That's it? You ask: 'do you see evidence of genocide' and let him get away with his answer without asking him, whether he is basing his beliefs on the facts, that are so readily available? Or whether the definition of genocide proffered by Kirby is what they base their assessment on (wanton shooting, even for which there seems to be more than enough video evidence). Is it wilful ignorance on Kirby's behalf? Or yours? Where is your journalistic fervour? MSNBC is coming close to abetting the gaslighting being perpetrated by Kirby. Or is the his only way, that you will still have access to the likes of Kirby (if so, it is not worth it,And if he were hones, he should be clamouring to come to you!).
They aren't coming close to it, what he said is objectively disinformation and he has plenty of advisors and briefings, he is not ignorant of any of the relevant facts. This is also not the first time. He has previously claimed that the state department has investigated seriously and found no evidence of violations of international humanitarian law.
To be clear, Israel has violated international humanitarian law, that's not an opinion. This is a case where in law a presumption operates, but only in strictly legal procedural terms. That is to say, if someone is seen stabbing someone to death, admits to it, and there is a lot of physical evidence as well as medical evidence that the stabbing was the proximal cause of death, there is still a legal presumption of innocence because it has not yet moved to the point where the determination has been made in the courts.
So how can I say they have with certainty? A) They've attacked protected sites, where the burden of proof is on the attacker to demonstrate that those sites had lost their protected status, which Israel has not done; B) They've engaged in collective punishment in a manner that would render it effectively impossible to dispute. There's actually a much longer list you could go into, but as you go down that list it can become relatively more disputable.
But the evidence of genocide is very clear and abundant, it was considered by the ICJ, the special rapporteur, and has been evaluated by experts in international humanitarian law including previous genocide cases. So to say there is no evidence, and then to mischaracterise genocide. That's just disinformation. There's no question about that.
And they straight up let him air that unchallenged.

Definition of Genocide
In 1948, the United Nations Genocide Convention defined genocide as any of five "acts committed with intent to destroy, in whole or in part, a national, ethnical, racial or religious group". These five acts were: killing members of the group, causing them serious bodily or mental harm, imposing living conditions intended to destroy the group, preventing births, and forcibly transferring children out of the group. Victims are targeted because of their real or perceived membership of a group, not randomly.
After reading this I'd have to say that Mr Kirby is erroneous in his thinking .

As horrific as it is, these victims are victims of a war and not deliberately targeted (for belonging to a group). It was Hamas' stated intention to fight as long as possible in order to cause as many Palestinian casualties as possible in order to use them as a propaganda tool. If the IDF had deliberately targeted them, many more would have died. (That said, the figure is Hamas's, but certainly very high and tragic). Hamas etc killed ~1200 people a day, with small arms, and sent 15,000+ rockets, which only didn't cause more casualties because Israel is trying to protect its people. The IDF killed about 165 people a day - including 1/3 Hamas fighters, so 100+ people. And the IDF has all the weapons there are. These figures show the behaviour and the difference in intent. The IDF used calls, leaflets, escape routes, roof knocking, etc. to protect civilians as much as possible. There's not much more one can do in an urban war. And it's still war.

War crimes for sure, but not genocide. Genocide as a term was created to specifically refer to the Holocaust, and as such has to meet a very high bar. I have no problem saying that what is happening in Gaza is less abhorent than the holocaust and every other event that has met the bar of genocide. What is happening in Gaza is a war with war crimes occurring.
