The laws are 'iffy' about this. ( sorry, no short answer and obvious retort is 'the laws are shit') This particular case is regarding the application powers used by Border Force, which comprises Australian Customs. Without going into detail, the Attorney General Department (federal powers) can restrict what firearms comes into the country for a multitude of reasons, in this case 'appearances' Once the rifles gets into the country, legality depends on which of the 7 states and territories the rifle will be registered. Although broadly assumed by foreigners as 'Australian Gun Laws' Gun laws are strictly a state responsibility under the constitution BUT were brought in line under a non-binding 'national firearms agreement' implemented in 1997. Note the use of the term 'Agreement' Nothing in the NFA mentions 'Appearances' and the 'appearance' clause used by Border Force to recall these rifles is because the State of New South Wales added it to their firearms legislation in a unchallenged case (to the best of my knowledge) of government over-reach that went above and beyond the NFA, which Border Force has assumed as the default standard nation wide. Conversely, if this rifle circumvented Customs and was MADE IN AUSTRALIA, Border Force would have ZERO say and it would be up to the States to determine if a licensed shooter could own one based on their states interpretation of the NFA.
