After reviewing my records you thought you were not the best firm to represent me but with my permission gave my information to another firm that might be a better fit. @@Hohmies86 it was a while ago. They work on a contingent basis so if they don't get you an increase you don't owe them anything. I think it was 10% of only my back pay nothing from my future payments.

Yup and sadly all of my other disabilities are secondary because my foot is so bad it’s causing my back and hips pain as well as horrible depression and anxiety . Living in pain everyday all of these years have worn me down so much . I just got to 90 earlier this year after getting out in 2005 with 10% and when I got home I was in a wheelchair and couldn’t even walk . Now I can walk and my biomechanics are so messed up it’s causing other parts of my body that weren’t injured to now have irreversible damage due to years of limping and favoring one side of my body when I walk .
I owe these folks the World. I fought with the VA for years, They got me (IUTD) Individual Unemployability Total Disabled rating. They know the law and stand up to the VA. They fight!

I need help with my disability I am at 60 and I can not see and I have had 6 or 7 knee replacement and I am still can't stand up for more than 45 minutes and my right eye is totally missed up for ever The VA is the only one that has been working on me thanks and God bless you

Im at 70 fighting for 100. Claims already in. I been service connected at 0 since nov2015 for headaches. I sent more evidence for an increase. I got sick of the constant denials and got a lawyer. Wish me luck.
I'm at 90% with several service connected conditions. Currently waiting for my presumptive asthma claim from the burn pits. I was told I needed a nexus for my planter fasciitis. I've been diagnosed for it in both feet. I served in the Marine Corp and their telling me I need to have a nexus for that...lol I'm not sure what to say or how to convince them that we used to hike 10 plus miles a day with 80 pounds of crap on our backs in boots made in Thailand lol They were not made with comfort in mind. XD Walked in because my feet hurt so bad I was having a hard time walking and when they scanned my feen the doc was like...shit...your arches have completely caved in on themselves. His reaction had my dying of laughter. XD lol
Still waiting for burn out claim? I was around burn pits in Iraq in 03. When I got back I had terrible sinus problems. Had 3 Surgery’s for nasal polyps. Lost my sense of smell after the 1st surgery. They rated me 30% for that. But I’m wondering if I can add another claim for burn pits as the reason my sinuses were messed up. My Surgeon stated In his letter my sinus problems were more likely then not due to being over there.
I am combined 80%. I have 20% ea for both shoulders. I also have other service connected ratings. I was denied IU. Now I am back in the VA doing chiropractic and also muscle skeleto because pain has gotten worse and it radiates into my back. Should I apply for it again?

If you're TDIU P&T, you can work if you have marginal employment, sheltered or protected work. Marginal allows you to make over poverty threshold if you work half or less than half the typical hours, or if you have sheltered/protected, you can work full time and make more than poverty limits. Does your employer make special accommodations?

I’m currently rated 90 %. I recently had a physical with my VA doctor and he said I should see a VSO to get TDIU as he said I qualify for it. He even wrote a statement in my medical records stating this. My ratings are 50, 50, 50, 30, 10, 10, 10 I called our local VSO and explained what I wanted to do per my doctor and he discouraged me and said the VA could lower my ratings. J was given 100 percent because of what happened to me in 2003. With my doing. A yr later. Va tookmit. Gave me 50. Percent. Took me 13 yrs to get back what they took. I'm 90 percent. Still fighting for 100.
I have 10 % for tinnitus 10% for scars 70% for PTSD with new diagnosis of diabetes type 2, hypertension, hypothyroidism, migraines, ED, peripheral neuropathy, lost of motor function on the hands, foot pain… I have not worked since 2019 March my conditions have gotten worse an I just had a C&P exam for increase for ptsd. I am an RN but with my condition I have not been able to retain a steady job since I first started working in the civilian world.

I’m 28 years old. US Army veteran. Serve from 2011 to 2014. This past summer just received 100% combined rating. From talking to other lawyers, they say this is the hardest way to get 100%. If it’s harder to receive 100% with combined ratings then you should be able to receive Social Security also even if it’s not P&T. Am I right?

I don't have a need to appeal at the moment because I'm already at 100% and i dont need the VA looking deeper into my disabilities because they can reexamine you if they want and they can request to lower your ratings if it has been a certain amount of time. Im blessed with the rating i currently sit at so i wont appeal right now although i would win very easily with the help of a VA lawyer.

