    The police officer did not even grab his taser gun. He went straight for his real gun! Seriously Officer Nelson? WTH? 🤦‍♀️ if you’re that jumpy about somebody trying to get their ID out of their backpack after you demanded it and he verbally told you it was in his backpack before he reached for it …you might be in the wrong line of work.

      I lived in Logan UT for 14 years and it has always been bad. I finally had to leave the state . Logan PD use to follow me to and from work every day, it was just bad.

      It’s happen to me. Someone called and said I had a gun. Swat responded. Guns drawn over an air soft gun I was bringing into my apartment. 😂 I was grabbing some door dash when I walked outside and had a shotgun pointed at my face.

      No reason for qualified immunity to be applicable here. This was a clear violation of an established right that a reasonable person would know, which is sufficient for qualified immunity to be stripped. Now if the courts would apply the requirements correctly and stop giving free passes then qualified immunity wouldn't be an issue.

    I had a moment similar to this. I called the cops on my boss at the time because he wouldn't pay me. After they talked to both of us. They told me that I can't stay around there because of loitering laws. I said "I'm not planning on it but you guys still have my license. So I can't leave yet." We then had this same conversation about five times until one of those idiots gave it back and I was on my way.

    Pulling his gun after telling Mr. Heinz to “pull out your id.” Is a clear excessive use of force. This was followed by the officer ripping Travis’ wallet out of his hands. The officer quickly retreats with the stolen wallet to paw through… a clear 4th amendment violation.
    This is obviously not a Terry stop since the officer had the wallet in his hands and knew it was not a weapon before Travis took it back just prior to the officer taking the wallet to illegally search after threatening Travis with his loaded weapon!
    All this with no reasonable suspicion of a crime nor probable cause that a crime was committed… by Travis just sitting in his legally parked car!

      @@lkfishing192 problem is with calling 911: I've seen an audit where the auditor asked for a supervisor after beind detained illegally (did not have to ID). So he called 911 to ask for a supervisor and got fined for abusing the emergency number and thus had to ID for his ticket.

      @@brucemiller1696 Right? I am a nurse manager and part of my job is suspending employees without pay when there is even a slight suspicion of emotional or verbal abuse. Even if a patient says something because they don't like a nurse or a nursing assistant and I know that I still must suspend them until our investigation is complete. Obviously I understand the serious nature of abusing a patient but 99.9% of the time it is not abuse and rather related to the population I serve...those with dementia and serious mental health diagnoses. These guys flat out abuse, violate rights, and kill then get to lounge around on our tax dollars. Government holds everyone else accountable except themselves!

      I'd argue that Travis initially consented to the search, but as soon as he took his wallet back and said hold on a I want your details first he had revoked that consent, which he is entitled to do at any point.
      The officer then snatching it out from Travis is therefore an illegal search and seizure. Or basically what would amount to theft for anybody else.
      Admittedly they were already violating his 4th amendment rights with the illegal detainment due to no RAS of a crime. So what's another violation.
      Not to forget the brandishing of the weapon against a man who was doing exactly what they had just asked him to do. Very dangerous officer behavior.

After the fact they laughed and joked about it in the "office".She walked out of walmart without paying for two items which walmart took back from her before she left the building. The oinkers stopped her on the side of the road when she was walking home and immediately threw her up against the car or ground -I don't remember all the details exactly - twisted her arm so hard and so far up her back that it made an audible pop when it broke, and they laughed about it. Big tough f'n P.O.S oinker beat up a 70 year old dementia woman

    I called the office. I asked one question to the person who was working there. I asked if Utah was a stop and ID state and she said yes. I quickly informed her that its not. She responded "well I'm not an officer so I don't think I need to know". I asked why she was so quick to answer yes to my original question. She said "I just don't know". I finished the the conversation by stating that she'll have to answer that same question probably 100 times so now she knows the actual truth. I would actually suggest calling, they are actually picking up the phone right now.

And when they guy starts to follow his order the cop shoots him (I don't recall if he killed him or not) and justified it by saying he was moving his hand "near his belt". So he *literally* shot him for following his order.

    Yep. I tried to record police from my own private property when they were outside conducting an investigation of some kind.
    They immediately asked me who I am and why I’m filming. I said I’m just filming. They said we can’t hear you, we’ll come talk to you.
    I went inside my home right away
    They came to my door and knocked for a few minutes saying they couldn’t hear me and they wanna talk to me.
    All I know is don’t talk to the police so I locked my door and didn’t say a word.
    I am terrified of police because I see more and more that they seem to be able to get away with whatever they want, including murder.

The focus is to get a 5 year old video taken down. It is amazing that your department misapplies the ID law and continues to violate citizen's rights. You can't demand ID willy nilly.       76-8-301.5
      This is what they were trying to charge him with, this law not the one you quoted.
      A person is guilty of failure to disclose identity if during the period of time that the person is lawfully subjected to a stopped as described in section 77 -7- 15
      Yes your defense is 77 - 7 - 15 but they will charge you with a misdemeanor of violating 76 - 8 - 301.5
      There was no legal stop. There is a term that nobody uses but they should be using it frequently.
      Custodial arrest
      If you are detained then you are under custodial arrest and you need to abide by the Constitution assert your fifth amendment right to refuse to incriminate yourself, your Fourth amendment right not to be searched, and your First amendment right to speak if you're stupid enough to do that.
      The 5/19/2019 revision of 77 - 7 - 15 is quite draconian
      Now you have to give the police officer your name address date of birth and an explanation of your actions and if you don't do that you can be arrested on 76
      Is 77 - 7 - 15 constitutional???? No, it orders citizens to give up fifth amendment rights to prevent self incrimination.

    I've been following Travis for a while now but I've never seen this older video. I'm amazed by the fact that Travis is unfazed by a cop drawing his weapon. I have all new respect for Mr. Hinze Travis is the king.

    James, you remind me of the late great Sheriff Buford 'The Bull' Pusser; he was so passionate about the Constitution and cleaning up the corruption in McNairy County, Tennessee, that they tried to kill him, but they did succeed in murdering his wife, but that didn't stop him! There was even a movie about his crime-fighting life called 'Walking Tall' in 1973. Be safe, James; We, the People' support you!

    The police officer is so poorly trained. The fact that he demanded the civilian to reach in his bag and then as the civilian did what he was told the police officer drew out his gun? Incredibly disturbing behavior from a man being trusted and supported by the public to carry a loaded weapon.
    It is even more surprising to hear the county sheriff, who is an elected official, literally unwilling to look at these issues at face value. The sheriff literally gets defensive when questioned about the training of his deputies. He is even more defensive when offered help?!?!
    My opinion: The officer that was called to go check on the car or person in question should have asked the caller or the officer. Was the man committing a crime? What do you see that he is doing wrong? Yes, the officer is in the wrong but the officers and elected officials are only resemblances of the type of people we hire them to protect. There is a huge lack of trust in the public space and there is more work to be done then just the officers.

    Thank you James for taking the story of Cache Valley on a bit of a historical interlude. Showing Cache Valley has a problem dating at least 5 years back shows it isn't just one bad apple or an isolated incident...2 favorite excuses of little piggies everywhere!

    Travis has already satisfied the concerns of the good citizens inquiring about his well-being as conveyed to him by the first officer, also asking him if everything is OK! That should have been the end of the inquiry, as Travis is just fine!
