    This is the greatest judgement from the supreme court since 1999 Any Gov that does otherwise against local govts funds must be impeached or president should declare State of emergency in such a state bcs all these Govs need iron hands!

    This is a welcomed development.
    It ensures accountability on the (now elected) LGA Chairmen and makes it more difficult for some State Government to embezzle.
    We need more decentralization and regional/state/LGA autonomy in this country.

    Now it is left to the LGAs to fight for their rights, the law has given them the power of their own, so all Local councils should recognise themselves to improve stability, little by little and by challenging themselves, there would be competition among them and then you would see development from all angles.

    Whao! what a time I had listening to SAN Femi Falana. I think we are not being briefed enough and our progress to sustainability has been very slow. Our next fight is independent Electoral commissions in federal and state level. so that our elections can be sanctified. I pray we get there soon

    I think the state govts should set up their own state efcc, and then the NGOs should start standing and speak up in states. Then House of Assemblies should do their jobs and no more be puppets of Governors, so that states can have internal democracies of their own.

      Bad attitude of governors while in office can't be checked due to their immunity from prosecution.

    If State Independent Electoral Commission (SIEC) is the body that will still conduct the local government elections, then this judgement is just a mere change of the channel through which Governors receive the local government allocation.

    It is a simple thing: allocations are made to the State/LGA joint accounts and the exact amounts due to each of the LGA is further allocated to them. If N1 billion is allocated to AB LGA from Abuja and paid to the state/LGA joint account in accordance with the constititon, the exact N1 billion is paid to AB LGA by the state. If rhe funds hits the State/LGA joint account today, it is expected that the LGAs get their allocations the same day or not later than the next. No state has the power to deduct a penny from the funds due to the LGAs or delayed further disbursement to them.
    The problem with Nigeria is not that the law is not robust enough to address some of the issues facing us but the inability to observe and enforce the law.

    I humbly ask, the Efcc do not have enough capacity to investigate acts of corruption in the 36 states of the Federation and the Federal government, by this ruling we are adding 774 local governments to the function of the Efcc. How will they cope? There is no Efcc presence in my Lag.

    Have successive Nigerian presidents been accountable to Nigerians? Don't Nigerians know them & their residents?Have state governors been accountable to the citizens of their respective states? Don't citizens of the states know their respective governors and their residents?
    What makes direct allocation to chairmen automatic factor for accountability at the LG level?Aren't chairmen Nigerians living in Nigeria who have also imbibed the culture of self-service & impunity at the expense of the people like the presidents & governors?
    Enough of the kindergarten analysis that the people will hold chairmen accountable b/c they know them up to their kitchen.

    My suggestion would be that;
    in other for it not to appear as though the Supreme Court is undermining the constitution, as it's been argued by some supporters of the state governments, let the Federal Government in conjunction with the CBN and The Banks holding State Governments Accounts brainstorm with reputable Software Engineering Companies to create an "AUTOMATED DEBIT/CREDIT, STATE/LGA FUND PROGRAM" inside every State-Local-Government joint accounts.
    This program (code) shall have the resources to automatically transfer the statutory amount of money meant or appropriated for each LGA directly to the LGA Account within 30' to 45secs of notification of 'Credit Alert' from the Federation Account, without any human, or Third-party interference or intervention.
    This way, the provisions of the constitution are still being upheld: where the money still goes to the State/Local Joint Account, but yet immediately moves unhinged into the 'Whereabout Account" of the LGAs. Righteousness fulfilled.
    This is my little suggestion -- might not necessarily be the best though, but we can seriously consider fine-tuning any grey areas.

    Any State government that does not understand joint accounts of State and local government must be a daft. For example, let say the joint account is a Will. In the Will, Mr A is given two houses, and Mr Z is given one house. Why should it be difficult for anyone to understand unless the person is daft. In the joint account, state governments have their money allocation specified and Local government money allocation specified, and the allocation goes to the authorities as stated, so what is the noise all about?. Daft.....

    It's a a really good policy HOWEVER. It is clearly unconstitutional according to the letter of the law.
    James Ibori, even with his reputation, is correct. It does damage federalism. The states are meant to have independence to run their own affairs.
    If you want to change this, the right thing to do is PASS LEGISLATION, not have the Supreme Court de facto change the law.

    The supreme court ruling as usual is also complicated and has confused many including Mr. Falana. He was very confused answering certain questions. When you say the money should be paid to the LGA directly, why saying it should pass throught the JAAC account first. So who is incharge of the JAAC or authorises the distribution from the JAAC to the LGA? We will also see situations where certain LGA will be owed their monies or delayed for " technical reasons" and end up in courts frustrated. Again, just like Mr. Falana said, elections in the LGA is the worst because the ruling party wins all and they in turn remain slaves to governors or still be frustrated till 3 years expires.

    The judiciary can save Nigeria by simply adjudicate and inetepret the law swiftly. Imagine the confusion in Rivers state, the judiciary could have saved the situation by just simply and swiftly adjudicating over cases brought before it.
    A strong legal environment is a prerequisite for the strengthening ans survival of democracy, and even the growth of the economy. No foreign investors will come to an environment where remedies that not be gotten for contractial breaches. Even when they do, it takes forever. Such is not helpful to businesses. Business people should be able to approach the courts to seek remedies if they feel their rights have been violated. The US is a prime investor location because of its strong legal system. Investors trust the sustem and know they can get justice fromt the system.

      Nigeria can work if we allow it work. Too many people and interests are clogging the wheel of our progress. Ofcourse a strong, vibrant legal environment is necessary for smooth economic activities and foreign investment but you have certain interest who benefit from the current chaotic system. This situation can be resolved if we decide to carry out legal reforms that will enable quick settlement of dispute. This won’t happen by itself though we the citizens have to demand for it, work for it and advocate for it by actively participating in the democratic process. Democracy works if we allow it work. Just like western countries especially US where everybody in the system makes sure the system work by enforcing high standards and punishing those who breach it. The citizens of the USA are hyper active participants in the democratic process, they are vigilant because they know the benefit and consequence for complacency. This is the kind of attitude we should embrace in this country. The disposition to participate in the democratic process. Too many of us have refuse to participate that is why we are where we are and then we complain when things are not working. We need to put in the work so we can enjoy the fruit of the process.

    I think the attention is focused on the AGF for no reason, you guys forget that these governors have immunity and as such can do anything against the constitution with no repercurssion. all these AGF act under the instructions of the governors , this will never stop until we strip them all of the immunity

    But this is nonsense. How can Falana be arguing this? It is not the duty of the Supreme Court to create laws. Their duty is simply to interpret laws. The constitution says the money should be paid to a joint account with the state government, but the SC, in total disregard pf the constitution is saying that it should be paid directly to the LG. And Nigerians are happy about this?Just because what the ruling means is positive does not mean this should not be condemned. Illegality and lawlessness is illegality and lawlessness regardless of whether the outcome is good or not. We are not realising that this is part of the rascality of the SC like so many other rulings we have been complaining about recently. The correct thing is to have the NA change the laws. And this supposed SAN is applauding this?
