PRIME MINISTER- QUALIFICATION ,POWERS AND FUNCTIONS|M LAXMIKANT AND NCERT SERIES BY

In this lecture by Hansraj Sir, we will learn about the qualifications, powers, and functions of the Prime Minister of India.
1. Qualifications of the Prime Minister
The Constitution does not lay down specific qualifications for the Prime Minister. However, the individual must satisfy the following:
Member of Parliament: Must be a member of either House of Parliament (Lok Sabha or Rajya Sabha). If not, they must get elected to either House within 6 months of appointment under Article 75(5).
Basic qualifications under Article 84:
Must be a citizen of India.
Must have attained the age of 25 years for the Lok Sabha or 30 years for the Rajya Sabha.
Must not hold any office of profit under the government of India or any state.
2. Powers of the Prime Minister
The Prime Minister enjoys wide-ranging powers in the parliamentary system, categorized as follows:
Executive Powers:
Heads the Council of Ministers and decides its composition and functions.
Allocates portfolios to ministers and can recommend their resignation or dismissal to the President.
Acts as a link between the President and the Cabinet.
Legislative Powers:
Advises the President on summoning and proroguing sessions of Parliament and dissolving the Lok Sabha.
Plays a leading role in shaping legislative policies and introducing bills.
Acts as the Leader of the House in the Lok Sabha or Rajya Sabha.
Advisory Powers:
Advises the President in the appointment of key officials like Governors, Judges of the Supreme Court and High Courts, and Election Commissioners.
Emergency Powers:
Plays a critical role in the declaration and implementation of emergency provisions under Articles 352, 356, and 360.
3. Functions of the Prime Minister
Policy Making: Plays a central role in formulating national policies and ensuring their implementation.
Coordination: Acts as a coordinator among various ministries and ensures smooth functioning of the government.
International Representation: Represents India in global forums and plays a key role in shaping foreign policy.
Crisis Management: Leads the nation in times of political, social, or economic crises.
Parliamentary Leadership: Guides legislative business, addresses parliamentary debates, and defends government policies.
In conclusion, the Prime Minister of India is the fulcrum of the executive machinery, with responsibilities extending to all realms of governance, including legislative, executive, and advisory functions. Their leadership defines the direction of the government and the nation.