I claim neck pain as a secondary for tbi the highest you can get is 100 i believe. I also have 10 & for lumbar and tinnitus.
My husband was a 100% but Califorina took my husband away and sent him back down to70%.. VA needs to update all veterans health care.. We ask his Dr but them not listening to him.. What to do?

@@aidamontanez1708 you would not get tdiu if you are working right now. does not matter what special circumstances you get. just means you can work because you found employment that will accomadate you. you prove that you can work and manage your finances. your best bet is to change the 70% to 100%
I have a question that I just can't seem to find an answer for. If I file for disability for a certain issue like my back, and I go to the CMP exam and they determine that I have other compensatable issues, is there a chance that I will get rated for the other conditions? Or just the one that I filed for?
Do you help vets that don't have anything yet? I saw a physician and they said based on what they saw in my records I can get 60%. But they want $3000 upfront before they file it. How do you guys operate?
I’ve been rated at 90% since retiring in 2010. I hired a lawyer in March 2021 due to being unemployable over one of my 10% ratings. Hopefully it’ll be back dated to 2010. I’m 70% PTSD; 30% Migraines; and six items each rated at 10% (90). I spent 29yrs and my last 15 was with the 304th Rescue Sq where most of my injuries/surgeries happened. Area51, Desert Storm, 7 deployments to the Middle East, & Afghanistan to end my career. Chronic pain on every step. I had a spinal cord stimulator implanted in Sept 2021. No relief.
At a glance, you are at 89% total. -If you bumped migraines from 30 to 50 (now 93% rating) -Need to bump that back from 10% to 20% (now 94% rating) -Add 1 more 10% from presumptive claims (burnpit exposure/asthma, tinnitus, cold weather exposure/frostbite) 10% min for each listed and you got 100% cumulative (95% rounds up). Just a fellow vet, but you seriously need to get those 10%s up after submitting enough info for 50% migraines.

I did 22 years Regular Army and Army Reserve. My adult stepson was in the Navy, deployed to Iraq as a combat medic and now has PTSD and had cancer. He suffered from night terrors. He recovered from cancer, got treatment for the other stuff, and now has 100% disability rating.
How I get increase for issue, brace, hearing aid I was issue a wakings stick, I have arthritis throughout my body and I’m at 92.9%. Was denied sleep apnea secondary to ptsd 70% and I’m continues pain
I qualify for TDIU by the VA percentages. Does my age at 66 effect that? I have not been able to work for 12 years. I lost 12 years of earnings for my retirement and only receive the minimum amount of my SS not to mention the amount I could have invested in my IRAs. The VA has me rated at 90%.

If I'm currently at 90% and receive an additional 50% for other service connected disabilities. Shouldn't that place me at 95% which would be rounded up to 100%
I currently have a 60% disability from the VA due to a heart issue 6 years ago. A few months ago I had another stint after a 99% blockage in my rt coronary artery. I applied for an increase but was denied any increase. A year prior to the first stint (6 years ago) I found ti more difficult working. It has progressively become worse, particularly prior to the second stint. I used to own 3 large massage clinics and have sold them because I could not continue at the work pace as before. I am now still working but only a few hours a week. Do you think there is any hope for TDIU?

@@elinino5275 I’m a Vietnam Veteran. Any heart disease is automatically considered to be service connected if you were in Vietnam. Also true for a lot of health issues.
I gave up in 1997 trying to get help from the VA I’m sure exactly what they were going for I spent 3days per week seeing specialist after specialist and doing test after test I would lay in bed n shake all over from night terrors n reliving the 164 oil fires around me during desert storm the sky remained purple in color and I still feel symptom’s today of burning fuel n taste n smell disorders overwhelming scents that leave me coughing choking or just nervous to the point I exit the situation as fast as I can I need help I’ve applied for social security disability and am awaiting the outcome but truly wish my attorneys at Victory disability would help me seek what I am owed if not for me for my kids and my wife who deal w my moods and lack of energy to do much of anything I wish to god I would just feel better most times but the ptsd lack of being able to stay asleep waking up sweating and shaking from nightmares of men exploding in front of me have left me much less of a person who is run down and just sad always because I know in my heart something happened there I was sick in a tent hospital somewhere in Saudi’s desert before the ground offensive began but after almost dying I did my duty and am glad to hear of people like yourselves looking out for us guys and girls men and women who lost everything to protect the wonderful USA I don’t blame anyone I just want what is right to happen if not for me for my wonderful family who has seen it all

