do as they please, and a County Judge who was just wanting to secure votes for the new term.. (he still lost).... Our landlord accepted and knew that TRR was being used to pay rent.... he never once mentioned that he wanted to terminate our lease... in fact he stated in October that he had a new lease for us to sign but we were never given it by his assistant... fast forward a month and a half and he is filling a lease termination..... I want to make a change and also get help for my family and the help we need to find a home and resources to get the resources and benefits we qualify for...
      I wish I could reach out to the ppp lender of our landlord to remind them that he may of miscounted his employees.... 3 to 5 people seems to be a more accurate description of his employee count... maybe he can take the 700 000.00 to hire a few more employees so it doesn't look like he is a liar..... oh wait never mind he is huge liar.... carry-on!!

      @@candaceismyname5131did the landlord submit a landlord application on your behalf for assistance, as well as you submitting an application? If so they have rules they need to follow. And agreements they make during the process, which typically include not evicting during the process.

      That's the big idea!
      Drive up home prices in order to push the poorer Units of the country into certain areas. Then begin to save them by giving them UBI-Universal Basic Income.
      In the meantime, the richer Units will be more concentrated in the metropolitan areas. These Units will typically fit in into the great reset agenda as they are probably more educated.
      The name of the game is to control the population...YOU are the population. You are not a human being you are a UNIT, no matter what color you are, and the number of units on the planet must be well controlled and well tamed. If a unit is hungry it can't fight. If it is homeless, it can't plan.
      A Unit will own nothing and be happy!
      The battle is to win back your right to be a human being!

    If he was confident he had the law behind him, he wouldn't be hiding. He knows he's in the wrong, the tenants have proof of payment. I imagine he thought they wouldn't fight back because they can't afford legal representation.

      They also didn’t plan on someone having connections with news. I have friends at major news media ABC, KHOU, FOX and Telemundo. They came out with in the 12 hours of receiving that 72 hour noticed. Come to find out they had done this at several apartment complex that they had purchased in Houston area. Do to a law Suilts against them, we can’t go into details till it over.

    These are crazy times. My daughter and I are currently staying with some people right now because my landlords terminated my rental agreement. I never missed a payment, even during covid.

      @@thelittlethings- Not a problem. I went thru similar. The house we were renting got bought out by a she-devil who of course sent a random email wanting to terminate the lease. We ended up in a hotel for a few days until the new place was ready. We made the most of it by having our favorite things from storage right with us ie teddy bears, pillows, photos, electronics and stocked up on snacks (microwave friendly of course). It was also a great way to instill and enforce good housekeeping lol my daughter had no choice but to constantly clean up after herself in such a small shared space lol. I am sure you and your loved ones have also slowly adapted and know that brighter days are coming! Until then dance in the rain, no days wasted🤪✨

    It sounds like the previous owners took the money and bailed. They then turned over the books showing these tenants in arrears to the new owners.

    I can vouch for this absolutely ludicrous situation!!!
    My family paid all bills and rent on time for the last 7 year's. We're military on a fixed income as well. The property jumped from 92k to 194k in 6 months and we were evicted for no cause. Unbelievable.

      @@samthepoet107 with a month to month lease, they aren't required to give us a reason. Just the 30 day notice and as tenants, that is how you give notice of vacate as well. Only messed up thing is while there are good people who conducted 7+ years of loyalty and never caused any problems...then we're searching and there's still people squatting in others homes...

      the rent should have been raised annually by 5% plus CPI every year since then. People on fixed income need to move to where they could afford to buy their own property. be ready, the bubble will burst very soon with lots of opportunity for the thrifty

      Yep our landlords a year ago were local, had an office location right in town! They weren't at all times nice, but they were fair in most cases. The pandemic moratorium screwed a lot of property management companies over.
      Now, as of last Fall, our new landlords are several states away in NEW JERSEY! And taking literally EVERY opportunity to make a buck they can...all while blatantly ignoring the needs of tenants! It's greedy, corruptible, & sickening!!

    This is why tenants shouldn’t have participated in eviction moratorium and kept paying rent. Your other bills could’ve been deferred, but you have to keep a roof over your head. Now that the landlords got their money from the government they are evicting people even if they are now able to pay.

