    Thank you for your very informative videos. I am not an OFW but this series has been extremely helpful and helped de-mystify land buying. Super practical and factual ang presentation.
    Planning on buying land in the province. I have a few questions po:
    - Red flag din po ba if the land is still titled to a deceased owner and the children are selling it? Aside from checking for claims in the baranggay, ano pa po ang additional due diligence na dapat gawin. May magbabago po ba sa transfer ng title to new owner?
    - Paano po nachecheck if the land on the vicinity map and title is the same as the physical property you are inspecting? Are there markers or dapat po ba meron personnel/expert na kasama when inspecting?
    - If wala po kakilala sa area, paano po makakahanap ng agent or broker to help process the sale?

      Our pleasure po. Punta lang po kayo sa kahit na sinong lawyer na may opisina. Present your valid ID and yung sa seller, original title or proof of ownership sa lupa. Gagawan po kayo ng Absolute Deed of Sale. Doon po kayo magbayaran sa harap ng abugado para maayos. Bibigyan kayo ng lawyer ng acknowledgement receipt.
      Bale usually po 1% ng value ng benta ang chinacharge ng lawyer. Pero sa bagong taripa ng Integrated Bar of the Philippines ngayon, yung ibang provinsya 2% na ang fee.
      Pag-usapan niyo rin po pala ang terms sa bentahan before magbayad -- like sino ang mag aasikaso ng transfer ng title, neto lang ba ang babayaran niyo o gross etc.

    Very informative. Not a single time wasted. I will be buying a land when I save around P2,500,000- 3,000,000. Hopefully maka kita ang ng cheap land around P1000-1500 cm2 haha if not then ill just keep looking.

      Hi Malvin! Depende po yan sa inyo kung ano arrangement niyo and ano ang tasks niya. Ang apartmemt mamager /caretaker po namin dati ang bro-in-law ko po. Hindi po siya stay-in. Hindi po malaki ang bayad namin kasi may sarili rin po siyang work and part-time work niya lang po ang apartment. Bale ang tasks niya po ay mag-entertain ng inquiries (text/calls or visit), mag-read ng submeters and mangolekta ng rent. Kung may mga sira po siya na rin ang sisilip kung kaya niya. Otherwise hahanap po ng gagawa (separate bayad po ito ng tenant kung minor repairs lang).
      So bale depende po yan sa assignment niya. Kung stay-in siya and naglilinis every day, then kailangan niya po mabayaran daily pwedeng minimum or above minimum depende sa usapqn niyo since magiging free stay siya if may pwesto sa apartment niyo for a caretaker. Magdedepende po talaga yan sa magiging usapan niyo.

      @@malvinafaga1435 ah so i-lay out niyo po ang tasks niya kung stay-in siya. Maglilinis siya ng common areas daily. Basically, yung pinaka-maintenance and upkeep ng apartment ay sa kaniya na? Bukod sa pagsingil ng rent, etc. Nasa usapan niyo na po talaga yan. Depende rin sa sahuran sa lugar niyo. Kasi pwede niya naman half day lang gawin ang lahat ng cleaning. Half day work siya sa labas pero malapit lang. That way may extra income siya pero minimum or slightly above minimum naman sa inyo + accommodation and free electricity and water. Sayang naman kasi kung tapos na siya sa tasks niya tapos tambay lang siya the whole day. I-test niyo muna rin kung mapapagkatiwalaan.
      Hindi po kasi tayo parehas ng situation kaya di ko makabigay ng idea.

    very helpful, una, naliwanagan ako sa amount na hinihingi ng agent para sa processing fee.. tapos dun sa other fees.. at mag sososry na ko sa asawa ko kase di ako naniniwala sa babayaran..
    300k un lupa, tapos 100k un processing.. umay.. pero, ok. hahaha.. salamat

    I was sold vacant lots. But till now all that was issued is Deed of Absolute Sale but not notarized. We were told waiting pa raw ng approval ng sub divide nung property. I don't understand why it is sold in parcels kung di pa na sub divide.

