1 Building Permits - The First Step to Build a House in Mexico

  • If you're from the US and are deciding to build your house in Mexico, obviously you need to be aware of the laws and regulations that will affect your project. Mexico has its own unique processes for building permits and very different methodology than you might be used to in the US.
    For example, you might think it's your contractor's job to handle all of the local permits and permissions but as the owner you are responsible to make sure the requirements are met. Just to give you a sampling of how these permits vary, if you're building near a coastline or other protected area your project has to be licensed by the local environmental regulatory agency in addition to the city. If it's also, or otherwise, a historic area you would need a permit from the Archeology and History Institute (INAH) etc.
    Jumping through all the hoops required for the construction permits in Mexico may seem expensive and a bit overwhelming, not to mention time-consuming, but if the proper permits are not obtained the resultant penalty will be your responsibility, regardless of what your contractor might tell you. Expect to pay up to 400,000 pesos (20,000 USD), have your construction site shut down and possibly even land yourself in a Mexican jail. So don't even try it - fair warning. It might sound a bit ominous, but those potential problems are easily avoided if you know the rules, follow the rules and get proper proof and documentation for the fees and permits you acquire.
