Rav Elyashiv To Shimon Peres: Its Forbidden To Ascend Har Habayis

  • Rav Yosef Shalom Elyashiv reiterated his previously expressed p’sak - shared by all gedolei haposkim of this and previous generations - that it is halachically forbidden for Yidden to ascend to the Har Habayis. Rav Elyashiv told this to Israeli President Shimon Peres when the latter visited him in 2009 on sukkos in his sukkah in Meah She’arim.
    Peres, who made it a practice to pay visits on Sukkos to the Chief Rabbis of Israel as well as to Chacham Ovadia Yosef, had not previously visited Rav Elyashiv.
    Peres raised the Temple Mount issue in light of renewed hostilities between Muslim religious authorities and small groups of Jews who choose to ignore the halachic prohibitions, thereby provoking Muslim antagonism, such as the call by Muslim leaders to safeguard the Har Habayis area.
    Aside from halachic prohibitions, said Rav Elyashiv, it was important to consider that any provocations on the part of Jews who are determined to reach the Har Habayis could lead to needless bloodshed and further condemnation of Israel by the nations of the world.
    At the conclusion of the meeting, Rav Elyashiv gave Peres a special bracha, saying to him: “As President you need a special blessing to steer the nation on the right course in these difficult times.”

    The odd thing is that if you actually study the sugya (Topic), the issue is really much more of a hashkafic one than a halachik one. How and where you can go are really the Halachik issues. By not going, or giving the area to the Arabs as some would have us do, we actually endanger Jewish lives and empower those who would again try to wipe us out.

    דמגוגיה זולה. הרב אלישיב דיבר רק על הפן ההלכתי. אין שום קשר בין האיסור הזה לבין המצב הבטחוני. אכן מבחינת הלכתית אסור לעלות להר הבית אבל מבחינה בטחונית כוחות הביטחון חייבים להראות נוכחות ולשלוט בהר. הר הבית הוא רק שלנו של היהודים גם אם אסור לעלות לשם. בוודאי שעליית היהודים להר אין בה שום 'הסתה והבערת השטח' כי הערבים אינם צריכים סיבות כדי לפגוע ביהודים. הבעיה היחידה היא האיסור ההלכתי

    Cheap demagoguery. Rabbi Eliashiv spoke only about the halachic aspect. There is no connection between this ban and the security situation. Indeed, from a halachic point of view, it is forbidden to go up to the Temple Mount, but from a security point of view, the security forces must show presence and control the mount. The Temple Mount belongs only to the Jews even if it is forbidden to go up there. Certainly, the Jews' ascension to the mountain has no 'incitement and burning of the area' because the Arabs do not need reasons to harm the Jews. The only problem is the halachic prohibition