      Hello! Yes po medyo nakakastress kung hindi efficient ang maghahandle ng papers niyo pero usually naman maayos sila and igaguide ka nila. Gaya ng sabi ni Mr Dirtdiver, medyo pabalik-balik lang nga and ngayong pandemic medyo tumagal ng konti ang releasing lalo na sa mga areas na may lockdown. Kagaya sa amin nilockdown ang mismong city hall compound dahil sa +cases sa mismong employees, staff ng aming mayor etc. 😔 Pero ang RD nag-open din after a while.
      Ngunit wag po kayo padadala sa stress. Kung maganda ang deal na nakuha niyo sa lupa, grab niyo na. Ang stress naman mawawala din. Pero ang opportunity makahanap ng magandang lote sa magandang presyo ay di kadalasan kaya grab niyo na. Magpa-spa or massage nalang kayo after 😊 (pero true sobrang hassle nga 😅 yung sa sister ko until now di pa tapos transfer from November 2020 pa yun inaasikaso ha dahil lang sa 1 error sa date sa SPA).

      Hello po. Bale magpahawa po kayo ng Special Power of Attorney na irerepresent kayo ng taong pinagkakatiwalaan ninyo. Ipapanotarize niyo po ito sa Embassy or Consulate kung nasaam kayo. Ipadala niyo po ang actual physical copy ng SPA via courier sa Pilipinas. Make sure po sa Abugado ang bayaran at nakalagay sa Absolute Deed of Sale na kayo ang buyer at nakalagay sa name niyo (at ng asawa niyo kung meron) ng lupa.
      Pwede niyo rin po ipalagay sa SPA na yung nagrerepresent sa inyo ay siya na rin ang mag-aasikaso ng pag transfer ng title or magrepresent sa inyo if may kailangan pirmahan atbp.

      Isa lang po, then phino-photocopy na ang iba. Won't hurt if you have several copies naman para incase mawala, nay original ka pa rin.
      Kung galing naman sa ibang bansa, kailangan notarized sa embassy or consulate kung nasaan kayo.

      makakasagot lang po mismo ang makakasagot nito. Pero to give you an idea, yung nabili naming lupa na almost 450sqm, under process na ang transfer ngayon dahil nasa RD na, ang binayad naming fees sa RD ay P8k plus po.

      Hello Lloyd!😊 Sorry po late reply. Yung ibig niya po sabihin is kailangan macheck kung yung tao ay marami ng lupa. Di na po kasi inaallow ng batas na ang isang tao ay maraming lupa (unless ipangalan sa anak). So sa residential kahit tig 1k sqm pero kapag agricultural land ay dapat daw 5hectares maximum per individual. This way napeprevent nila mag-amass ng maraming lupa ang iisang tao lang. Pero ang ginagawa ng iba, ipapangalan sa anak etc.

    napaka-informative po ng mga contents nyo. I have a question po. Kami po ay seller ng lot, and meron po kami buyer with attorney na they are asking us to give them photocopies of the following: Certified True Copy, SPA, and the Original Title. This is to validate the documents of the lot before making a deal.
    Is giving this copies safe for us seller? Because our relatives are hesitant/scared to give them these copies even though photocopy. Thanks in advance

      Hello po. Thanks for watching and for your feedback 😊 Hindi na po kailangan ang lahat ng iyon. All you are duty-bound to give as a responsible seller is to give them a photocopy of the Title (but only to serious buyers ha? Wag sa ahente). Then sila na mismo ang pupunta sa Register of Deeds (RD) to check if the title is clean by requesting for a Certifified True Copy from the RD (Ph300 lang ito). I've done that na. Hindi naman ako hiningan ng SPA. Pinakita ko lang ang photocopy ng Title and yun nakarequest na ako. The buyer just needs to tell the RD na bibilhin ang lupa and they want to check if it's clean. Once I received the Certified True Copy of the Title, chineck ko anv details doon sa kopya na binigay nila sakin: name of owner, TCT number, technical description, and check if may annotation. Ibig sabihin po, ang RD ang third-party verification nila.
      What's the SPA for daw po? Please don't give them the Original Title hanggat hindi kayo nagkakabayaran sa harap ng lawyer. As a seller, you also need to protect yourself and your property.

