You don't even apply for a stay in a declarative judgement instead, it is an application for an injunction pending appeal that they ought to apply. Am disappointed in that PDP chap there if truly he's a lawyer.

He is promoting anarchy, lawlessness and corruption in Edo State, and including in Nigeria. Which is bad for democracy and democratic governance.

The political situation/tension in the country have made even those of us who are not lawyers nor even pass tro the walls of the universities to be very conversant with court processes in the country so i expected this presenter to av known that the moment someone file for a stay of execution in a matter(wede it is heard or not)every party is suppose to wait till the substance of the matter is dealt with and Final judgement given before anyone can claim to be the winner.

But thd Tinubu-APC government has bastardised and degraded Nigeria judiciary so much that has never been witnessed in the history of Nigeria.
There has been a flouting of court orders with impunity.
In the Tinubu-APC government, some cases are RUSHED to the Supreme Court and get judgement out. But when it comes to other cases the government knows they can't win,the applies DELAYED tactics.
Shaibu has Bern impeached by Edo House of assembly, a high court had reinstated him, another court order has been filed for notice of appeal and stay of execution, and Shaibu himself has publicity DECAMPED from the PDP party that choosed him as ex- deputy governor to another party APC.
So why is Shaibu not being patient until the stay of execution will be decided. Status quo remain.

This case is different from the ones cited by Obaseki’s lawyer. In case of Shuaibu, nobody was in that seat. The court believes that the position of the deputy governor is not vacant . In this case nobody is in this office besides Shuaibu. Shuaibu has no reason to wait before enjoying the judgment as the position was vacant. The other appointee was not legally appointed. The position has not been occupied in the opinion of the court. This made it different from the appeal against a sitting governor which the anchor was referring to. Our journalist were all biased and brown envelope journalists. These are two different cases. Obi is in a position already but the person occupying Shuaibu position was not elected with Obaseki. He is not existing in the face of the law. Please stop using Obi’s case. Useless governor.

The Deputy Governor, Shaibu, should be allowed to continue his work and perform his duties in accordance with the law. The individual representing PDP is making baseless arguments, which only serve to mislead the Governor into perpetuating unlawful actions. These are the types of people who encourage the Governor to disregard legal procedures and act outside the boundaries of his authority. The Governor must adhere to the law and respect the role of the Deputy Governor, allowing him to fulfill his responsibilities as outlined by the constitution. Ignoring the law and acting inappropriately not only undermines the rule of law. but also erodes public trust in the government. It is imperative that the Governor corrects this course of action and allows the Deputy Governor to carry out his duties without further interference

Court can not deny stay of execution
At times I wonder wat kind of network this television stations are using,I do video calls every now and then and it's seamless but this stations can't even establish a video communication with their guests for once without network failures.

I think you are ignorance of the law. On what grounds does an impeachment takes place. If the court finds that the ground for impeachment was illegal then the impeachment becomes null and void

The issue here is very simple……if a court gives a judgment, the court allows a period of time in most cases 14 days to allow appeals application against such judgement…..after the expired period of time and if there is no appeal against the judgement then the judgement takes effects…….this is the standard practice worldwide…..so what precedent is PHILIP SHAIBU is attempting to break?….

Having been reinstated by a court of competent jurisdiction, Philip Shuaibu remains the Deputy Governor of Edo State. A judgment remains subsisting until it is vacated or set aside on appeal. It is elementary law that the mere filing of an appeal does not operate as a stay of execution.

Unless and until your application for stay of execution of a judgement is granted, the judgement remain in force especially if it is a declaratory judgement.
