  • The plaintiff says she bought a puppy from the defendant, but the dog was so sick it had to be euthanized six days later. She’s suing for vet bills and pain and suffering. The defendant claims the vet says the puppy was fine for days until the plaintiffs gave the dog a bath. He claims the puppy maybe inhaled something in the bath and got sick.

    I rescued my dog from a shelter. Within 2 days he was on deaths door. The vet said if I hadn’t brought him in that day he would have died. He’s 12 now and he has been the light of our lives. So, it’s not just pet stores that can have sick animals.

    I just lost my cat sadly literally overnight was sick and apperently coulda been sick without showing symptoms. Very devastating.

      They do mask their illness. Dogs are more likely to trust you enough to let you know something is wrong. With our cats, there was usually a behavior clue like not using the litter box. It was never direct and usually hindsight was the only way to know.

      Just had to put down my cat 3 days ago. 19yr old big, fluffy blonde boy, Mango.
      He was fine, then he WASN'T. Only took 3 days, he couldn't eat, drink, groom. We thought he might rally, but then he didn't know us anymore, and became frightened. THAT'S when I made the call.
      Glad he's free and not in pain, but I am gutted.

    I had miniature schnauzers the whole time I was growing up. my wife's family raised schnauzers. they are not a sickly breed. even the miniature schnauzers. they're nice healthy strong dogs

      Within our immediate family, we have had 4 miniature schnauzer and they have all been healthy dogs. It is a fantastic breed with high intelligence and great personality.

    It's so sad that people pay ridiculous prices for puppies from these people that are just trying to make money, probably from a puppy mill. Go to a rescue where the dogs are better cared for and are seen by a vet.

      Some people want a puppy to grow up with their kids, (I'm speaking in general, not pertaining to this case.) Not all rescues and shelters have puppies, definitely not in my area. You just have to find the right breeders.

      Problem is they got it from a pet store...pet stores get puppies from puppy mills...there is a HUGE difference between going that route or a backyard breeder who breeds for financial gain vs a reputable ethical breeder...research is key...DO YOUR RESEARCH

    I want to tell everyone these two things. First, you do not realize that your shoes have the chance of carrying deadly viruses/bacteria on them. A puppy, even if vaccinated is not fully vaccinated until age 12 months. You can track parvo or distemper into your house on the bottom of your shoes. The last thing, yes a bath to a puppy can indeed cause a certain kind of pneumonia and kill them. Its a real thing that happens to dogs and especially cats due to medicine administrated incorrectly. Word of advice if you have to give your cat (or dog) liquid medicine, go to the side of their mouth and do it slowly. Do not squeeze the whole amount into their mouth from the front. - Just a little advice for pet owners out there.

    We purchased a cockalier puppy at a store 14 years ago and there was a warranty clause that if the puppy had a vet check within 48 hours there would be a warranty. Thankfully we went to our vet and found she had severe kennel cough that was severe enough our vet fought the store for us and 2 weeks later they were closed. Our puppy thankfully survived after numerous treatments and was left with permanant damage. Always make sure when buying an animal to get a vet check to verify their health at time of purchase.

      Purchasing a dog or cat from a store is almost always a bad idea. Best to go directly to a reputable breeder if you want a specific breed or a reputable rescue.

      That was a puppy mill puppy you got. Sad that she was so sick, That is why I go to a no kill shelter and the one I use has vets on staff that check all dogs and pups, and cat and kitten and all small animals they have.

      @@trekgirl65 yes we realized that after we bought her. We didn't want to return her knowing what would happen to her. Come to find out the entire store was infected and I can only imagine what happened to all those animals in there. We were young and naive and learned a lesson thru all of that.

    Dog groomer here! Dry Water Drowning is a thing. Basically while washing the dog’s face/ head, water gets in the dogs lungs and they drown throughout the next 24-48 hours. Something we are conscious of in the grooming world to be careful especially with water around noses!

      The defendant is not a breeder or I would agree with you as most breeders have a spare puppy. This judge has a good understanding of the possible complicaions that occur w living animals. Some laws act as though they are equivalent to a pair of shoes. Genetics is not always predictable.

    As a loving mother of a 4yr old tea-cup Yorkie, In the words of “JOE GATTO”.-Adopt don’t Shop..You must do your research when it involves bringing a pet/new family member into your home. First, if they’re newborn..they need to be acclimated to a new environment meaning “the purchaser”..they’re like “babies”..never immersed them in a tub of water..My groomer taught me to use cotton balls in her ears during bath time to prevent ear infections.,you risk the chances of them getting “flu/inflammation..give them a cleansing with baby wipes. Allow them to become accustomed to their new atmosphere.If someone took you out of your “comfort zone”..threw water on you..it would without a doubt cause you trauma. If you don’t do your homework, please leave those helpless, possibly ILL puppies where they belong.