My claim has been submitted for over a year now. Currently, at 80% with six other items deferred. Not sure how much longer it’s going to be but gets old sitting around waiting! I call VA and get told they are working on it.
I’m at 80% for loss of use of left leg, four back operations when I was in the USAF, left foot drop and depression. since I got out 2 operations on right shoulder, two on right knee and carpal tunnel right wrist, trigger finger and right elbow operation. Now my left elbow hurts all the time and I have to see an orthopedic surgeon for my right knee again. But afraid to go to the VA. Afraid they may try to lower my compensation. Really don’t know what to do!
They wont lower your compensation…gather up your paperwork from your doctor or doctors that you’ve seen for your elbow and or knee and submit that claim. I’m sure you’ll get to 90% at a minimum. Do IT! Don’t be scared…you served your country, you deserve to be compensated.
I am combined 90, stand alone 80. My main problems come from getting hit by a car on active duty and messed up my neck effecting both arms. Lately I have new problems effecting my lower spine/legs, plus a very curved spine discovered. I filed a claim using the car accident as the reason and they, VA, said no. What do you think?

It’s hard but possible man. I was exactly at 90% filed for two claims. Now I’m at 94%. Now going back to do a increase and another secondary. Look at all your claims. Increase are easier just have to prove they’ve gotten worse or secondaries to already service connected issues.

I just got my 90% last week up from 50% but I’m really 160% I still have claim for hypertension migraines and TB but I can’t really prove the TB was service connected .
@@LawDogg01 I did not realize it was so much the VA math is so confusing I’m glad I know that now though . I figured maybe 20 or 30 would do it I’m also going to put in for tinnitus and I have hammertoe on both feet I know that’s only 10% and 10% if those are approved . I really need to have an mri on my hips done because I’ve been limping so many years my back is now an issue and my hips have been bothering me since 2012 I had an mri then again in 2017 and both times there was fluid and inflammation and it got worse . It doesn’t hurt every single day like my foot and my back but when I am on my feet for more than a few hours they will hurt and bother me for a week .

can you do CWT program at VA hospital? That's what I'm doing. It is considered compensation not earned income.

I’m currently rated 90 %. I recently had a physical with my VA doctor and he said I should see a VSO to get TDIU as he said I qualify for it. He even wrote a statement in my medical records stating this. My ratings are 50, 50, 50, 30, 10, 10, 10 I called our local VSO and explained what I wanted to do per my doctor and he discouraged me and said the VA could lower my ratings. Wondering any thoughts please?

Question❓ I am T&P, 80%, with IU; I have service connected that have deteriorated, and some of the dots have not been connected between primary and secondary issues as service connected. All of the dots have not been connected, should I go in for 100%, or should I just leave things alone. Question❓ Will my IU fall off at a predetermined age, say 62 or so?? J was given 100 percent because of what happened to me in 2003. With my doing. A yr later. Va tookmit. Gave me 50. Percent. Took me 13 yrs to get back what they took. I'm 90 percent. Still fighting for 100.
I have 10 % for tinnitus 10% for scars 70% for PTSD with new diagnosis of diabetes type 2, hypertension, hypothyroidism, migraines, ED, peripheral neuropathy, lost of motor function on the hands, foot pain… I have not worked since 2019 March my conditions have gotten worse an I just had a C&P exam for increase for ptsd. I am an RN but with my condition I have not been able to retain a steady job since I first started working in the civilian world.

I am only 10% for tinnitus and I strain my lower back in 1982 and they said I didn’t injure myself in the service when they denied me, I received a letter saying they saw where I strain my back
Im at 90 % for Ptsd and sleep apnea however they ruled my depression was not denied or granted
You cannot get a rating for depression if you have already been rated for PTSD because both fall under mental health.

How does one address the concern about filling an additional claim with the proposed changes looming. I'm concerned they'll reduce my current rating. It's wrong that they've got me scared to file an additional honest service-connected claim.

