      Hmmmm.... I haven’t come across a situation like that before where someone else has a Content ID claim on someone else’s song? Is this something you’ve seen?

    Just discovered this video. I sometimes (not always) get content ID claims, I usually dispute it as fair use and say it’s a cover song. 90% of the time the claim is removed within 30 days but sometimes the claim stands. But as I am not monetised yet it’s not a big deal as the video remains public. But I am now working on rescoring film scenes and playing my covers over them and they get content ID claimed. Again doing this for fun atm so I am perfectly fine with it

      Yeah, cover songs are pretty harmless. You’ll get copyright claims but those don’t impact your channel - they just mean any revenue is sent to the original artist.

      I’m not quite sure what you’re asking sorry. Ads don’t cover any video content - they are inserted in to the video so won’t cover anything. You will need to cut out or replace any copyrighted songs.

    Anime opening covers don't get copyright complications. When Narmak made a Spongebob anime opening compilation, he used the ROMIX cover for opening 1 instead of the original song because of copyright

      TH-cam kind of gave up on this I’m afraid. There’s no way to know this info now without just uploading and seeing what happens.

      @@PeteJohnsMusic Thank you for the quick reply, Pete. So, obviously, the only thing the algorithm is running checks on is the words, right? Wonder if I could make an ultra-basic video with a song title and writer info in order to more quickly ascertain what provisions the copyrighters allow.
      Sure would be a heck of lot easier than producing an entire recording, only to find out they don't allow for covers. 😄

    hello, thanks for the great info! but I still have some questions to ask, would very much appreciate if you could help out!
    1. How about instrumental covers that is made from scratch without vocal?
    For example, if I made an instrument only cover of Nirvana's 'Come as you are' from scratch with some different arrangement, will it be eligible for revenue sharing/monetized?
    2. How about songs that aren't listed in th-cam.com/users/music_policies because they are recently released?
    3. The link to check these policies are gonna be removed soon, what should we do then?

      Hey there. I think the simplest advice is to avoid using other people’s music at all, however cover songs are generally okay and you will get revenue sharing at best, and often just have the revenue go to the original artist. A few will block even covers at times - it’s almost impossible to know.
      This relates to your other questions about newer songs and the policy page going away / I think the volume of music has become so great that it is impossible for anyone to keep up with a list like this.

    Thanks for the video! I have a question! So our church will do live streaming and we will perform a song with copy rights. So we edited the song lyrics and recorded the song in our voice. And we used an instrumental version of the song. Do you think playing the song during live streaming would violate your copyright policy? It's a tremendous risk to do while streaming without knowing whether ID content will shut us down or not. Since the TH-cam Music Policies page is no longer working, there is no way to check whether the song can be covered or not. What should we do ??? 😱😱😱

      Hey there. I have been testing this for many months this now and cover songs are very low risk. Most of the time it will result in a copyright claim which won’t result in any action against the channel or blocking of content. At worst it may block the replay of the video but I haven’t come across that even once and have been streaming cover songs a lot.

      It’s very rare for copyright strikes to be the result unless you use the actual original audio. Usually just copyright claims which shouldn’t impact your channel. More here - th-cam.com/video/IC_OpiTEKOc/w-d-xo.html

    What if various versions of a song has various policies? I want to cover "I'll do my crying in the rain". The original Everly Brothers Version says "not available". Some a-ha versions says "blocked in 197 countries". And one live a-ha version says "viewable worldwide".
    This is a common problem with many songs. What should I do? How does youtube decide which original version your cover song is based on? I also see other people's covers on youtube despite that they are supposed to be blocked (though I heard that the fact they are up doesn't mean they are approved by the copyright holder, right?)
    And what if there is no information at all about a song?
    Can I ask youtube directly about this (didn't find a direct way to email about it).
    Please clarify this for us! I and many more would be utterly grateful!

      Really good questions Chris, and I wish I had better answers for you.
      I think the issue is that try e system is still in its infancy and definitely has its flaws.
      Not the answer you will want, but it is seriously hit and miss. I have released covers that have just never been matched, while other are matched literally minutes after I release. I had a similar issue where my song was matched with a live version not even owned by the original artist.
      My advice is to do a rough version of what you want to release and upload it as unlisted. Then give it a few days. If it’s not instantly claimed you will probably be okay. However there is always a chance it will be claimed at a random time in the future.
      It sucks I know and I wish I could give you a more definitive answer.

