I received a letter from my lawyer.They asked me to complete background check medical and financial statements.My issue is I lived in the states for 7yrs.i dont have a criminal record I'm the states. Never been arrested or fingerprinted. I just recently find out from my ex roommate that I have a paternity warrant in the states for missing child support court. But I have been here when they booked the paternity court.i sent my finger prints to FBI for background check.i dont know if it will say I have a warrant for missing a paternity court.willl this affect my end approval for my permanent residence .please reply.Thanks.
It depends if this results in a criminal conviction. You should contact a US criminal lawyer to get to obtain clarification and you should also submit this information to IRCC even if it does not appear on your FBI report.

duration is not a crucial point in the application. There are people who have lived for long years. Five, six and even ten years, but they were not so lucky, and there are others who lived a year or two and obtained acceptance (they proved their adaptation in the country and also focused on the best interest of the child as well as the difficulty of returning to their motherland because the conditions there, for example, or because of a disease cannot be treated in the home country, or because of serious psychological problems that could happen to the principal applicant or to the family members...) I heard that rejected asylum seekers, it could be more difficult for them to get admission. Regarding the processing time for the applicaiton , things are now faster compared to the requests sent in 2018, for example . In the end, every file is different, and good luck to everyone
Hi there, I am living in Canada since 2015 I complete my studies and work full time for around 2.5 years and I don’t achieve enough point for bc pnp to apply and I moved to Prince Edward Island work there for 2 months and layed off from my work due to COVID-19 and came back to BC and since than I start working as a carpenter, now I only have one and half months left on my post graduate work permit. Can I apply for h&c and mean while working on study permit or lmia options for express entry for pr. Thanks
You can apply for H&C but if you are also wanting to get a study permit or any other type of temporary status, your H&C application might jeopardize these applications. With the H&C application you are demonstrating an permanent intention in Canada which goes against the study permit intention.
Hello, want to know : When or if I would have access to Canadian Health care system after stage 1 approval of H&C ground application. Or do I get access to healthcare at all before the final decision of H&C application (that might take 3-4 years) ?
Sanyat Hoque you would only have access to health care once you become a PR of Canada, at the final stage. H&c’s have been taking about 1-2 years in the last few years but it might change due to the pandemic backlogs.

I think there is some misunderstanding here. The Healthcare system in Canada is usually run by the provincial governments not the federal government. If you live in Ontario you get the Ontario Healthcare card, and if you live in Alberta you get the Alberta Healthcare card. You don't really need a status to get it but a valid resident address. The provincial governments do not check your immigration status
Hi I just saw your video and would like to ask a question on my friend's H&C application. He submitted his application and got a confirmation from IRCC that his application has been received through his lawyer. He was then asked to go get his biometric done after few weeks later. He said he got his biometric done at a Service Canada office even when his ID and passport has expired because of an immigration consultant screwed up his AINP application so he's currently in Canada illegally. He's now waiting to know if IRCC are still working on his biometric or they will just ignore it because he doesn't have a valid document in Canada. He did his biometric a month ago. Do you think everything is fine with my friend's application please? Thanks

H&C applications can only be made when physically present in Canada. There is the option to file for an overseas family sponsorship while outside of Canada under H&C grounds however these are very rare and for exceptional cases.

Hey l have a very big problem l hope you can help me. I am gonna write all story please help me. I was living usa. I went there work and travel program. I didn’t leave when my visa expired. I stay there 6 mounts after my visa over. After that l pass the border l went canada l apply the asylum l was a refugee in canada. (I went there because of her and During that time l got married but l couldn’t apply the sponsorship because of financial problem and my wife was pregnant .) In hearing date l went the court l wasn’t ready because my lowyer didn’t prepare me and even she didn’t attend hearing court. Anyway my case was denied. After that I did appeal. I sent the case again. After 2 months my wife gave a birth 2 mounts later finally l apply the sponsorship. My lowyer said don’t cancel your refugee case l am not recommending. But we couldn’t finish the case right a way it’s took more less 6 months. Finally Lowyer finish the case and sent it . 15 days later l got decision my appeal. Immigration officer said your appeal is rejected you have to leave Canada in 30 days and your sponsorship it’s gonna be cancel and you have to aplly in your country (Turkey). I didn’t broke the rules l ask 3 weeks extension because l want to see my son’s first birthday they said okay. Next day l left the canada. When l came to Turkey my wife is changed. Some problems start between me and her and it’s grow up day by day she was keep fighting with me after that she canceled the sponsorship and she started legal divorce process. She is not showing even my son now l would like to came to canada and see my son l wanna be part of his life. l am desperate right now. I don’t know what l am gonna do. Can l apply TFW with ARC or express entry or H&C I don’t know which one is best option for me or do you have something else for me. l hope you have some solutions for me if you have something for me l would like to work with you please help me. You should ask your lawyer specifically if you have been approved first stage and he/she should be able to advise you or send you the letter. You can also call the call centre and with your client ID request to find out if you have been approved first stage.

Unfortunately no - in an H&C application, you must mention the existence of a child for the applicant but they cannot become permanent residence along with the applicant if approved.

My brother is an adopted child and facing problems backhome as he is still dependent on my mom and my father has passed away. Also sponsor parents 2020 close for now. because you nonetheless have to include dependent children in an H&C application if not it’s misrepresentation. If the applicant is in Canada, children overseas cannot be sponsored to Canada unfortunately.