      This lady bathed his rear end only. Doesn't sound like he aspirated water. Pretty obvious when they do, as they cough and gurgle when it happens. No idea what took this puppy out... sad case :(

      Only purebreds are expensive. And purebred dogs are rarely healthy.

    Sounds like puppy developed aspiration pneumonia, it happens. It isn't anyone's fault. It is just a horrible, sad occurrence and I feel for the family. It wouldn't have mattered if this puppy came from a rescue, a pet store or a breeder, it can happen to any puppy. I still would never buy a puppy from a pet store, find a reputable breeder or adopt from a shelter.

      It does sound like it may have happened, although usually you can hear when they aspirate water. All animals gurgle, choke or cough when it happens.

    She means /dis-fā-shu/.
    Dysphagia: difficulty swallowing foods or liquids, arising from the throat or esophagus, ranging from mild difficulty to complete and painful blockage.
    A dog can aspirate during a bath. It really can if it has dysphagia.

    If they were locate I'd give them one of my beautiful pups for free. I feel so bad for this family. And unfortunately most pups from pet shops are from crappy puppy mills, where the parents to the pups are abused live in nasty conditions and then as a result people pay an insane amount of money for the "cute puppy in the window" only for it to get sick and die. It happens so much more often than people think.

    Sadly our furbabies can get sick with all sorts of things. 6 years ago I adopted a cat from the local SPCA. Within a month he ended up with urinary crystals. Took care of it. A month later he got blocked up again and ended up having a PU surgery (this removes a male cats penis and gives them a hole like a vagina). Cost me over 5000 within the three months we had him. Best 5000 I ever spent though. Sadly, the damage he went through, took his life 2 and a half years later of kidney failure. It was so worth it all though. Miss that boy.

      @@alyssahamlett I am sorry for your loss. I've had 6 cats go through it, 3 got the surgery. One lived to be 19 days short of his 19th birthday. It's said to only be about 1% of male cats that get this. However all mine had siamese in them. They say it's not breed specific but that makes me wonder.

    I foster Senior dogs with medical issues and can tell you that these dogs are the most loving and loyal fur babies. Most are ignored at the shelter and would be euthanized if it wasn’t for us fosters. I foster failed on my 12th dog foster and now he lives a very spoiled life. Adopted him at 12 yes and now he’s 14. Best decision ever!!

    Interestingly, if you look at definitions of mini and toy breeds, they are not recommended for young children. They are too easily hurt.

    That poor family! The pup they bought to help them through grief over the loss of two close family members just drops dead! It's awful. I get why she's pissed. They'll do better with a pound puppy. Mutts usually have heartier constitutions.

      My dog came from the shelter. Canine influenza and kennel cough. Nearly died. Cost around a thousand dollars in vet bills and lost wages because one of us had to be with him constantly. Shelter pets also can have behavior issues. Mine is afraid of the world. Getting him out for a pee can be a nightmare. He barks at everything that moves, he hears, or smells. When he’s with our other dog and that dog barks, he becomes incredibly aggressive and has attacked his brother more than once. Twice he’s bitten me when this happens. Mutts being a better, healthier dog is a myth if the dog isn’t overbred. My little dog is a mix of multiple breeds. He has severe allergies to everything. He’s on expensive allergy meds he will have to be on for life.

    Never ever ever ever sipport the people who sell puppies in a damn store. They
    are supplied by puppy mills. Goto a an anima rescue or breeder who actually cares about dogs.

    When you really want to know then you should get an autopsy. It's worth the money especially in a case like this where so much money was just spent. Must have been devastating for them to lose a tiny puppy like that. I'd want to know if the puppy had been free. I'd want to know what happened.

    Same thing happen to me, my cousin bought me a miniature schnauzer as a present and he ended up dying less than a month later to health issue. The vet thought it was parvo but wasn’t.

      Why not get a mutt? They're just as cute, healthier as they have more genetic variance, will love you just as much, and also super cheap/free.

      I had snauzers. My girl had 2 litters and it was awful hard to give up those babies. We never had any unusual health problems but I would never have their ears done again. They suffered for that. Second litter kept their ears like God gave them.

