Now I would like to ask that if a person continues the possession in an immovable property after lapse of an agreement of sale then can the owner file a suit for recovery of possession under section 5 of S R Act? And also if the owner by force takes back the possession of that immovable property from that person then that person can file a suit under section 6 on the basis of his previous possession by strength of such agreement of sale which was not enforced due to expire of specific time to execute sale? And one fact I would like to add no suit for specific performance of contract was filed by the either party. Please reply...thank you..with regards

Now to prove readiness and willingness Mr.B submitted bank statements of himself along with his partners bank statement. Is this considered by court ? Note : His partners were not part of agreement to sale.

Mere papa pichle 64 saal se ek jamin par kacha makan bana kar rah rahe hain lekin hamare paas us jamin ka koi deed ya koi document nahi hai papa usi jamindar ke paas 40 saal tak kaam kiye. Lekin ab mere chacha ne us jamin ke adhe hisse me pichle mahine jabardasti kabza kar liya aur kacha ghar bana liya .
