0:17 You omitted the third question: "Does the invention is useful?"
You’re right, utility is the third test, but it’s rarely an issue. In 34 years of practicing patent law I’ve never seen a patent application fail for lack of utility (usefulness). It’s possible for the patent office to reject an application based on utility, but it’s quite rare.
@@PatentToronto I agree, "utility" is pretty much everything as long as it's not perpetual motion, free energy or the likes.
@@PatentToronto Respected Sir/Mam, Can i patent a idea only, which is fully novel, but involve with very costly field, thats why by me as a individual single person cannot make any prototype construction _____ ••• There is no such prototype o/r model o/r simulated o/r Trial Error method by Thinking-owner (single person).
••• But thiking-owner is 100% sure that “If R&D team impliment the idea (after acceptence patent publish) _ definately then particular field which is involve with this idea.... The particular field will develop worlwide for whole Cosmopolitan.
I can tell you about inventions that have absolut not real scientific proven use and they have been sell by millions like the fisher spinners or the NB bracelets that give you balanced
Can make plz a video on patentability search, validity/invalidity, FTO search, landscape search.
I will do that. Thanks for your input.
2:39 Is there some "reputable patent attorney" who almost exclusively use Google Patent and USPTO tools for patent search?
Many patent agents use Google’s patent search tool. I use it first, but may also use additional databases. The tool is quite comprehensive and, if you’re good at searching and spend the time it’s most likely all you would need for a good search.
@@PatentToronto What kind of tool or database would you use next? For what kind of situation? I'm guessing theses database are not free isn't?
I search a thing for what I am thinking. But there are more than 10000 pages for that product. So how can I reach that product which am I really think about it? Because it is impossible to read the detail of that 10000 pages for me as well as any person.
How to sell a patent?
In this UV toothbrush example. I would not suggest to invest in patent search because UV will be harmful to gums and living cells in your mouth.
Therefor, a patent on a non-sellable product is a waste of ressources.
So, before investing time in a patent search, I would suggest to make sure the invention have a market potential.
This preliminary market potential should include a scientific evaluation (find someone in the field of invention if you cannot do it yourself).
I guess this was just a random example to explain the patent searching.
I've put a THUMBS UP especially because this type of content is very scarce on TH-cam.
Thank you Elias for sharing!
Good point. It was a hypothetical example.
@@PatentToronto I'm glad you understood my bad English (I'm a french Canadian!)
I've subscribed to your channel. I find it really insightful.
Thank you for sharing your long experience. This is TH-cam at it's best.
So let’s say that I have an invention and it’s not patent but to make it you need skills in carpenter or blacksmith etc that you don’t have what’s the next move to do ? Cause if I talk to some one that has the knowledge to make it he can steal the idea 💡
You need to have people sign a non-disclosure agreement (NDA - also called a confidentiality agreement). Make sure they sign the agreement before revealing details of your invention. I have a video on NDAs and a free online course on them. Check out the description of this video for more.
I won’t be typing anything under the name Google!
Why not?
Duckduckgo is better.
