He lost a contract so he is down on income, and clearly has done nothing to find new work. "I'm trying to..." means "I haven't thought about it because it's too stressful for me to deal with." Simple tasks made hard by indecision.
I’m shocked this guy even has a drivers license, most states would have suspended it by now for failure to support his kids. Plus he hasn’t exercised any visitation time, what a jerk. There is no way he is going to get approved for a refinance if his business is in decline. Mortgage lenders don’t give declining self employment income a good rating. This woman needs to be calling the lender to verify timely payments on the mortgage, she is still on the loan and it will have a direct affect on her credit scores, which can’t be fixed by just saying it was my ex’s responsibility. She is stupid not to be checking on this debt. Also she should have filed this case right after his 1 year was up. The writing was on the wall at that point.
They say they will take away their license and/or give them jail time. My ex went over 3 years of paying absolutely NOTHING on the child support. I live in California. Child Support Services did pretty much nothing as far as enforcing the order to pay. I am the one who had to be the investigator as far as letting them know where he was living and where he was working. Every time he started a job and they told him his paycheck was going to be garnished he quit on the spot.
Some people thru depression anxiety etc simply shut down and decide not to do anything. They think it will all go away however in reality it gets worse. Interest rates have nothing to do with it. Sir let it go. Sell the house and give her the money deserved. Move on with your life and stop looking for handouts from the govt (especially since you are working) for your issues. Get it together and do right by your children.
Getting a VA claim processed and granted can take years! And he JUST now requested his medical records. Which means he's no where near a final determination to grant benefits.
As someone who got the shit end of the stick during her divorce (max child support i ever got- and that wasn't often- was $140), it's nice to see someone actually get some justice.
His stress disorder happened when he got home and had to be an adult. No more free food, clothing, housing, transportation, armor, weapons, gear, medical, dental, etc. etc. surrounded by his bros while he washed tanks and stacked boxes.
Judge David Ricke is an outstanding judge and human being. I am a former defense attorney and prosecutor in California. I constantly watch the TH-cam court hearings in other states, from great channels like Court Nerds, Time Served and Meg's Crime Watch. I have watched many videos of Judge Ricke. He has such an ideal judicial demeanor: smart, fair, conscientious, respectful to all parties and he genuinely cares about the cases and people before him. I have noticed that Judge Ricke is distressed when victims of crime are elderly or animals. Both groups are so vulnerable to abuse and neglect and Judge Ricke has a huge heart. He is a gem and a blessing. He is one of my very favorites along with Judge Stephanie Boyd (Texas) and Judge Tami Hayward (Georgia, I think).
I too love Judge Boyd, but she gives wayyyyyy too many probations out to people who repeated don't do what they're supposed to be doing...over and over and over and over. I LOVE the honorable Judge Ricke!!!
20k behind in support ..I had a 2 week period my child support was missed 1 time in 8 years and they dragged me into court..I pay 1k per month. They acted like I was a criminal yet people are 20k + behind and nothing happens to them..Sooo many never pay. I'd be sick not paying for my kids I love them their mine just like moms..Don't be DEAD BEATS
My ex was over 70,000 behind, and their support payment was only 200 per month, for two kids ( $100 each). Think I received a total of possibly $1200. before the kids turned 18.

It's very expensive to try to collect from an out of state parent, when one has to pay out of pocket. Lawyer, investigation, and legal fees would have eaten up most of any potential collection. I did look into it.
Judge Ricke is the kind of jurist who gives one faith in the system. I wouldn’t want to appear before him as a defendant, but I could expect a fair shake.

So essentially, if he can get the house refinanced within 30 days, in his name only, he keeps the house and his ex-wife will no longer be obligated to help pay for the house. Plus, there will be proof of his income earned. If that doesn't happen, then he has to move out in 30 days and the house goes up for sale. If he was smart, he'd sell the house, take his cut and be done with it. But, I really don't think numbnuts is smart.

