      @@Wise-1-x1yeh…yes and no. Qualified immunity is important to a degree, because without it police would be too afraid to do their jobs, and this “personal accountability” would be 100% abused by the public.
      There needs to be a better balance.

      Exactly. The Bill of Rights was specifically put in place to protect the people from the state due to tyranny in Great Britain. Nowhere in the constitution can I find statements on law enforcement as a goal (except treason), nor can I find the term balance, nor compelling state interest. Judges have illegally legislated these things into existence. If the people want these things we will amend the constitution.

    How did the U.S. Supreme Court come to overlook the reason for the States demanding the 2nd, 4th, 5th, and 6th Amendments before they were willing to ratify the Constitution of the united States? The Founders had come from places or suffered here under corrupt officials sought to disarm, harm, use their words or lack of words against citizens.

      The police are the strong arm of the judicial system. Their job is to find and arrest some accused of a crime, someone who is commiting
      a crime. They are not supposed judge a person.
      That is for a judge and/or jury to decide.
      However, there are some bad apples in that barrel. They have been known to taint fellow officers, and while some people disagree
      on, some people beg to be slammed in the can by really
      showing their 6 if they get stopped for a traffic violation.
      Be polite, and courteous. If you refuse to take a breatalizer test, in some states, you will be arrested, taken to a hospital for a blood test, and at the very least, have your plans for that day ruined. If you want to argue, do it on the courtroom, not on the side of a road.
      Believe it or not, if you get stopped for drunk driving, reckless driving, or worse, that police officer stops you, it is for the safety of you, and everyone on that road.
      So he/she is serving you by stopping you, and protecting both you and other travelers simultaneously.
      A person is supposed to
      exercise ordinary care when operating any vehicle.
      Passengers in his/her vehicle? The driver must use extra ordinary care.
      I drive a car, and my rusty old pickup. I love to ride motorcycles too.
      It is not cool to drive anything on the roads at maniac speeds. In some emergencies, maybe. But not just for attention.

    Unlike some people here, I don't believe we should end qualified immunity. However, I do believe it should be changed from having to show proof to have it revoked, to having to show proof that it should be exercised. The reason being that there ARE cases where, without qualified immunity, officers would be discouraged from upholding the law for fear of the kind of malicious lawsuits that destroy a person's life, family, and career. Therefore, rather than eliminating the protection for all officers, keep it as an option while simultaneously removing it as a blanket.

    It ONLY exists when the cops are acting within the scope of their authority. This lawyer is absolutely wrong again. No judges don’t believe a cop won’t everything do anything wrong. That’s why when they do, qualified immunity doesn’t protect them. You absolutely know this as a lawyer and are choosing to hide it from your viewers.
    As far as the 1984 case, you forgot it was a rape suspect who tossed his gun in a public store and there was a fear children would find it. The only question asked was to find the gun for the imminent danger to our children. No other questions asked. People really get mad at the cops yet judges and prosecutors have ABSOLUTE immunity and are the ones who make the rules. The cops are literally following the rules in this case. They don’t follow them and people are upset but it they do follow them people are upset. Change the law but until then, the cops in this case obeyed the law while the suspected rapist exposed a child to picking up a gun. Great job as always misleading your viewers.

    I know for a fact cops will break the law for their own ends. I have seen it personally. Now, to be fair, I knew the folks I'm referring to, but they still did it. If you are supposed to uphold the laws of this country and the constitution, then you too should be held if not as much accountable, if not more than the average citizen.

    Just like judicially immunity qualified immunity is unconstitutional. But the courts have to support qualified immunity if they're going to support judicially immunity.
    No there's something to be said if there are operating within the boundaries of the Constitution but if they're not then the burden of proof needs to be on the defense to prove that they are entitled to qualified immunity that they are not violating the Constitution or the law when they behaved badly.

    That was my biggest hang up on Trump and ultimately why I didn’t vote at all. One was a cop who helps people in jail past their release dates for the money, and the other is trying to keep qualified immunity for all cops. When you think about it, qualified immunity is just admitting “I don’t understand the law” which is fine for a teacher or nurse, but not a cop.

    I went before judge Heinrich in Florida and he forced everyone to plead guilty,one guy pled not guilty and the judge made an example out of him

    Qualified immunity for law enforcement is not a real thing. The supreme Court does not have the power or authority to grant anything.
