    I find it ironic that the people who are supposed to be working for the people of this nation can't even answer a simple question. I don't think I have heard anyone, republican or democrat answer any question with a simple answer. Why must they dance around the damn question? Just give a fucking answer!

    If the actions of the president are at odds with the constitution, why is it taking so long to get anything more than questions asked of Holder?

    Exactly ! Nobody is accusing Obama of making "too much" use of his executive power. We are accusing him of exceeding his executive authority. He can use his power all day long, there is no limit on that and that is his right. It is when you try to use your power to exceed your authority that is when we have a legal problem. Same thing for the congress. There is no limit on the number of laws they can pass to use their legislative power. There is a limit on what they can pass though. These are totally different things.

    It gets pretty good around 9:30. Lee delivers a smack-down and holder smirks away any suggestions of "usurpation and lawlessness." I guess I would too if I were part of an usurpatious and lawless administration.

    Finally! Someone's challenging Obama about all the picking and choosing what parts of a law (written and signed) to delay and/or implement. I sincerely hope Sen. Mike Lee follows through with this and doesn't let it go.
    We cannot have an executive branch that continually picks and chooses what laws IT deems fit to be enforced and which ones if feels are inadequate. The most lawless administration in my lifetime.

    Holder’s hesitation(s) in responding to Lee’s questions and his stumbling answers show that he hadn’t been ‘briefed’ as to what to say and how to back up and support the pres. If he had his leaders’ expertise as an orator he could have weaseled his way around the tough questions.

    Con Law as taught in Law School is not about acting in accordance with the Constitution, but rather how to do what you want by weaseling around the restrictions. This is only necessary as a member of the state as the Constitution places restrictions on the State and not the citizen.

    I don't like how we let democrats get away with the "I don't know" or "I don't remember" answer. I can't stand that. Every time a really solid question is asked, it's always "I don't remember" and then we just move on as though that's an acceptable answer. Other than that, I like what Senator Lee did here.

    It is important to note, in this instance, that the action of deferring the mandate was a graduated enforcement in contrast to a refusal to enforce - which is the gravity of the concern here I take it. Had the president stated he refuses to enforce the law indefinitely, almost assuredly this would be a violation unless he deemed it unconstitutional. As such, litigation to that effect would define and limit such actions. This has not occurred to my knowledge, probably because he has not REFUSED to enforce.
    What the president has done under his Executive Authority provided in the Constitution (The Executive Power shall be vested...) in determining HOW to enforce a duly passed law, to my understanding, is a sensible adjustment to phase-in enforcement, not a refusal to enforce. In fact, current law gives Executive Departments the authority to implement such phased in transitions in certain circumstances. For example, in section 7805(a) of the Internal Revenue Code ("the Secretary [of the Treasury] shall prescribe all needful rules and regulations for the enforcement of this title, including all rules and regulations as may be necessary by reason of any alteration of law in relation to internal revenue"), the Treasury Department is granted the administrative authority to grant transition relief when implementing new legislation. This authority has been used to phase in and postpone the application of new legislation multiple times across administrations (Tax Relief Extension Act of 1999, Small Business and Work Opportunity Act of 2007, Airport and Airway Extension Act, Part IV of 2011, Housing Assistance Tax Act of 2008, etc.)
    You may cry foul and say what prevents them from indefinitely postponing laws. I would argue the court system does. While current judicial interpretation allows the executive to phase in legislation, it does not allow legislation to be “unreasonably delayed” (Federal Administrative Procedures Act) Another protection is in Heckler v. Chaney where the Court found that if an executive agency has consciously adopted a policy that amounts to abdication of its statutory responsibility, the Court has the obligation to order them to enforce the law.

    The difference, wingnut, is that executive orders that defy existing laws passed by Congress, or make up law that Congress has not passed, such as Obama's orders to ignore extant immigration law, are non constitutional are should be met by impeachment.
