I am losing count how many times a gun has been pulled on me. They are adding up. The statistics of probability are working against me that one will be fired.
An anonymous caller reported my car for being parked in the parking lot of the City Square (public parking). At about 5:30pm, when I was eating a bowl of cereal, a Sheriff Deputy pulled next to my car and started demanding my name. They had to identify me.
This is a town where they closed their police station down and rely on the Sheriff Dept to do their law enforcement.
I am so tired of these anonymous callers giving the cops permission to harass me. This process of vetting isn't right.
The caller complainer needs to take some responsibility for themselves and be fully identified when they make a stupid complaint!

I looked up the law You only have to identify if you are lawfully stopped in a public place under Utah code 77-7-15. Which states the officer has to have reasonable suspicion that the person is committing a crime

In order to be detained you must be suspected of a crime, which in this case was cited as "failure to identify". Yet you only need to provide ID if you are being detained for a crime, which he wasn't when he was asked for ID. But in order to be detained in the first place there needs to be suspicion of a crime. He never had that initial suspicion of crime and had no right to detain. Just looking suspicious is not grounds for detainment, and therefore he has no legal obligation to present ID. Obviously the cop is in the wrong, and more than likely it didn't matter.
It's impossible to know beyond a reasonable doubt that was going on the LEO head at the moment of encounter. We can't say that the LEO didn't have reasonable suspicion because we were not there, we don't have all the facts surrounding the situation....

It has been established in federal courts that a LEO pulling out his side arm is not attempted murder. It's only murder if the LEO kills the subject without just cause after all evidence has been analysed.

Next, go to the nearest state court and file an Oath of Office violation. It still said the same thing, (reasonable suspicion of a crime) prior to anything else. You can't legally be charged with not identifying, when no other crime has been committed. You can't put the cart before the horse.

In order for "Failure to ID" to be a crime, you must first be obligated to ID due to reasonable articulable suspicion of a past, present or future crime. Failure to ID cannot be the compelling reason for the detainment in the first place.

That was a scary shakedown! Utah's stop & ID law (77-7-15) doesn't authorize police to detain an individual without a particular offence, so that was a fat lie. Even if they though you might have committed an offence, then all they could lawfully demand, at most, would have been your name, address & an explanation of your actions. But drawing his gun on you was way over the line.

It’s a stop and Id state only if you’re suspected of committing a crime or have already committed a crime, or suspect a crime is about to be committed. They couldn’t articulate a crime being committed other than not providing papers which isn’t a law he can break unless he had already broken the law. We have freedom of movement and when the officer says the man videoing is detained for not identifying himself, the officer is infringing on that mans rights due to the fact he has not committed a crime. You even hear the officer assume that the man videoing has a warrant which isn’t the case, aka profiling. You also notice the first time he asks the officer if he was being detained he says “no were just having a conversation” but then decides to make up laws and changes his mind.
I’ve had the fortune of being stopped only for traffic violations and always had a cordial experience with most the officers I’ve dealt with, but the day that I start to get asked for “my papers” as if I were in nazi Germany then we’ve got a problem. Be informed and be knowledgeable. We as a people have given police too much power and they abuse it, but they can’t if you understand the law.
