This is not true. The courts are there to apply the law to the everyday life of people. And the law is too harsh and unreasonable sometimes. So if courts execute the law as it is, a lot of people will face unfair punishment. This is why a pardon is important. It serves the people who broke the written law, but do not deserve punishment.

If it makes sense to pardon convictions which have yet to be adjudicated, it must also make sense to prosecute crimes which have yet to be committed, and enact laws which have yet to be written.
If the pardon is to pardon for crimes done or potential convictions of issues under investigation how can one be pardoned where neither exist? This is the most dangerous precedent ever enacted. It allows an incoming president to preemptively pardon every department under his administration and everyone in those departments, on day one. He/She could then commit tyrannical and dictatorial actions and crimes with total impunity. Preemptive pardons must be ruled UNCONSTITUTIONAL NOW.
It should only apply to cases in progress and act as an automatic appeal to the highest federal/state courts, the justices will still take bribes but at least the ruling will be a precedent for all people.
@@JudeLind A Presidential Pardon can only be granted for federal convictions. Therefore there is no option for parole or early release. Only probation after the sentence is served 100% of the duration that was given by the judge. So if someone was charged with a non violent conviction with no prior or further crimanal history before or after serving a prison sentence and is a law abiding citizen other than a one time conviction of the wrong place wrong time kind of thing. Shouldn't that person be considered worthy of a presidential pardon at that point?
@@JudeLind People that commit federal crimes ARE punished. They serve a prison sentence, probation , community service, pay restitution and court fees. But being punished for life or years AFTER they have successfully fulfilled ALL obligated parts of punishments. It does not seem right to NOT let a person that has made amends and corrected their mistake to move on from their one time mistake and return to become a worthy citizen in society again. How would that be right? To have someone pay their dues and then hang it over their head for life after they corrected it and proved they are worthy of moving on from it? How is that morally right?

I do agree that it should not be the choice of just ONE person e.g. presidents etc. to pardon a federal felon. But you said no one should be able to grant pardons. Seriously? The president basically has the power to pardon because it was part of previous corrupt systems as a way for the well connected to be protected from the law. And all these examples given was again just the well connected being protected from the law. That’s the purpose for the pardon. Hamiltons argument of ”public welfare” is basically an admition of this, what else is he reffering to other than a powerful and well connected person being thrown in jail putting the community he is into chaos?
