A version of this literally happened to the legal counsel of one of my previous employers in her time as a trial attorney. They were on public transit an the person sitting next to them was a opposing lawyer on a case they were on. He was reading their (presumably confidential) notes about the case. My friend moved away to avoid any perception that they were reading the notes, but if you're doing it in a public place, it's at best hard to defend someone happening to notice. (At worst, how would you know that they guessed your strategy this way?) If you've got something even possibly private to read/watch/discuss/etc, don't do it in public places. Movies and TV have lied to you, that's a bad idea.
She would never do anything to prevent these, erm, suits, from impeaching themselves. Lawyers but moreso judges and magistrates, love it when that happens. The judiciary has short shrift for that sort of behavior, principally because they give a flexibility to both sides.
In Florida is generally required parties consent. You may or may not be able to record what someone says in public. It depends on whether or not there would be an expectation of privacy. Good lord. This show takes place in NYC. Under NY law it is a crime to threaten criminal prosecution - perjury - in order to gain a civil advantage. Also, in NY it is a crime to record a conversation unless you have the permission of at least one of the participants, which the young lady obviously did not have. I'd bet the "lawyer" didn't inform her witness of this teeny tiny legal fact, either. What a bonanza of ethical and Bar Rule violations, criminal conduct, and exploitation of a witness!! This kind of stuff is why, as a lawyer, I can't stand most "legal" shows or movies. They are so cracked off-base they make my teeth itch. PS: The one deposition question asked by the lawyer was objectionable because it was vague and argumentative ("ripped off"? Really?) Teeth itching again.

Public Coffee Shop 2. Recording the Public Coffee Shop where 2 individuals happen to be having a conversation in 3. Under Oath, an attorney and their clients in a civil case ought to tell the truth and nothing but the truth. Katherine Heigl's character is not "threatening" for a legal advantage, she is purely informing of what could occur if the defendant and his attorney continue in their lies that they know there is no evidence for the plaintiff to prove except for the plaintiff own self-incriminating words recorded in a *public* place In fact, there might indeed be no recording at all. But does this lying lawyer and his lying client know this for sure? In Texas, I go up against lying attorneys and partial judges [who are attorneys] as a pro se litigant and have filed against the partial judges to the Texas Judiciary Committee with my court transcripts [on 1 of 2 judges filed against] and pointed out the areas of the Texas Judiciary Constitution that the judge should be disqualified under... and it is quite a laugh that this committee could not even be bothered to name the judge name they state is not disqualified. The Bar Association, regardless of whichever state, is just one of the many repositories of the modern scribes and Pharisees who set out to oppress humanity as spoken of in Matthew 23. Some lawyers are more honorable than most and actually set out to help their clients. From my experience over a 2 years window with 5 different civil judges, only 2 of 5 were competent and impartial. The two practing bar attorneys (one with 2 years and one with 25 years experience) were both unprofessional and outright lied as well. I have all of these evidence in my official court transcripts and the different statutes and case precedent they lied about because they know that they fellow bar member (judge) will side with them any day of the week over a non-bar member (pro se litigant). So, enjoy your perception of truth and justice little lawyer [scribe and Pharisee], because it is only for a moment. Eventually, all that is hidden in the dark will come forth into the light.
Think about it, in our day and age, everyone has a recording device, audio, video, photographic... we assumed the surveillance society would be constructed by the state. But we've done it to ourselves, and that's what really hurts.
Is this show still on? What happened to the original guy? He was at least somewhat charismatic (if not particularly well-written). Think i tapped out at season 2 or 3 as, like you implied, every episode seemed like more of the same. To be fair to them, I do compare every TV show to The Wire which was so well-written that it's definitely the peak of TV, but even then the last season of that wasn't very good.

