  • The plaintiff says she and the defendant were best friends until the plaintiff moved away. After the plaintiff moved back and reconnected with her friend, the defendant admitted that she was homeless and prostituting. The plaintiff is suing her former friend for a bounced check and overdraft fees. The defendant insists the plaintiff is lying because she never confessed anything about being a prostitute, and she has a home.

    Plaintiff’s first question should have been: *”Why don’t you have a bank account”?* followed by: *”Sorry, I can’t help you”.* When grown people don’t have bank accounts, there’s usually a negative reason for it.

That is why, in the closing statements, the defendant rebutted with: it is the plaintiff's own fault for being stupid enough to help a friend. Ridiculous!     This is the exact reason why I don't deposit other people's checks into my account. Furthermore, the plaintiff is mistaken when she said the check had cleared. No, what they did was give you credit for the check in advance. Once they submitted that check to that other person's account, that's when they discovered funds were not available so the initial credit was reversed. As a rule of thumb, it's usually five business days for a check to clear an account.

      Exactly, which is why I do not even use checks. I would much rather money orders simply because I am very impatient and I want the money to come out of my account immediately, I do not feel like waiting for checks to clear.

      @@misterbee66 we think alike because I even though I have a checking account I always get a cashier's check for my rent every month and I have them put my apartment number and the month that I am paying for in the memo section. I want the money out of my account so that it balances immediately.
      Another rule of thumb is that if you get money orders, get them at the post office because they can trace them back indefinitely whereas Western Union can only go back 5 years I believe, if not it's 2 years. Last piece of advice, I take a picture of my cashier's check and email it to a folder in my Yahoo account. That way if I lose my rent receipt I have proof that I paid it even if I lose or damage my phone.

At the end of the day if it's ever a problem it will never be my word against theirs. Let the paperwork speak for itself. :-)

      @@shanikaayanna9767 honey there are a lot of logical explanations on why grown ups don't have a bank account honestly a lot of people feel like it's more safer having their money at home in a safe then having a bank account you do know that those cards can get stolen you do know that your wallet can get lost or someone can steal your purse with your credit cards and debit cards in there you do know that it's very easy to use a debit card or a credit card and you can still make a purchase without the PIN number even in a store you don't necessarily have to go online. Also swiping your card nowadays is really not that safe because people can easily still your credit and debit card information with one swipe whether you buy something and swipe your card in the store or whether you pay for gas at the gas pump

    If a person can't cash their own check. A grown person at that. There's absolutely no reason that I'd cash a check for them.
    Get your own bank account and if you had issues in the past with a bank preventing you from getting an account, settle those issues because it's unacceptable behavior for an adult with responsibilities and a job assumedly that will pay you with a check until they can direct deposit you.

    The check cashing place is where people go if they don't have a bank account for whatever reason. All the banks I use will not cash a check in anyone's name unless their name is on the account. This probably happened too many times

    This is not too far fetched - I hadn’t spoken to my home girl in years and when we reconnected she told me the same thing. I think it was like a confession I think she felt so bad about having to sell her body and her and I were so close few years before she just told me. She didn’t tell me in a proud way she said it like she was stressed. This same exact thing happened to me so it’s not that absurd.

    For those who don't have a bank account. There are a few things. If you are afraid of the bank, you probably don't go outside at all, afraid of people robbing you. The only people I know without a bank account, owe the Feds, child support, credit card fraud etc. If you travel, you should have a bank account, a lot of places don't take cash and on the plane. Customs may ask you about your stay, and how much money do you have, and prove that it is yours. And if you are carrying too much and don't declare it, they can take it away. So I guess you just stay at home counting your money and go nowhere, but to the bar or club. If you travel by car and don't have a credit or debit card, I don't know if you can get a quality hotel room?

      Exactly 💯%!! Yes, I believe the plaintiff was telling the truth about the defendant being a prostitute because she was establishing evidence for Judge Mathis to consider regarding her morals, character, and credibility as a person. Also, the entire story about the check was shady as hell. The defendant knew that check was fraudulent yet she let the plaintiff deposit that check into her bank account. Telling the plaintiff she didn't have the address for the business and she didn't know when she would start working so she had no way of communicating with the individual to get there contacts. That's all part of the scam deposit the check and you wire a portion of the money through Western Union to the person who gave you the check and that person keeps the remaining portion. Some banking institutions will close your account and/or call law enforcement when you deposit phony checks. ⚖