      We paid rent the entire time, were NOT late ever. We had a Marine Veteran that was head of our household. He had had ongoing health issues several years & last year around Labor Day weekend, his failing heart finally gave out.
      After that new landlords took over our property, the one agency that at some time helped us with move-in expenses had closed their doors, & our rent went consequently from a Vets discounted $650 a month, to $1000, nearly overnight!
      Now, mind you we live in a ghetto place. Rents have been fairly cheap for most part for those on disability or Social Security checks, for instance. Working families even had reasonable rates for awhile.
      Now everyone pays $1000/month for 1Bd, $1200 for 2Bds. Regardless if on fixed income, disabled, veterans working or not!! And most places elsewhere in town are gonna be $1500 AND UP, when a year or so ago you could get a decent 2-3 Bd for about $800-$900, now those same Apts or condos rent for easily $2000 avg!!
      THIS IS NUTS!!!

    The news couldn’t really believe that man cares or feels anything for those people.
    The state just needs to help them find housing before they end up homeless. The minute the new owners purchased it they knew what they were going to do. It happens all the time and law makers do not care because if they did they would make a rule that prevents this from happening but guess what they won’t.

    Tennessee laws favor landlords. My sister in law needed someone in a condo she and her husband bought so we moved in. We paid rent on time and i even did repairs for free because they were family. March 2020. I hand delivered the rent in cash to her husband. After laughing and joking i went back home only to wake up to an eviction notice. The cowards didnt give warning and evicted us because they couldnt afford the condo with the rent they charged us. It doesnt matter . the court says you have to do what the homeowner says. Bam! Evicted by family!

    Unfortunately, in Texas the laws favor landlords & property owners over tenants. Always always make sure you have a lease and read your lease before you sign. It's the only way you have any rights. Rent is going up and will continue. If you can, sign a 2 or more year lease that locks your rent at that price. Things aren't going to get better regarding affordable housing here any time soon

      No, still doesn't matter. Judges are in it with the landlords. Tenants do not pay taxes. Plain and simple. Judges, especially justices of the peace are elected in. They don't want to offend tax paying constituents. Tenants expendable. Also justices do not have to know the law. They only have to take what amounts to continuing education courses! They influenced by the attorneys. They have no clue to the laws they were sworn to uphold. Its a joke

    I’m dealing with this same situation, my landlord didn’t even give us time to vacate, we were just evicted like trash… we have proof of rent being payed in full amount and on time.
    We don’t know where to go :(

    Don’t blame on the property owners. Blame the government. I am the property owner and I always try to keep my tenants stay long and helping them but the tax I have to pay is so high I have to raise the rent to make up for the tax and insurance. Example 2 years ago they appraised my house $190 thousand I rented 1400 a month. Last year they appraised my house to 220 thousands I still keep the rent at $1400. But this year they appraised my house 270 thousands ( almost $9000 in tax, association fee and insurance that is about $12,000 without mortgage) if I keep the rent at $1400 or even $1600 a month I am in trouble but if I raised the rent to the neighborhood average is $1850- $1950 which mean the renters can not afford. So who fault is it? The tax has to base on the lease contract too. If the rent is low they have to lower the Tex but if the rent is high they have to pay the tax that is good for the tenants. That is the government is helping the renters. The more tax the owner has to pay the renters have to pay to make up the the difference. How is it sound? The owner is not only protest the tax but also the renters have to protest too.

      You are correct, most people that rent dont realize that TX property taxes are what is to blame. With the higher appraisals come higher taxes that have to be passed onto the renter. Sorry, but we should all be fighting for property tax relief in TX instead of blaming all property owners for the actions of a small number of owners that are doing it the wrong way!!

      @@rennieden6130 there is no tax exemption for investment. Property. Exemption is ONLY apply for owner occupied. If the renters want or expect the lower rent. You have to shout out loud for property tax and not sitting there blaming the owners. The more they are raising tax and the more renters have to pay.

    This happened to my friend, Texas rent relief paid her rent up, but they still evicted her. She had to move back to new York. Also just like those apartments here, our apartments never answer the phone for us. I sat in the lobby and watched them pick the phone up and hang it right up and showed the manager and he said there was nothing he could do about that

    I payed off my mortgage in 2019 and every nickel and dime landlord and two for a penny investors wants to buy it from me but my house is a investment in meeeeeee so I will never have to pay rent for as long as I live. Plus I found a bunch of money to save and I am saving every dime of it so if I sell my house then I would have to pay rent or buy another house so i am not going to be that stupid

    Very sus having the grant money disappear to cover the rest of the year and then have them evicted. I think they're trying to move as fast as possible so they don't have to deal with the legal actions and keep that money.

      a lot of landlords are getting out of the business because of the abuses of tenants who havent lost their jobs, or had savings, other assets and still didnt pay rent. I have 2 rentals that I didnt raise rent for 8 years. Now I will raise rent by 5% plus CPI EVERY YEAR to make up for the abuse to small landlords. The govt had the audacity to allow tenants to stop paying rent without cause, while they still demanded maintenace,, PROPERTY TAXES , utilities paid if, HOA fees and on and on.