      Thanks for your reply! TH-cam has a contact page for copyright claims but where can I ask them about this? Using the normal feedback function? This must be a common issue so they should have a dedicated page/contact to answer this.
      Like you, when I played a cover live that was kind of similiar to the original, it was detected by TH-cam. But other covers that sound almost identical to the original have not been detected. Confusing. Well, I guess I have to take the risk of experimenting until I get my first copyright strike....

      Yes, I think everything is just run through the dispute process. Even their own videos are quite vague in places.
      The good news is that copyright strikes are actually really hard to get, especially for covers. Copyright claims are annoying, but don’t risk your channel’s status.

    Great explanation Pete. I did some live performed cover songs in the past and sometimes I got a copyright strike. These videos have only a couple hundred views so I can laugh about it. Got some news, I bought an iPhone 6s with 64GB last week and it’s awesome. Finally I can use the Alchemy synth inside GarageBand! My iPhone 5s didn’t support it, but I’m happy now.     Lots of good information there. Thanks a bunch. How does a composer go about 'taking control' of their music on TH-cam or get on that list? I've run into this a few times and when I've informed the video owner that I write the music, they've been quite good about giving me credit. About every 6 months I do a search & find someone else who has uploaded a video of my music and listed it a traditional, which is my main concern, not necessarily the money aspect.

      Thanks Judi. Yes, I did think about this when I made the video and the honest answer is that I don’t actually know! I want to find out though so will do some more research.
      I assume it is related to the distribution, s most of the songs have their publishing company listed. I haven’t explored this much because it hasn’t been an issue for me (yet) and I don’t want to get my own music flagged on my own channel somehow! 😊

    Question. I am a fitness instructor. Obviously the gyms are closed. I am Facebook friends with many of the members that come to my classes. I would like to do a TH-cam class video with me teaching in my garage and be able to share it with them. I'm struggling finding royalty free music. I would like to not work about the music I'm using. I am NOT doing this for money. This is all temporary until things get back to normal. Any suggestions?

      Hi there. You may be able to find instrumentals as backing tracks, however this will still be considered a cover version of the original song for copyright purposes.

      Hey there. You’ll need to search for the song you are looking for. If it is not there, then there’s no current policy attached to that song. You still need to be careful as the artist or producer may still choose to claim.

    1. If I release a cover version via DistroKid, would that cover me to use that tune in my own TH-cam video?
    2. I have a song where I have re-recorded someone else’s music but changed the words completely. Is this allowed as a cover?

      1. The DistroKid license is for audio distribution only. Your video would still be subject to the same standard copyright terms
      2. So, yes this is probably still a cover if it’s using the melody, as this is the core of the composer license.

      Hi there. If the song is listed as "eligible for revenue sharing" for covers, you will still get a claim for Content ID, but it means the video won't be blocked or taken down. Is this what has happened?

      You pretty much just need to make your cover and then upload it as unlisted or private to see if it will be claimed or not. It’s not ideal but just became too much to be managed.

      Parodies are a pretty complicated. You can parody a song but if you just change the lyrics without any parody elements it may not qualify as a “parody”.

      Unfortunately it has just become Tom complex. I recommend uploading any cover songs as unlisted videos first and see if a claim is placed. Usually you will be fine.

      If it is eligible for revenue sharing and your TH-cam channel is part of the partner program, then you can monetise your videos and earn part of the revenue.

    Always good to know these things when it comes to copyright 👍 I had a copyright strike or warning once even though the tune came from editing software and was fine to use, one year or so later it wasn't. That's the problem, artists or owners of the music can change their mind later and end up with a great whacking share of the profits if that video or thousands of videos that are popular and using their tune. That's what I have come to realize or as it seems from what I've read.

      Hey there. If it’s your own work and incorrectly flagged as a cover you can. If the claim is for a song that you actually covered, then no you can’t.

    So what actually counts as a cover? Is it a cover if it uses the original song as a backing and has an instrument played by you over the top? Or does that make it the original song and not a cover? Help? :) Thanks

      Hey there. Yes, a cover is your own music but playing music written by others. Using actual recordings from at artist is a form of sampling which is considered using the artist’s original material and more likely to be blocked.
      Using a backing track created by someone else is a grey area somewhere in between and could go either way, depending how close the backing track is to the original song.

    Is there a possibility of them watching my private video?