I’m 28 years old. US Army veteran. Serve from 2011 to 2014. This past summer just received 100% combined rating. From talking to other lawyers, they say this is the hardest way to get 100%. If it’s harder to receive 100% with combined ratings then you should be able to receive Social Security also even if it’s not P&T. Am I right?
I tried SSDI after being denied several increase attempts through the VA. I was denied x2 for SSDI as well. 😔

This is how the how i achieved 100% combined by ratings alone. I started at 70% in 2014 but this year i really wanted 100%. So i studied and figured out more things i could claim. Also claim secondary disabilities. Thats gold too.

The other disabilities that I have with the VA included in my list of disabilities are migraine headaches, arthritis in the cervical spine and neck, left hand and right hand carpal tunnel syndrome and sleep apnea. I would get 50% just by sleep apnea alone and migraines because i meet the criteria for the 50% for each. I could hire a lawyer to appeal these ratings because they are not service-connected according to VA but i know that at any given time i could have them connected as disabilities direct service connection but most surely secondary by way of my other service connected disabilities. I don't have a need to appeal at the moment because I'm already at 100% and i dont need the VA looking deeper into my disabilities because they can reexamine you if they want and they can request to lower your ratings if it has been a certain amount of time. Im blessed with the rating i currently sit at so i wont appeal right now although i would win very easily with the help of a VA lawyer.

I claim neck pain as a secondary for tbi the highest you can get is 100 i believe. I also have 10 & for lumbar and tinnitus.
My husband was a 100% but Califorina took my husband away and sent him back down to70%.. VA needs to update all veterans health care.. We ask his Dr but them not listening to him.. What to do?
If a person at 90 has only been capable of maintaining a part time (20-30 hrs) employment would TDIU be worth attempting 70/20x3/10x3=89%

@@aidamontanez1708 you would not get tdiu if you are working right now. does not matter what special circumstances you get. just means you can work because you found employment that will accomadate you. you prove that you can work and manage your finances. your best bet is to change the 70% to 100%

I have a question that I just can't seem to find an answer for. If I file for disability for a certain issue like my back, and I go to the CMP exam and they determine that I have other compensatable issues, is there a chance that I will get rated for the other conditions? Or just the one that I filed for?

I’ve been rated at 90% since retiring in 2010. I hired a lawyer in March 2021 due to being unemployable over one of my 10% ratings. Hopefully it’ll be back dated to 2010. I’m 70% PTSD; 30% Migraines; and six items each rated at 10% (90). I spent 29yrs and my last 15 was with the 304th Rescue Sq where most of my injuries/surgeries happened. Area51, Desert Storm, 7 deployments to the Middle East, & Afghanistan to end my career. Chronic pain on every step. I had a spinal cord stimulator implanted in Sept 2021. No relief.
At a glance, you are at 89% total.
-If you bumped migraines from 30 to 50 (now 93% rating)
-Need to bump that back from 10% to 20% (now 94% rating)
-Add 1 more 10% from presumptive claims (burnpit exposure/asthma, tinnitus, cold weather exposure/frostbite) 10% min for each listed and you got 100% cumulative (95% rounds up).
Just a fellow vet, but you seriously need to get those 10%s up after submitting enough info for 50% migraines.
At least you know you're assured at least 90% for the rest of your life.....

I did 22 years Regular Army and Army Reserve. My adult stepson was in the Navy, deployed to Iraq as a combat medic and now has PTSD and had cancer. He suffered from night terrors. He recovered from cancer, got treatment for the other stuff, and now has 100% disability rating.

I qualify for TDIU by the VA percentages. Does my age at 66 effect that? I have not been able to work for 12 years. I lost 12 years of earnings for my retirement and only receive the minimum amount of my SS not to mention the amount I could have invested in my IRAs. The VA has me rated at 90%.

Where do you find your v.a.disability rating? I've looked on my original documents ( disability) can't see it..am I looking at wrong place? My disability is manic depression, bipolar, was in Navy during Vietnam War. I get $1494.00 monthly..unfortunately I only get $295 Social security..which I worked my whole life till got disability in 2006..I guess what I'm asking is,,is my SS so low because I'm on v.a. disability also?

I currently have a 60% disability from the VA due to a heart issue 6 years ago. A few months ago I had another stint after a 99% blockage in my rt coronary artery. I applied for an increase but was denied any increase. A year prior to the first stint (6 years ago) I found ti more difficult working. It has progressively become worse, particularly prior to the second stint. I used to own 3 large massage clinics and have sold them because I could not continue at the work pace as before. I am now still working but only a few hours a week. Do you think there is any hope for TDIU?

