      I had a civil trial against a pro se litigant. She made every mistake in the book, but I also knew that if I was going to call her on all of it, everything I did had to be perfect. That was almost harder than most other cases I've had!

      The judge is giving her 30 days for the first contempt violation. I doubt she will stop at one. This judge is great with sovereign citizens. He ignores most of what they say. He lets them put their beliefs on the record to show any court of appeals or compla8ntmthat she is nuts.

      The ones that spoke to her during the case, I would have removed them for obstructing a court proceeding.

      Because that would have just added another contempt hearing, which would have pushed back the actual trial. It's a delay tactic that broadcasts loudly that any trial with this nutcase is going to be a nightmare. So while the 'entertaining' option would have been to frog march her right back to lockup from the offset, the best option is just to push through to a verdict and be done with her: at least for now.

      The young man only got caught with a beer underage…not crime of century. He was young and didn’t understand who was who in courthouse. He did not know her until she approached him in courtroom hallway. Defendant exploited his naivety for her own purposes and gave him money. She used him as a stooge. So angry. This is worse than using BS in own case.

    It might be difficult to see Judge Gauthier apparently allowing her contemptuous behavior...but by pushing thorough to the end, he ensured that this case is _done._ Note how he immediately told the peanut gallery that they could either shut up or be escorted out. He’s as decisive as he needs to be to get this over and done with.

    I'm sorry, but the judge should have taken her out of the court room. I was LEO 24 years, I LOVED arresting these silly citizens. I arrested hundreds of them and after a normal traffic stop, I had them in custody about 5 minutes into the traffic stop. When they said I needed to get a supervisor on site I would tell them I did not need a supervisor to arrest you which is going to happen in about a minute. She should have got 90 days in jail. She is a true believer in all her common law bull shit.

      By law he has to complete the process of each phase of the hearing. If you pay attention though, he allows her to fillabuster past offering herself to give testimony. He asks her if she has any witnesses (meaning even her) and she just refuses to give a straight answer and he moves on... but to be fair, she literally used the whole hearing as her testimonial grandstand time, she didn't need to give any additional testimony. But the judge wanted his decision to be "appeal proof".

    I would hazard a guess that the prosecutor has never had to make her closing statement while a noisy defendant is disruptively walking around and talking to her supporters in the audience, but she did a great job keeping focus. I would have had to keep asking the judge to tell the defendant to be quiet while I was talking!

      While I would absolutely love to see this lady do 90 days in jail for the disrespect she shows the society she clearly benefits from, like most things it isn't that simple.
      Every sitting Judge knows the prison system is over max capacity and the per/capita amount of Americans incarcerated is extremely high for a modern western country.
      Now we could discuss why that is and how to go about lowering it but it doesn't change the facts currently.
      With this in mind, many Judges (not all) are looking for just about any reason NOT to put people in jail unless it is absolutely necessary.
      In this ladies case what will 90 days in jail teach her what 30 days won't? She's just going to take up space which is at a premium. She's going to walk out of that jail probably more devoted to her pseudo-law than she was going in. She may be dumber than a box of rocks but she clearly isn't a violent person.
      The longer a non-violent but dumb person stays in prison the more likely you are to actually turn them into a violent one.

      I've seen a lot of judges who immediately shut them down. If a judge allows it, then they deal with it. It's the same rhetoric everytime, the judge should have a document showing his jurisdiction when they request it, then their only option is to appeal. Then the appelate court should do the same thing.

      @@MrFriesz - Yeah, some judges shut them down, but the fact that they're even taking up a slot on the docket in the first place, and requiring time spent by the prosecutor's office and the probation office, and (until the judge allows the sov cit to represent himself or herself) the public defender's office, all chips away at a limited supply of time and resources available in the public judicial system. And usually it's for some crazy issue or violation that would never end up in court for anyone else _except_ a sov cit. They do it on purpose-- the movement is an organized assault on the judicial system.

    She has a very distorted view of her importance. She is rude, misguided, unappealing, and paranoid. She gathered up people on the street to support her and, at times, she even argues with herself. At no time does anyone interrupt her or talk over her, which she does repeatedly. There are judges that do not put up with sov cits at all.

      Defendant wanted to get ruse out of judge and prosecutor. Ignoring some of her nonsense was a deliberate choice to keep trial moving.
      Defendant wanted judge get mad and start yelling or for judge to react to each of her points.
      Judge picked his battles.

    With other SovCits, this Judge has not let the minute-by-minute contemptuous interruptions continue. I believe he was allowing it this time to complete the process without further delay. There was even one SovCit case that was allowed to be appealed to a much higher State Court. I believe that one was also allowed so that lower courts could then cite the Appeals Court ruling that none of the SovCit jabberwocky has anything to do with the real world.

    If she was indeed a teacher at one time, any student that she failed for any reason should be passed with flying colors. The funniest part of her defense is that while she was questioning the witnesses, she gave all the proof necessary to convict her. What I find sad is that she only has to serve 30 days. She can be glad that I'm not the judge. I would have given her 5 years.

      He stated earlier that 93 days was the maximum allowable. The point is, he is obeying the laws.

    I have to add to one of your on-screen comments. I hope it doesn't offend you because there's no offense intended.

    AND THEN IT SUNK.
    This sovcit lady is something else! They all buy into (literally, for some) this stuff and argue it with cops and courts. It never works, yet they still keep trying. At least it gives us some laughs!

      I worked in a prison; they will 'befriend' her to find some angle to get something form her. Jail/prison is a whole different world; no one is who they seem.