    Where can i ask about a specific question not found anywhere on your channel? Or maybe the answer is right in front of me. How to fade in a recording. I know of the fadeout feature at the end , but about the beginning or middle ?

      Hey David. So you’re right, I haven’t specifically talked about how to fade I’m tracks, but I do have a video about fading out tracks, so you can use this same method (automation) and use it in reverse.

    Hey Pete how does it work when the song you search for on TH-cam music policies shows up, but maybe it’s in a weird titling or a live version or something ...for example I searched Despacito but other Despacitos came up. Then I type in Luis Fonsi and many of his songs do show up, as not coverable. But that song doesn’t quite show up...curious what your thoughts are! Also when looking up the Cranberries, many Cranberries songs are uncoverable, but Zombie doesn't show up except as live versions or remixes, etc. Confusing! I want to put up some of these covers if possible. 😁

      It’s a tough one these days. In my experience pretty much all cover songs are okay. I might talk about this in tomorrow’s live show.

      Hey Steve. I haven’t checked this specifically, but you can release covers of pretty much any song using DistorKid, b ur you do need to pay $1 per month (per song) for them to manage the royalties.

      Hey Gwen. Depends where you intend to release it. On TH-cam, the copyright is all managed by their Content ID system. If you want to release it as a song to streaming platforms, you’ll need to ensure a license is obtained, which can usually be managed by the distributor.

      Monetisation won’t affect whether it gets a copyright claim or not. Only difference is that monetised videos will share their revenue with the original artist.

    Hi Pete, what happens in case I want to do a remix of a certain song where I would have the original vocal stems included in the original master as part of the remix? Am I allowed to use those stems as part of the remix without asking for permission? Thank you.

      Hey there. You would need permission form the original artist. It is always high risk to use original audio, though on TH-cam it will usually only result in a copyright claim or potentially a block.

      You can cover and upload pretty much any song. It will get a copyright claim but very few artists choose to block cover songs so you should be fine. I play covers every week on my Happy Hour shows.

    So if I just change the words it would be OK? That would be the main thing I would cover, aside from the fact that I don’t really have the skill to do The music/instrumental part that close to the original anyway.

      It really depends on how close you perform it to the original, and therefore how likely the TH-cam algorithm is to pick it up.
      Just choose one of the songs on the list that allows you to cover it and you’ll be fine.

      If you plan to release the song to sell or stream on online platforms you will need to use a distributor who will manage the royalties with the songwriter on your behalf. th-cam.com/video/zMn-i30Xslk/w-d-xo.html
      For TH-cam, the Content ID system will manage any royalties and other requirements.

      Hey there. Yes, generally this means there is no specific Content ID for the song. It can still be manually claimed by the original producer later but is unlikely to be subject to an automatic Content ID claim. Unfortunately there are no guarantees with any of this though.

    Pete, I’ve just opened up TH-cam and something popped up about ‘article 13’...do you know much about this? Apparently, it’s a legislation in progress that’s will limit the content being viewed and created throughout the EU. Copyrights etc. You (the creator) will have to prove you own everything you upload and share!

    For songs that say "This song is not available for use in your TH-cam videos. If you use this song, your video may be blocked or muted", I still see SO many covers of them. Would you say they can get away with it as long as they decided not to monetize it? I want to cover something that's marked as not available, but I have no intention of monetizing. Thoughts?

      I’ve found that cover versions seem to be treated more lightly in recent years. They seem to be focusing on when the actual music is being used and not blocking cover versions. I’ve been doing. Live show playing 10+ cover songs each week and have yet to have a video blocked at all.

      This is a tricky one. The whole concept of “fair use” is a confusing one, and it’s hard to know what you can and can’t do. It’s unlikely that a “how to play” video will get flagged, however the content ID system is pretty accurate, so there’s a chance it will get picked up.

But also, because things are broken down, I think because it can be deemed as educational it’s not really a copyright issue? I have no idea, I’m just spit-balling. But good to know this stuff.

      Yeah, given how many of gear type of videos are out there, I’m thinking the publishers are choosing to leave this alone. After all, it’s pretty much promoting their music and no one is going to say “I think I’ll listen to someone slowly playing the riffs from that song instead of the actual version”. 😄

    And what if id doesn't find song that I'd like to cover? I wanted to record drum cover of "jumpsuit" by 21 pilots and it doesn't pop up on the list. It's a very popular song, so it should have been on the list :/

      Good question. I haven’t personally come across popular songs that aren’t on the list. The best option is to do a rough version and upload it as an unlisted video and see if it gets flagged.

