  • Tom Devine discusses the critical importance of the first amendment for and solidarity with whistle blowers, whose actions change the course of history. He gives stunning examples of the work they have done, and the growing solidarity for their courage in the last 40 years.
    Tom Devine is co-founder and legal director of the Government Accountability Project. Since 1979, Tom has assisted over 7,000 whistleblowers in defending themselves against retaliation and in making real differences on behalf of the public. In 2015 he won the first U.S. Supreme Court test of the Whistleblower Protection Act. Tom has been a leader in the campaigns to pass or defend 33 major national or international whistleblower laws. Tom has authored numerous books, including The Corporate Whistleblower’s Survival Guide: A Handbook for Committing the Truth, which won the 2011 Frankfurt Book Fair “International Business Book of the Year” award. Tom has been selected as one of Washington DC’s top employment lawyers for the last seven years by Washingtonian magazine.

      @john hinsdale Because it takes away everything you valued to be true. The retaliation, gaslighting, the work-place psychological bullying is so severe that you can lose your basic instinct to stay alive.

      Im scared to ask this question but ill chance it becuse im screwed anyways but my question is if these type thigs are hapoening to person and thier standing alone aginst whole county n possibly more where and who can you comtact for help to get yr voice herd before they single person out ??

      "The retaliation, gaslighting, the work-place psychological bullying" AND the verbal abuse, defamation of character and not keeping/constant documentation of the the abuse, micro aggressions and shenanigans is utterly exhausting. Instead of having off days to do errands and chores, one has to try to get a bit of mental space to compose letters, report the assholes to officials, etc.
      It's a damned shame that we have so many corrupt, psychopathic people in the world.

    Whistle blowing was professional suicide for me 15 years ago and I’m still trying to get over it.

    If it does not directly effect you, it is best to keep your mouth shut. Support always goes to the highest bidder and to keep a job or the next promotion will outbid the truth. I had worked at a school run by Sisters of Mercy nuns. In an attic type room was equipment etc that always had to be worked on by tradesmen. In the past holes had been smashed through the walls to gain access and the asbestos debris lay where it fell. Some tradesmen refused to work there because of the asbestos. My supervisor told them it had been tested and was not asbestos so they went back to work. I said I thought it was asbestos and the issue should be looked at. My repeated requests for it to be looked at was ignored and tradesmen kept being sent there to work. I sent a sample away to be tested and it came back positive to asbestos. I then politely showed the result to the higher boss. The fact that I had taken it upon myself to get it tested was listed as one of the reasons for my sacking as they said I had undermined my supervisor. And the other reasons listed for my sacking were equally as unjust. If people wished to read my 100% true story google warning to employees test blog and google white lies test blog and also innuendo test blog.

      Wow that was so brave of you!! Don't regret such noble deed!! It's unfortunate you loss your job yet you gained dignity & grace! Peace of mind that YOU did do the right thing hopefully a million more people can do the same including myself!! You may know or feel the impact but it is definitely there😍😍😍💖💖😏

      David#323 Surely you could take your case to an employment tribunal, or campaign to have your case taken on by a lawyer pro bono?
      I refuse to accept that what you did was anything but, what needed to be done.
      The more we do accept such things, the more normalized they become.

      @@comanchio1976 I did take my sacking to the Fair work employment tribunal. The judge said to me that he was going to find against me and he said he would give me a chance to withdraw my case so he would not find against me. I was told (falsely) that if I lost the case I would have to pay for my employers lawyers. I withdrew my case after getting it rammed down my throat that it was best for me. After thought, it seems the judge did not wish to put it in writing that he had found against me regards the issues. (The asbestos was just one issue and I feel the other issues were even more unfair) And in regards to me getting a lawyer. I trust them very little.

    Italy has a strongest and more affordable solution. Since the 1980s the Italian civil code of law contemplates the institution of a "collegio dei sindaci" which is mandatory for each capital society quoted in a stock market exchenge. Is is formed by therre to five adiministrators whose mandate has a maximum duration for three years. The must take a meeting at least every three months whose results are writtenly reported in a public official relation.
    They must be present to any meeting of the Borad of Advisors and have alsoaccess to any legal, techinical or accounting produced by the society, even if for mere internal and unofficial purposes. They are elected by and reported uniqeuly to the stockholder's assembly.
    Is this more reliable and law-enforced than a first level manager which is waged by adn depends on the Chief Executive Offices. Is he a real warranty for the customer social responsability and third parties rights in respect of a public or private company?
    I think U.S. shall consider to introduce a similar law-enforced institution in theri own legal system intead of promoting a voluntary policy thant any songle company mayadoprt or refuse without any kind of consequence in their businesses.

    Question. What are the limits of the laws that protect a whistleblower? If there is a reason, why are whistleblowers bad?

      Hi Elisa! I’m in Professor Devine’s clinic now and I can tell you now that the laws are extensive, beyond what I could write on this post. If you are still interested, I can email you some laws that apply. He spoke last week for three hours on only two laws. It’s not a one size fits all type area of law but if you are down for the research I definitely can send it to you!

    the biggest problem whistleblower stil have a lot to go..because even though whistleblower act or laws are created many judges dont know about the laws or they dont apply worldwide

    It seems so wildly impossible to imagine that the people still willfully in a comatose state after a year of this insanity... will ever wake up.
    I don't know what to think any more...
    Sometimes I'm certain it's all a mass awakening happening at turtle-speed, and all is perfect; divine timing.
    Other times... watching zombies in masks, salivating with excitement over the mark of the beast... that's when I lose my ability to hold on to hope...
    (I also heard David icke speak in an interview about the coming of 6g and 7g! How will humanity survive that?)
