There is a story of the Alter Rebbe in Hayom Yom that when he saw people sinning he would rebuke them. Also, in the first chapter of Tanya it says that a person who even commits a Rabbinical sin is wicked, but a person who he himself doesn't sin but has the opportunity to prevent another Jew from sinning and fails to do so, the Alter Rebbe calls that person a Rasha.
the alter rebbe is quoting that in the first chapter in Tanya and the entire purpose is give possible explanations for what a Beninei not to call people rishaim
Learn Perek 32 Tanya, where he talks about rebuke and when it’s appropriate. He says there that even the rabbinical Mitzva to “hate” someone is virtually never applicable, and EVEN THEN there’s a chiyuv to “love” that person. When the alter rebbe is referring to Rasha, tzadik, and beinoni, he’s only talking about it in the context of the battle between the souls. According to the Tanya, many gedolei hador are rashaim. That’s not to say they are wicked people
Ziggy Death If no one has ever been to Gehinom or never will then why should we observe the Torah? Then there is no place to punish the sinners in the spiritual world?
If you need an ulterior motive to follow Torah, you are not one of us. As our sages teach, Gehinom is merely a temporary place to cleanse the soul before entering the World to Come. If you go through there, you are guaranteed to experience the bliss of the World to Come. Some will not have to experience any of it to correct themselves. Still others will not experience any of this, because their souls will be doomed to expire. These are those that do not believe in the Resurrection. Just as they believed, they will not experience any of it, as the sages teach.
Gehinom and Gan Eden are all about fairness. The sages ask, "What is the worst place on earth?" The answer is "a fire pit" (Gehenom); and "what is the best place on earth?" and the answer is "a garden". Just as a person cannot sin without both body and soul, the person cannot be judged without body and soul together, so entrance into either of these places is contingent upon the soul being back together with the body, which happens at the time of the Resurrection of the Dead. Without this, it would be unfair to judge the dead. In addition, it would be unfair for one to suffer a greater amount of time just being they were born in a previous generation. Do you see now?

There still is Gehinom, it is very much a real place that is mentioned many times throughout Tanach.