@@elinino5275 I’m a Vietnam Veteran. Any heart disease is automatically considered to be service connected if you were in Vietnam. Also true for a lot of health issues.

I gave up in 1997 trying to get help from the VA I’m sure exactly what they were going for I spent 3days per week seeing specialist after specialist and doing test after test I would lay in bed n shake all over from night terrors n reliving the 164 oil fires around me during desert storm the sky remained purple in color and I still feel symptom’s today of burning fuel n taste n smell disorders overwhelming scents that leave me coughing choking or just nervous to the point I exit the situation as fast as I can I need help I’ve applied for social security disability and am awaiting the outcome but truly wish my attorneys at Victory disability would help me seek what I am owed if not for me for my kids and my wife who deal w my moods and lack of energy to do much of anything I wish to god I would just feel better most times but the ptsd lack of being able to stay asleep waking up sweating and shaking from nightmares of men exploding in front of me have left me much less of a person who is run down and just sad always because I know in my heart something happened there I was sick in a tent hospital somewhere in Saudi’s desert before the ground offensive began but after almost dying I did my duty and am glad to hear of people like yourselves looking out for us guys and girls men and women who lost everything to protect the wonderful USA I don’t blame anyone I just want what is right to happen if not for me for my wonderful family who has seen it all

My claim has been submitted for over a year now. Currently, at 80% with six other items deferred. Not sure how much longer it’s going to be but gets old sitting around waiting! I call VA and get told they are working on it.
That’s crazy…think of it this way when you get approved that retroactive payment for 12 months will be nice!
I’m at 80% for loss of use of left leg, four back operations when I was in the USAF, left foot drop and depression. since I got out 2 operations on right shoulder, two on right knee and carpal tunnel right wrist, trigger finger and right elbow operation. Now my left elbow hurts all the time and I have to see an orthopedic surgeon for my right knee again. But afraid to go to the VA. Afraid they may try to lower my compensation. Really don’t know what to do!
Doubt they will EVER lower you. Suggest you talk to one or two of the service organizations like VFW and/or DAV and see what they say.
They wont lower your compensation…gather up your paperwork from your doctor or doctors that you’ve seen for your elbow and or knee and submit that claim. I’m sure you’ll get to 90% at a minimum. Do IT! Don’t be scared…you served your country, you deserve to be compensated.

I am combined 90, stand alone 80. My main problems come from getting hit by a car on active duty and messed up my neck effecting both arms. Lately I have new problems effecting my lower spine/legs, plus a very curved spine discovered. I filed a claim using the car accident as the reason and they, VA, said no. What do you think?

It’s hard but possible man. I was exactly at 90% filed for two claims. Now I’m at 94%. Now going back to do a increase and another secondary. Look at all your claims. Increase are easier just have to prove they’ve gotten worse or secondaries to already service connected issues.

I was at 80%,reduced to 30% ,with them saying my condition was getting better, my va doctor says i shouldnt have never been reduced, i have spinal issues and secondary issues that caused the initial injury,sleep apnea, extreme pain,presently being represented by VFW,IN WHICH THEY HAVE FILED A INTENT TO FILE,SHOULD I GET A OUTSIDE DOCTOR WHO KNOWS THE VERBAGE AFTER THE EXAM,I NEED MY COMPENSATION BACK DUE TO THEIR MISDIAGNOSIS GAGING MY CONDITION, CAN YALL HELP ME.
I just got my 90% last week up from 50% but I’m really 160% I still have claim for hypertension migraines and TB but I can’t really prove the TB was service connected .
I have laten TB and no one else in my family has it. I don't know how I got it either. Strange....
Your next claim will need to be at least 50% VA math for that jump to 100%

I figured maybe 20 or 30 would do it I’m also going to put in for tinnitus and I have hammertoe on both feet I know that’s only 10% and 10% if those are approved . I really need to have an mri on my hips done because I’ve been limping so many years my back is now an issue and my hips have been bothering me since 2012 I had an mri then again in 2017 and both times there was fluid and inflammation and it got worse . It doesn’t hurt every single day like my foot and my back but when I am on my feet for more than a few hours they will hurt and bother me for a week .