      You would also destroy your credit rating. The tenants being kicked out have a clean record of payments. They will probably struggle to find somewhere else affordable, but bad credit won't be one of the problems.

    As someone who works in property management, I'll tell you right now that technically corporate doesn't allow you to answer questions about units to anyone other than the lease holder. Just giving some context on why these guys never answer reporters.

    I have always heard the devil is in the details. Read your lease agreement with the past owner and current owner. See if there have been any changes that you may have missed. Get attorney and fight unfair evictions. If you don't, you are part of the problem. Never give up no matter what.

    Ive been homeless by choice for a year. Even tho I qualify for an apartment, I do my laundry every week, I shower every day. I work 50 hours a week, go to college, church every sunday. I don't drink, smoke or do drugs. I just woke up one day realized my rent has tripled since I started renting and decided Id rather jump off a bridge than give another sleezy land lord a thousand bucks a month.

    Even where I live I’m noticing more and more landlords are locking up their payment offices early so people are kind of late on their rent and forced to pay an additional 50% of what they’re already paying or they’re facing evictions also somebody needs to stop this

      Have them check with a local housing advocate. The state I managed in went by calendar days meaning if I came in at 8am any rent payments waiting from after I closed the office the day before had to be logged in as the day before. to protect against just that.

      And my friends made sure they had the envelope marked by the post office so it was time stamped for the day of but after 5 PM they’ll count it late

    And then that eviction or potential eviction is on their credit for 7 years to a decade and no one will rent to them and they will probably become homeless. Renters are totally screwed.

    This is criminal. Hopefully the judge will see these are good tenants. We had a nightmare renter who was several months behind on rent and it took a year to get him out of our family's rental...the judge was on his side.

    In some states you can be evicted by the sheriff after a court appearance. The problem I see is month to month and landlord's not willing to renew a yearly lease. Unfortunately or not the landlord has the right to evict just as you have the right to leave within guidelines of the contract. Always have a plan B. So hard to get comfortable especially if you have a family and pets.

    They're trying to do it everywhere. They will take ur rent and tell u ur lease will come in a email for months. But u can't evict a disabled vet unless they don't pay. I pay early on em and keep the receipts. For sure.

    landlord is going to lose the case. the landlord is going for non-rent payment. the fact that the tenants have proof of rent payment and not owing any money is going to and should be more than enough for the eviction case to be dismissed. but if where these people live doesn't have rent control laws on the books. than there is still a good chance that at the end of their lease they would still have to move. for non lease renewal.

    Complex was probably sold recently at sky high prices for cash to a bigger corporate overlord. Rent prices are going up as small fish are cashing out afraid of future moratoriums.

    Happening here all over upstate N.Y. landlords getting earp payments and still evicting with no problem, 650, one bedroom are now 875 to 900, something has to give

    Any way property managers can buy or sell the NOTES of the property debt without selling off the physical property, itself?
    Then renegotiate terms w tenants. Ultimately it KEEPS tenants, in their homes! Everyone wins

    I was awarded rent by Texas Rent Relief and my landlord received the money but kept me going to court until I received a default judgment .
    I appealed and won but eviction is still on my record.

    They must not be from Texas you can always tell when people move here from another state or another country both the owner and people that are renting. There's water laws in Texas he cannot evict them in the state of Texas while they pay their rent and eviction notices last 45 days in the state of Texas. Y'all should counter sue him for not knowing the law and illegally evicting people.

      Texas is a quick eviction state. The evictions are rushed. In just a few days the courts have made it where the landlord can file the eviction and have the furniture out on the street. Landlords don't have to pay anything to file evictions either. so they routinely do it and then pull them out of court. the Apartment association in Texas has a lot of power. It's written the rules of the road. Read the dallas observer piece called 'Litigious Apartments Freeze the Bank Account of Grandmother Who Never Lived There'. Its an eye opener.

    I don't understand how they can evict them so fast with no court order? There are people who don't pay for months and don't get kicked out until they have their day in court. How is this happening?

      In my area, you can't evict if the tenant has a pending application for rent relief. Those who did not care to apply for rent relief could be evicted as soon as the eviction moratorium was up.

    One can be asked to move even for paying their rent. They may need to move before a certain time due to things such as owner wants to update property or sell property. How much time did they get to find a new apartment and waited to the last minute and want the owner to give additional time???? Questions that need too be asked and are not.