      Yes, 100%. If you aren't going to monetise the video, then the only risk is getting a "copyright strike" which is very rare, and if they are not on the list, very unlikely. So yes, upload a version of it and see if it gets flagged.

      All the same copyright rules apply, it just means you don’t have to worry about any monetisation sharing or copyright claims. As long as you avoid copyright strikes (using large amounts of the original recordings) and stick to cover songs, you’ll be fine.

      When you release a cover song you get to “share” the revenue with the songwriter. If you have a monetised YT channel you won’t make as much as the same plays on an original song, but you will make some revenue

      Hey there my friend. Yes, it gets a little murky when it comes to using the original instrumental as a backing track and the answer to this is bot super clear.
      Technically using any part of the original recording comes under the “using the recording” as opposed to a cover, but in my experience most artists that have their license as allowing covers are pretty cool with this, so you’ll unlikely run in to trouble. You may get a copyright claim, it unlikely to get a strike or takedown notice.

    I wonder why I didn't find this vid 5 years ago (at this typing) when it was posted. That music-policy link in the description box is sadly outdated now. I got a CR strike for covering Bryan Adams' "Hey Honey, I'm Packin' You In," so I took down all my remaining vids as damage control. A music database telling me which artists allow their fans to sing covers, I didn't know it existed before. It should be brought back!

If you release a cover song you need to ensure royalties are paid to the original songwriter, however if you release a cover on TH-cam, you don’t need to do anything specific, however are subject to whatever the original rights holder chooses to do. (Revenue sharing, blocking, etc)

So we have covered doing cover songs of copyrighted material now let me ask what happens if you write an original song and release it, is it automatically copyrighted to you or do you have to apply for copyright protection so someone else couldn't steal your song.?

      So this one is a bit complex. The short answer is that as soon as you publish a song, or even write one, it’s our song and you own the copyright. You can register the song with your country’s performing rights group (BMI for instance) but this is more about receiving revenue from your song being played.
      I’m far from an expert however and tend to hit release my music and hope that people play nice. Might be naive, but I have the unique advantage of time stamped TH-cam videos showing me writing and recording my songs. 😊

    It's just confusing. People in bars are covering other artists songs and making money, and the artist don't care at all. Why? Because THEY did covers before THEY made it big. So I am seeing "You can't use this song in TH-cam videos", which means you can't use that song as is- but that's not saying you can't cover it. It is saying you can't use the artists recorded version in your video. At least, that's the way it should be. Covering a song hurts nobody.

      It is indeed confusing and the rights management rules and regulations have not caught up with the digital age very well in my opinion.
      In the past, when songs were performed by other people and they were members of performing rights organisations, they would submit what songs they played in public and then the original songwriters were paid royalties. I believe this is still the case today but I’m far from an expert.
      When I cover a song on TH-cam and it is claimed, meaning all the revenue from and advertising on the video is sent back to the original copyright holder, I’m not super worried, but it is a different model because unlike a live performer who is still getting paid, I receive no compensation as the player of a cover.
      Worse is copyright owners who actually block any covers of their songs. If I cover “Hotel California”, his is likely to only have a positive impact on The Eagles. People who know and l ow the tune aren’t going to say “well, I was going to buy the Eagles Greatest Hits but now I don’t have to - I’ll just listen to Pete’s cover for free”. If anything, they will say “cool song - let me check out the original on Spotify”.
      Some are still stuck in the old way of thinking, which is very short term and instant profit focused. Music juts doesn’t work that way any more and thankfully most newer artists realise this and treat covers as a compliment, not a threat. Rant over! 😄

      This particular channel hasn't been going too long and that was the 1st time i have done a cover of blackbird and within an hour I get a claim. So I disputed it coz the artist wasn't Paul McCartney, he recently took Sony to court to get his music back and won so Sony shouldn't have a right to claim his music, also it said the artist was some woman so that's another problem is other artist who have also done covers are taking advantage of this system also.

      Yeah. We are having the same issue with legally licensed and free to use loops. As soon as someone (anyone) uses them in a song and adds Content ID, they then “own” the copyright as far as the Content ID system is concerned.

      Yup. Unfortunately there were just too many songs so TH-cam pulled the plug. Now you just need to create your cover and upload, then see what happens! Just make sure you upload as private or unlisted first to check before you release.
