Sorry to hear that Savita. I think you should be eligible for maternity leave. But what is more important is your doctor's statement. You have to furnish that as proof. Legal Definition of miscarriage is - “expulsion of the contents of a pregnant uterus at any period prior to or during the twenty-sixth week of pregnancy.” The law also states that “In case of miscarriage, a woman shall, on the production of such proof as may be prescribed, be entitled to leave with wages at the rate of maternity benefit for a period of six weeks immediately following the day of her miscarriage.” Please get a statement from your doctor and that's proof of the miscarriage. Di Norway and Canada have parental leave where both parents have to share it.... Women can not take whole leaves

Can you tell me if after working 80 days in new company we can go for maternity still why you are asking to retain in same company?