    You can adopt a shelter pet, that doesn’t guarantee they’re healthy. I got one of my dogs from the shelter. Their vet said he was in good health. He wasn’t. He had kennel cough but worse, canine influenza. Weeks of treatment, so sick we had to have a vet come to the house. He had to be spoon fed liquids. It cost around $1500. He’s well now and we’ve had him 5 years but wow. We love him but he has behavior issues. My other dog came from a neglect situation when he was a puppy. He has severe allergies and is on expensive meds. It took almost a year of going back to the vet before they figured out why I couldn’t keep weight on and his hair was falling out. Probably $600 for visits and tests and $900/year in allergy meds. Both of them around $400/year for heartworm, flea and tick meds. Plus regular vet visits.
    Any dog is going to be expensive. But that puppy should have survived 6 damned days. It’s sucks the vet wouldn’t be honest. That happens all too often.

      It's not that it's guaranteed to be healthy it's just that if something like this happens your losing about 100 for the purchase of a dog rather than 5 grand on top of vet bills. To pay 5 grand only to have the puppy die within a couple days is just a waste of money. That's a down payment on a cat for sake.

    What a lie! I had four miniature Schnauzers and we also bred them and they were not prone to illness. I’m happy to say that all of them lived long lives.

    4 or 5k A DAY for hospitalisation? Omg. Here in Australia, ICU for a dog overnight is 4-500. Wow. Massive rip off caused the dog to lose its life before they even knew if it could be saved :(

      It's very easy for a bath to kill a puppy. Its a kind of pneumonia they get from water/liquid going into the lungs. As a matter of fact, a lot of pets get it, especially cats, due to medication being administrated wrong. I know this cause as a paranoid furbaby mother, I have researched it and spoke to my vets about it.

    Why oh why do we have this obsession with breeding new breeds of dogs and cats? I can understand in the past when they were bred to do a certain job, but why breed just for the cute factor. In some ways it is bordering on cruelty because they are developing medical defects which they can pass on to future generations.

      @Marilyn Willett Personally I have no problem with people owning a pure established breed so long as they come from reputable breeders and have done their research on potential pets. German Shepherds are beautiful loyal dogs, really only a viscous dog in the wrong hands.

    Sounds like that puppy died from parvo. My puppy died from that when I was in High School. She bought it sick. So sad. 😣

      If it was parvo the vet would have easily diagnosed that. When puppies get sick that is one of the first things tested for. Also the symptoms this puppy had don't at all sound like parvo.

    The shelter where i am from wont let you adopt a small dog without $950 and thats paid for before you even see the dog. So not all shelters are great either. Just spay and neuter your pets.

    This is why you buy puppies from a reputable breeder. Not from a store. Pet store dogs usually come from puppy mills. Can do searches online to find a reputable breeder. I've had schnauzers none of myself schnauzers were sickly.

    They should have asked if other puppies sold from the same litter came down with the same illness. However, it doesn't appear to be the case because the pet store employee seemed to be as much in the dark as anyone else. Puppies are susceptible to many illnesses prior to being vaccinated at certain stages (6-8 weeks: vaccines for distemper and parvovirus; 10-12 weeks: DHPP - vaccines for distemper, adenovirus [hepatitis], parainfluenza, and parvovirus). Just by putting an unvaccinated puppy on the ground outside can expose them to canine viruses that can kill them.
    I agree that the pet store should not be held liable for the puppy's unfortunate death unless there was solid proof that the puppy was already sick or had a genetic disorder that caused its death prior to the purchase.

    You shouldn't give puppies very many submersive baths anyway. Not only can this situation happen but they also don't have as much natural protective oil on their coat which can lead to skin/coat issues. You should use washclothes if you need to give small puppies baths.

    And this is why you really shouldn’t purchase a puppy from anywhere other than a reputable breeder or adopt from a shelter. Lots of stores that sell puppies get them from backyard breeders or puppy mills and come in very poor health. Horrible situation for this family and especially for their son to go through all that.

      My dog from the shelter cost over a grand because he was so sick. Luckily we managed to pay for it and didn’t have to put him down. The vet didn’t think he would survive. He wouldn’t have if I hadn’t kept him right next to me 24/7 until he was well enough to be on his own for a little while. He’s 6 now.

    Our mini schnauzer didn't bark either . What does that have to do with it. If it was the sixth day could have gotten into something. They are not sickly dogs . If you took the puppy for an wellness check the vet should have pick up on the throat thing. An injury to the throat could have been from not using a a harness and wearing a collar and pulling or yanking on the lead. Puppies need to watched they get into everything.plants etc

    I don't know WHY people don't want dogs from shelters and spend thousands of dollars on a purebred when a mutt is just as loveable, enjoyable as any as good. Save your money and save a life get your animals at a shelter. 1,000's of puppies waiting for a home. Please ADOBT don't buy. Oh, and if you absolutely have to have a purebred they have them too!

      Took it to a hospital. Dogs can have congenital issues that don't show up initially, and they had a 14day health guarantee.
