    @8.10 "think long and hard really before you starting a tribunal, but if you do start one, good luck" sounds neither encouraging nor uplifting, but instead rather dissuasive and helpless, and that from a profession which is there to assist in such cases. why not instead try to empower employees and support them in their struggles in a system where, while odds may be set against them, there will be opportunities for a party which believes in its cause.

    I have submitted my case and have a first hearing date. I do not know what to expect. Would it be online or do I need to go for hearing?

    I’m a victim of false self employment in construction, I verbally spoke to my boss 2weeks ago about it, I want to take it to tribunal, I spoke to Acas and didn’t get any help just told to put it in writing to give to him? He admits he’s doing wrong but pretty much doesn’t care, I can’t seem to get any advice or help and have absolutely no idea about how to go about this, I’ve called a few solicitors but I can’t afford to pay £250-£500 for a 1 hour phone conversation and they don’t even tell you what you get out of that conversation, is there anyone that offers a no win no fee sort of thing with these types of cases?

    mine is rather simple but not simply enough for a free 15 minute consultation. needs to be longer than that

    Can you represent yourself at a employment tribunal

    • @MonacoSolicitors
      @MonacoSolicitors  5 ปีที่แล้ว +1

      Yes you can. It’s very difficult though! There is a book by Naomi Cunningham which takes you through it.

      Ok thanks but do no win no fee firms do employment tribunal cases

    • @MonacoSolicitors
      @MonacoSolicitors  5 ปีที่แล้ว

      Not normally, because of the sheer amount of work involved. Judges want everything perfect so it’s not possible to cut any corners at all.

    I submitted my case after almost one year after the incident but the employment tribunal judge has accepted my claim. My opponent lawyer has mentioned this point in agenda form that is it allows to proceed a case which was submitted out of timeline. What may happen? My dismissal was a discrimination due to medical problems OCD and ADHD. My case hearing will be soon.
    Please guide me.

      Hi Zakir, thanks for your question. Well done for getting your claim accepted out of time. However one of the issues which the tribunal will have to decide was whether you brought the claim within 3 months or as soon as possible thereafter. In discrimination cases the 3 months can be extended where 'just and equitable to do so.' I haven't seen your case but in my honest opinion it is normally extremely difficult to pass this test if it is almost a year after the incident. For example, 4 months would be easier, but 11/12 months - extremely difficult. Unless you had a doctor's report saying that you were so stressed by the discrimination, for example, that you were mentally unable to bring the claim previously. Hope this helps.

      @@MonacoSolicitors my lawyer wants to do a pre-action protocol (for JR) instead of Employment tribunal application. Do you think it would be more effective to win. I have recent dismissal but two old issues. They are related so could be interlinked?

    These time limits are pathetic.who the hell decided to create them?But when it comes to historic child abuse from say 40 ,50 years back how come there's no time boundaries on things like that.?

      Criminal law vs Civil law. There is a very substantial difference!
