Depending on the reasons why the PR card expired without renewal, as well as reasons for remaining outside of Canada may qualify the application to be done on humanitarian and compassionate grounds. Otherwise, you will need to wait until the residency requirements have been met. But given that she is still a PR, she should be able to still apply for a health card.

garip yolcu You have some strong grounds given that your family lives in Canada. We would need to look further into the details of you being outside of Canada and also the personal circumstances of your family. You would need to file a very strong and complete application.

They can enter Canada by plane with their valid PR cards, however they might receive a removal order upon entry as it looks like they have not met the PR residency requirement of 2 years out of 5. It would be beneficial for them to speak to an immigration lawyer to understand this situation and be prepared for questions at the border. @@anureetmangat1938 I came from Iran via Germany. As long as you are holding a valid PR card, nobody can stop you from entering Canada. The last time I was in Canada was 2019 and had been away actually for two years but the officer didn’t say anything.

If you are in Canada now, live 730 days out of 5 years from now on, and apply for renewal after residency obligation fulfilled at the time you apply. even your PR card expires, you don't lose your PR status unless you receive removal order, you then need to appeal to IAD if you still wish to keep ur PR status.

I am not sure I understand your question - the law/case law/manuals/policies allows for PR card renewal applications under H&C grounds if the residency requirement is not met if we can demonstrate that the reason for being forced to be outside of Canada was out of your control. Our office has successfully filed hundreds of these applications. Every case is different, some will be approved and some not. Depending of the refusal reason there is also possibilities of appeal.

Manoulie Brutus h&c has many different factors to be considered, language is one of them. Definitely if you have language skills in Canada it would make your case stronger.