A version of this literally happened to the legal counsel of one of my previous employers in her time as a trial attorney. They were on public transit an the person sitting next to them was a opposing lawyer on a case they were on. He was reading their (presumably confidential) notes about the case.
My friend moved away to avoid any perception that they were reading the notes, but if you're doing it in a public place, it's at best hard to defend someone happening to notice. (At worst, how would you know that they guessed your strategy this way?)
If you've got something even possibly private to read/watch/discuss/etc, don't do it in public places. Movies and TV have lied to you, that's a bad idea.
She would never do anything to prevent these, erm, suits, from impeaching themselves. Lawyers but moreso judges and magistrates, love it when that happens. The judiciary has short shrift for that sort of behavior, principally because they give a flexibility to both sides.

In Florida is generally required parties consent. You may or may not be able to record what someone says in public. It depends on whether or not there would be an expectation of privacy. For example, if someone the street preacher screaming about the end is near, and that person obviously has no expectation privacy because you’re trying to get attention.people in a coffee shop… Either way

The girl was working as an agent for her attorney mother to violate attorney- client communications between defense counsel and his client. Not only inadmissible but would result in disbarment of mommy.
Not in a public place where there is no expectation of privacy and recording is legal. Might be a bit of a dick move, but that's it.

Good lord. This show takes place in NYC. Under NY law it is a crime to threaten criminal prosecution - perjury - in order to gain a civil advantage. Also, in NY it is a crime to record a conversation unless you have the permission of at least one of the participants, which the young lady obviously did not have. I'd bet the "lawyer" didn't inform her witness of this teeny tiny legal fact, either. What a bonanza of ethical and Bar Rule violations, criminal conduct, and exploitation of a witness!! This kind of stuff is why, as a lawyer, I can't stand most "legal" shows or movies. They are so cracked off-base they make my teeth itch. PS: The one deposition question asked by the lawyer was objectionable because it was vague and argumentative ("ripped off"? Really?) Teeth itching again.
The one party consent law applies where there is a reasonable expectation of privacy. They were in a publicly accessible coffee shop.

2. Recording the Public Coffee Shop where 2 individuals happen to be having a conversation in
3. Under Oath, an attorney and their clients in a civil case ought to tell the truth and nothing but the truth. Katherine Heigl's character is not "threatening" for a legal advantage, she is purely informing of what could occur if the defendant and his attorney continue in their lies that they know there is no evidence for the plaintiff to prove except for the plaintiff own self-incriminating words recorded in a *public* place
In fact, there might indeed be no recording at all. But does this lying lawyer and his lying client know this for sure?
In Texas, I go up against lying attorneys and partial judges [who are attorneys] as a pro se litigant and have filed against the partial judges to the Texas Judiciary Committee with my court transcripts [on 1 of 2 judges filed against] and pointed out the areas of the Texas Judiciary Constitution that the judge should be disqualified under... and it is quite a laugh that this committee could not even be bothered to name the judge name they state is not disqualified.
The Bar Association, regardless of whichever state, is just one of the many repositories of the modern scribes and Pharisees who set out to oppress humanity as spoken of in Matthew 23. Some lawyers are more honorable than most and actually set out to help their clients. From my experience over a 2 years window with 5 different civil judges, only 2 of 5 were competent and impartial. The two practing bar attorneys (one with 2 years and one with 25 years experience) were both unprofessional and outright lied as well. I have all of these evidence in my official court transcripts and the different statutes and case precedent they lied about because they know that they fellow bar member (judge) will side with them any day of the week over a non-bar member (pro se litigant).
So, enjoy your perception of truth and justice little lawyer [scribe and Pharisee], because it is only for a moment. Eventually, all that is hidden in the dark will come forth into the light.
Think about it, in our day and age, everyone has a recording device, audio, video, photographic... we assumed the surveillance society would be constructed by the state. But we've done it to ourselves, and that's what really hurts.
Every sentence in thos show has the exact same cadence and delivery.

Is this show still on? What happened to the original guy? He was at least somewhat charismatic (if not particularly well-written). Think i tapped out at season 2 or 3 as, like you implied, every episode seemed like more of the same. To be fair to them, I do compare every TV show to The Wire which was so well-written that it's definitely the peak of TV, but even then the last season of that wasn't very good.