The ex husband has zero affect. I can't figure out of he's high or if he's bored with the hearing believing he's going to ignore, yet again, the court's orders, or if he's so intentionally malicious toward his ex wife that he's already planning on destroying the house before he gets physically removed from it by law enforcement in 30 days' time. The Judge even cautioned him against that idea, but he's probably going to do it anyway, believing the only consequence will be that he'll get less when she sells it because she'll have to first recoup her repair expenses. Not sure he's considering that would be in direct violation of the Judge telling him *not* to do it. Destroying the house, or plumbing, or well or electricity will cause his ex-wife problems and delays in selling it, and he seems hellbent on making her life miserable. He doesn't appear to have any motivation, any sense of responsibility or accountability, and he certainly has no respect for the law or the courts, and no moral compass. Refinancing that house is something he needs to initiate right away: refinancing doesn't happen overnight; it takes time - sometimes 45-60+ days and he's got only 30, and that's if he remains with the current mortgage holder. If he wants to shop around for a better refi rate, that's going to cut into his 30 days as well. And he doesn't want to refinance because the application filing, no matter if he stays with the current mortgage lender or not, will create a hard credit check of credit history, as well as requiring documented proof of current mortgage balance and income so all the secrets he's kept about his income these past 3 years becomes public knowledge for the courts, his ex wife and her attorney, child support orders, etc. Even though Judge ordered him to maintain the house, this guy has hijacked the courts, his responsibility to support his children and his ex wife raising those children alone without him and even visiting his kids for 3 years with zero consequences, so maybe he is unimpressed with the real threat of being jailed for contempt and noncompliance with numerous court orders. I don't think he's lazy: I think he's strategically calculating and intentionally malicious to force his ex wife into paying the mortgage for the house he lives in, quit his job and is suddenly self employed so he makes less money and has no one else providing employment benefits, his ex wife also has to pay for the house *she* lives in with their children, he gives her no child support, so he's not paying for their education, their health insurance, any school activities or sports programs, clothing, food, daily necessities, etc. By ignoring all those court orders, he's pretty much a "kept man" and he's gotten away with it for 3 years. I hope, for her and the kids' sake, he doesn't vacate and doesn't "get around to" initiating a refinancing. He could always initiate a refinancing but not make any effort to provide the necessary documentation which would delay the end result, but he'd still be able to prove he did 'start it'. The Judge was telling him straight up that the next hearing was going to be in person and he highly suggested, more than once, that the guy get an attorney. He couldn't have been much more clear that the guy already has a more than just a toe over the 'go straight to jail for failure to comply and multiple contempt' orders and 'in person' means there will be court officers to haul him out the door and lock him up, but again, the guy looked seriously unimpressed.
Hopefully more Judges will follow Ricke's change to start caring more about the victims of criminals and deadbeats in their decisions and sentencing. Amazing how they think their kids are always someone elses responsibility.
Mortgage rates have only gone up recently; back when the judgement happened they were very low. This dude is a bad liar, and I suspect not just about why he didn’t refinance.
How could the wife and her attorney come to court without knowing what, if any, mortgage is on the house? That is relevant to how much the house could contribute to what the Judge tells the husband to pay the wife.
Yep. If she in on the mortgage as they state. They need to have all the numbers available including how much equity is in the house and how much child support is owed. When he last paid and how much.
The other court ordered that she be removed from the mortgage. The judge has to honor that decision. If he can't refinance the house in his own name, it has to be sold. She has a lien on the property, so that will come off the top of whatever money there is left (if any) after the sale. The judge has no input on that. And if it turns out the mortgage is underwater, she may be liable for a portion of that debt, but that still fulfills the order directing him to get her off the mortgage.
She could be in a world of hurt if he isn’t current on mortgage payments, her name is still on the loan and her credit could be in the tank. She is liable until it’s paid off. She has also put her head in the sand and not kept track of the mortgage. Most mortgage information is available online, how hard is that?

In a fairly new program, the VA allows, with a quitclaim deed to remove a spouse from a VA loan. Not many people know of this. Handle your business. In order to initiate the process for your VA spousal release you will need the following documents. 1) A copy of your filed divorce decree, including all pages OR a legal separation agreement awarding the property to the Veteran whose entitlement is encumbered by the VA-guaranteed loan. 2) A copy of the Quit Claim Deed that was recorded to remove your spouse from the title to the home.

As someone who got the shit end of the stick during her divorce (max child support i ever got- and that wasn't often- was $140), it's nice to see someone actually get some justice.

Judge David Ricke is an outstanding judge and human being. I am a former defense attorney and prosecutor in California. I constantly watch the TH-cam court hearings in other states, from great channels like Court Nerds, Time Served and Meg's Crime Watch. I have watched many videos of Judge Ricke. He has such an ideal judicial demeanor: smart, fair, conscientious, respectful to all parties and he genuinely cares about the cases and people before him. I have noticed that Judge Ricke is distressed when victims of crime are elderly or animals. Both groups are so vulnerable to abuse and neglect and Judge Ricke has a huge heart. He is a gem and a blessing. He is one of my very favorites along with Judge Stephanie Boyd (Texas) and Judge Tami Hayward (Georgia, I think).

None of these judges are tough enough. They all go easy on criminals. Things need to change.
I too love Judge Boyd, but she gives wayyyyyy too many probations out to people who repeated don't do what they're supposed to be doing...over and over and over and over. I LOVE the honorable Judge Ricke!!!

20k behind in support ..I had a 2 week period my child support was missed 1 time in 8 years and they dragged me into court..I pay 1k per month. They acted like I was a criminal yet people are 20k + behind and nothing happens to them..Sooo many never pay. I'd be sick not paying for my kids I love them their mine just like moms..Don't be DEAD BEATS
My ex was over 70,000 behind, and their support payment was only 200 per month, for two kids ( $100 each). Think I received a total of possibly $1200. before the kids turned 18.
Child support doesn't stop at 18 if there are arrears. You can still go to court and get money.
@@kimpulsipher647 while that's true, it's beyond the purview of State (at least in California) Child Support enforcement one the kid turns 18. It was hard enough for the state to collect anything. It's very expensive to try to collect from an out of state parent, when one has to pay out of pocket. Lawyer, investigation, and legal fees would have eaten up most of any potential collection. I did look into it.

