    If i aleady paid a VAT before GST applicable i.e. 1st July 2017, so i need to know that whether VAT can be adjusted or not ? E.g. I paid 1% VAT and actual GST is 12%, Is there any possibility GST would become 12% - 1% = 11% on agreement value in my case or will it remain same i.e. 12%?

    I have purchased under construction flat where 1st installment is paid 20% plus 12%GST in January 2019,-- 2nd installment is paid 40% in April 2019 plus 12%GST....
    Nw 3rd and final installment I will be paying after occupancy certificate i.e remaining 40%.
    1) So do I have to pay GST on the final payment after obtaining occupancy certificate?
    2) what ever GST I paid in 1st & 2nd installment, am I applicable to claim ITC?

    Sir i have a small doubt that new gst rate from 1st april 2019 is 5%,, but under construction which started in old taxation..how it will be reflect on new rule & what is the difference between affordable housing gst rate & normal housing gst rate ..

      In theory, the builder must pass on GST benefits to private buyers by consummate reduction in prices only. However many builders don't follows this practice. Only properties billed to companies can avail tax benefits as the taxes through invoice are availed by the company client making the purchase through monthly GSTR-3B and GSTR-1 returns.
      For private buyers, on most occasions builders will claim that taxes have been paid on behalf of the customer to GST as per norms, but they can seldom put forward proof of gst payment for each specific Bill No. in these cases. Non-payment of GST charges after collecting the same from a customer can be taken up with GST council Anti-Profiteering wing.
      To answer your question in short, taxes must be followed as per the prevailing rules at the time of invoice. If the property follows a stage-wise or milestone-based demand/invoice system, the rule prevailing at the date of each invoice must be considered the GST bracket for that invoice. For example:
      Pre 2017: 6% (Service charge and VAT)
      2017-2019: 12% (GST)
      2019 onward: 5% (GST)
      Completed project: 0 GST

    i have one query regarding input tax Credit to ne given by builder to buyer
    i have entered intto builder buyer agreement in 2016 fir residential project in greater noida west.the size of the flat us 1365 sq ft .
    after GST Was implimented in july 2017 onward builder is charging 12% GST on Basic cost and on PLC . Buyer bas not given any ITC to me. And buyer has raised final demand but in this demand also he has chrged 12% GST on Bsic cost ,12% on PLC, and 18% on services like electricity connection charges,DG set charges,etc.
    Builder bas not given any benefits or ITC .And on my enquery ye bas replied that ye opted to remain under old GST regime.Wo far i have paid or will be paying Rs- 2.5 Lak . Sir how much ITC am i eligible .Also will the byuer will get ITC benefits for 18% GST paid fir services and 12% GST charged fir PLC .

    Now news are around that GST for under construction flat will come under 5% ... I have done the agreement and registration and disbursement has still not started .... will i also get the benefit of 5% slab ?.... Please reply..

    What dies exactly mean by " benefit of input credit to be transferred to buyer " ? What will be benefit of buyer in this ? Will he get refund of paid gst ?
