    Thank you for all that you do, many times you have made me calm from a lot of Fear and Stress by reducing the power over the sad job of Social Security people literally scaring me to the point of breakdown...Have a Fantastic Holiday!

    Would the overdraft fee you pay at the bank be the same thing as a garnishment ? Especially on social security only funds ?

    I have a summons for a judgement on may 11, 2022. I will not appear to contest the lawsuit since I owe the money. What I would like to know is if I am called in to fill out a summary of my assets, will someone demand to do a walk-thru to see if am hiding possible assets in my house, such as a $2000 OLED TV that I recently purchased with my last stimulus check. I would hide it in the back of my SUV. Will demand me to open the tailgate to check for hidden assets? Or, do I hurry up and sell the TV? I payed cash for the set!

      No one is going to do a "walk-thru" of your house to see any assets. States have laws that protect equity certain amounts of personal property. A judgment creditor in any event would never be interested in someone's 'TV no matter what they paid for it. As an aside people always seem to have an inflated idea of what their assets are worth. I guess its a natural tendency. HELPS has several videos that discuss the issue of judgment creditors not going after a person's personal property. I say this having filed around 30,000 bankruptcies and 42 years of practice in this area. Eric HELPS p.s HELPS also assist our clients if there are forms that need to be filled out.

    If I have my car as calaterial for one Main Finacial.. In Ky ill they take it? Or sue me..? I can't pay them. I thought I could but I cant. THEY PAID OFF MY ONE LOAN AND GAVR ME SOME CASH AND NOW I OWE OVER 10,000.. I was better off staying with my original loan which was only 2,500 and the payment. I Have had 2 strokes and don't make good decisions sonetimes. Plus stage 3 kidney failure.. I'm trying to survive.

    In many instances on personal property, depending on the type of property it is, you can’t clearly determine whose property it is. If your married and your being sued by a credit card company, which is an unsecured debt. And only one spouse is named on the judgment the creditor can’t prove who’s property it really is. So if the husband is being sued and the creditor comes after say..a lawn tractor and other property maintenance equipment that doesn’t have any form of registration proving who owns it, the wife can say it belongs to her. So long as she isn’t named on the judgment. So it’s always wise to get credit cards in individual names and accounts. I was once advised to keep your unsecured debts in separate names and keep your checking and savings accounts in both names In the case of a married individual. That way in the case of banking accounts, it’s hard for a creditor to prove who’s money it really is. Your spouse is entitled to it as well. This doesn’t apply to anyone you share an account with that person is not your spouse.

      As a practical matter it is virtually never the practice of an unsecured judgment creditor to go after personal property. For a lot of different reasons.