There were many transportation soldiers who were exposed to enormous amounts of enemy activity due to convoys and who did multiple deployments.

So essentially, if he can get the house refinanced within 30 days, in his name only, he keeps the house and his ex-wife will no longer be obligated to help pay for the house. Plus, there will be proof of his income earned.
If that doesn't happen, then he has to move out in 30 days and the house goes up for sale.
If he was smart, he'd sell the house, take his cut and be done with it.

The ex husband has zero affect. I can't figure out of he's high or if he's bored with the hearing believing he's going to ignore, yet again, the court's orders, or if he's so intentionally malicious toward his ex wife that he's already planning on destroying the house before he gets physically removed from it by law enforcement in 30 days' time. The Judge even cautioned him against that idea, but he's probably going to do it anyway, believing the only consequence will be that he'll get less when she sells it because she'll have to first recoup her repair expenses. Not sure he's considering that would be in direct violation of the Judge telling him *not* to do it. Destroying the house, or plumbing, or well or electricity will cause his ex-wife problems and delays in selling it, and he seems hellbent on making her life miserable. He doesn't appear to have any motivation, any sense of responsibility or accountability, and he certainly has no respect for the law or the courts, and no moral compass. Refinancing that house is something he needs to initiate right away: refinancing doesn't happen overnight; it takes time - sometimes 45-60+ days and he's got only 30, and that's if he remains with the current mortgage holder. If he wants to shop around for a better refi rate, that's going to cut into his 30 days as well. And he doesn't want to refinance because the application filing, no matter if he stays with the current mortgage lender or not, will create a hard credit check of credit history, as well as requiring documented proof of current mortgage balance and income so all the secrets he's kept about his income these past 3 years becomes public knowledge for the courts, his ex wife and her attorney, child support orders, etc. Even though Judge ordered him to maintain the house, this guy has hijacked the courts, his responsibility to support his children and his ex wife raising those children alone without him and even visiting his kids for 3 years with zero consequences, so maybe he is unimpressed with the real threat of being jailed for contempt and noncompliance with numerous court orders. I don't think he's lazy: I think he's strategically calculating and intentionally malicious to force his ex wife into paying the mortgage for the house he lives in, quit his job and is suddenly self employed so he makes less money and has no one else providing employment benefits, his ex wife also has to pay for the house *she* lives in with their children, he gives her no child support, so he's not paying for their education, their health insurance, any school activities or sports programs, clothing, food, daily necessities, etc. By ignoring all those court orders, he's pretty much a "kept man" and he's gotten away with it for 3 years. I hope, for her and the kids' sake, he doesn't vacate and doesn't "get around to" initiating a refinancing. He could always initiate a refinancing but not make any effort to provide the necessary documentation which would delay the end result, but he'd still be able to prove he did 'start it'. The Judge was telling him straight up that the next hearing was going to be in person and he highly suggested, more than once, that the guy get an attorney. He couldn't have been much more clear that the guy already has a more than just a toe over the 'go straight to jail for failure to comply and multiple contempt' orders and 'in person' means there will be court officers to haul him out the door and lock him up, but again, the guy looked seriously unimpressed.

How could the wife and her attorney come to court without knowing what, if any, mortgage is on the house? That is relevant to how much the house could contribute to what the Judge tells the husband to pay the wife.
Yep. If she in on the mortgage as they state. They need to have all the numbers available including how much equity is in the house and how much child support is owed.

The other court ordered that she be removed from the mortgage. The judge has to honor that decision. If he can't refinance the house in his own name, it has to be sold. She has a lien on the property, so that will come off the top of whatever money there is left (if any) after the sale. The judge has no input on that. And if it turns out the mortgage is underwater, she may be liable for a portion of that debt, but that still fulfills the order directing him to get her off the mortgage.
She could be in a world of hurt if he isn’t current on mortgage payments, her name is still on the loan and her credit could be in the tank. She is liable until it’s paid off. She has also put her head in the sand and not kept track of the mortgage. Most mortgage information is available online, how hard is that?
He might have taken another mortgage since they divorced.
They can't know if he encumbered it after he took possession. Their may be liens that won't show until a current title search is done.

In a fairly new program, the VA allows, with a quitclaim deed to remove a spouse from a VA loan. Not many people know of this. Handle your business.
In order to initiate the process for your VA spousal release you will need the following documents.
1) A copy of your filed divorce decree, including all pages OR a legal separation agreement awarding the property to the Veteran whose entitlement is encumbered by the VA-guaranteed loan.
2) A copy of the Quit Claim Deed that was recorded to remove your spouse from the title to the home.
