Reason: Based on the trust that the tenant will be paying the rent , land lord hands over his high value immovable property to the tenant for rent which is only a very small fraction of the property value . If the tenant does not pay the rent then it's clear breach of trust .

Don't know why the court is so lenient towards tenant .They will not pay rent for months,they will not vacate when asked to ,even refuse to renew agreement but still court will not take any action.

All court cases should be disolved within one years, this rule help from anxiety haresment, money, why cases took so much time to dissolved? This is inhumam? Some sort of injustice? Way back in 1986 section 441 IPC was amended in Odisha and the tenant can be treated as a house trespasser if he does not vacate the house after one month of receiving the notice from the land lord. Section 448 IPC is a cognizable offence and FIR can be registered. 🙏

The boys asked police official they can give hand written application. Police official replied you can get it from the typists and typist know what he has to write. Without rent or the possession of the property, I can’t even repay my loan taken to do the ornamental works for the tenant. My dear gentlemen, It's common knowledge that in jurisprudence, there is no system of universal mutatis mutandis or automatic application of a court order or a judgement in another or even in a similar type of case. This order of Apex court cannot be construed to have foreclosed a landlords complaint whether through process of IPC sections or in terms of Rent control provisions. If that be the case all lakhs of existing cases will meet a sudden death in the courts and get devolved on Tribunals and consumer commissions. Let no one try to interpret a court judgement as to have attained finality forever, in a manner according to one's own understanding. Let's understand that each and every case is separate and carries it's trappings & uniqueness. One judgement in a case cannot become replicating feature in every case, nor it can stop a reasoned order of any other hon'ble court in variance to the quoted judgement.

Time to change the present system of laws and courts taking years to make decisions. All such cases should be solved by arbitration with zero fees.
It is very difficult situation for owners, if tenants will not give rent, then how come owner will adjust every month. There should be some provision else people will take advantages for this kind of situations. I feel older laws need to change as per current time. Don't know why the court is so lenient towards tenant .They will not pay rent for months,they will not vacate when asked to ,even refuse to renew agreement but still court will not take any action.
All provisions of law are against landlords. The property owner must have a 'right to vacate' with a notice period of one year.

our judicial system is a waste of time. It basically protects defaulter. The judges' never look at the practicality. Specially the supreme court judges. They are all lakir ka fakir
All court cases should be disolved within one years, this rule help from anxiety haresment, money, why cases took so much time to dissolved? This is inhumam? Some sort of injustice? And many more, victim understand this. So law maker body should think of this. Advocate fees also need to be fixed. Advocate charges so much, it's great problem also.
Not satisfactory judgement. It will be harassment for landlords as state rarely gives any relief to landlords even after long pending cases.

Way back in 1986 section 441 IPC was amended in Odisha and the tenant can be treated as a house trespasser if he does not vacate the house after one month of receiving the notice from the land lord. Section 448 IPC is a cognizable offence and FIR can be registered. 🙏

The boys asked police official they can give hand written application. Police official replied you can get it from the typists and typist know what he has to write.

It's common knowledge that in jurisprudence, there is no system of universal mutatis mutandis or automatic application of a court order or a judgement in another or even in a similar type of case.
This order of Apex court cannot be construed to have foreclosed a landlords complaint whether through process of IPC sections or in terms of Rent control provisions. If that be the case all lakhs of existing cases will meet a sudden death in the courts and get devolved on Tribunals and consumer commissions.
Let no one try to interpret a court judgement as to have attained finality forever, in a manner according to one's own understanding. Let's understand that each and every case is separate and carries it's trappings & uniqueness.
One judgement in a case cannot become replicating feature in every case, nor it can stop a reasoned order of any other hon'ble court in variance to the quoted judgement.

Advocate was fooled by the section of laws, if judgement is correct. In such cases, courts should directly help solve cases of parties like in the panchayat system in short time . Time to change the present system of laws and courts taking years to make decisions. All such cases should be solved by arbitration with zero fees.
It is very difficult situation for owners, if tenants will not give rent, then how come owner will adjust every month. There should be some provision else people will take advantages for this kind of situations. I feel older laws need to change as per current time. I can understand few laws will remains as it is but other can be modified.

Jai Hind Jai Bharat. I am a tenant and being staying for last 7 years and my land owner asked me to vacate. I have searched for a new house, but i will only get possession after 2months. There is a lot pressure from the house owner and fear of him taking legal action against me. Please advise, what I can do, as I have no negative intention of taking over his property. I just need time of two months to vacate and the live license agreement is over on Nov 2022

Sir tell me one thing that few years ago Honorable Supreme Court of India had a judgement that residential property rent increased every 3 year not every 11 months
If a tenant complete its 11 months in a home then the owner told him that increase the flat rent by 10% it's absolutely wrong now because the supreme court header decision that if a tenant is take a flat on rent then after 3 years the rent agreement increase to 10% please tell me it is right or wrong
Second decision by Honorable Supreme Court of India that now 6 month Notice from owner to tenant for vacant of flat before this decision there is one month Notice from owner to tenant