      Hello po. Kilala niyo po ba ang nagsangla at ang may-ari sa titulo? Paano po niya nasanla sa inyo if hindi sa kaniya nakapangalan ang titulo? Doon palang hindi na dapat. Pls check for real ownership po ah. Don't base it on the title alone. Punta po kayo RD and City Assessor kung kanino talaga ang lupa at baka nakasangla pa yan sa iba. Ask the RD if clean ang title. Nakasulat po sa likod kung nagamit siya as collateral. Make sure walang sabit before you buy. The way I look at it now, mukhang may issue.

      Hi Roma! 😊 That means walang titulo ang lupa. "Rights" lang ang meron sila sa lupa because they are paying the tax declaration. You can still buy it but you have to do the necessary verification still.
      Don't rely on what sellers will say lang, okay? 3 things you should do:
      1. Check if the area is already eligible for titling. If yes, why haven't they applied for it yet?
      2. If the area (neighbourhood, barangay, city or province) is not yet eligible for titling because the LRA froze the titling there (may ban gaya dito sa Palawan), then check with the city hall kung sino talaga ang may-ari ng lupa. Dapat yung name sa Tax Dec ay same sa records ng City Hall (Assessor's office). Check din if they are updated sa payments.
      3. If Sila talaga may-ari as per your verification, note that the value of the property cannot be too high. Mas mura kasi ang lupa na tax dec lang kumpara sa titled lot.
      Kung naverify mo na lahat and desido ka na bilhin, same ang procedure ng pagbili ng lupa. Go to an attorney who will facilitate the sale for you and the seller. Laging tamang proseso pa rin.
      Then, check mo rin kung kailan pwede patituluhan ang lupa. Usually if hindi pa nakalift ang ban sa area, matagal pa yan. But we can always hope. 😊

      Bale ng options niyo po ay ipangalan po sa family niyo na nasa Pilipinas ang title ng lupa pagbili niyo po. Halimbawa sa asawa niyo or magulang niyo. Pero di ko po inaadvise yun. Madali lang naman po magpagawa ng SPA and ipa notarize niyo lang sa consulate or embassy kung nasaan kayo. The padala niyo lang via courier sa Pilipinas. Make sure tama po lahat ng details sa SPA, including spelling ng names na nasa ID niyo at ng iauthorize niyo. Dapat din po pinagkakatiwalaan niyo ang i-SPA niyo. Yung matapat at di kayo lolokohin.

    Very informative po sis. Tanong ko lang sis nandito ako sa us may lupa yong kapatid ko dyan sa davao under sa developer pero fully paid na sya gusto nyang ibenta sa akin. Pero 50% lang muna ang ibayad and the balance will be installment kailangan ko pa ba ipa check ko yong title nya sa register of deeds bago ako magdown ng 50% anong yong pinakauna kung gawin bago ko sya bayaran ng 50%? At anu pa yong mga dapat gawin at mga papeles since nandito ako sa us? Ano yong pinaka the best way bago bimili ng lupa para patayuan ng bahay ? Kailangan ba rin na fully paid ka na sa seller bago ka pwedeng magtayo ng bahay?

      Hi Teresa! Apologies for the late reply. Bale yes po, you still need to check the title with the Register of Deeds. Kailangan mo rin kasi malaman kung natransfer na ba talaga sa kapatid niyo yung title. That way, madali na lang pagbili mo sa Kaniya.
      Your sibling will also need to present the title sa lawyer during the sale of the property. Bale ang una nilang ibibigay sa iyo ay Contract To Sell-- dito nakalagay ang terms ng installment. After mo ma-fully pay ang lupa, saka ka kayo makakapagawa ng Absolute Deed of Sale sa lawyer. Notarized din yan kasi kailangan yan sa pagpapatransfer ng Title.
      Sa pagpapagawa po ng bahay, pwede pa rin basta may Deed of Sale kahit Contract to Sell palang siya. Hingi rin kayo ng consent sa Current Owner plus technical description nung lupa. Please ask the Office of the Building Official kung ano pa ang iba nilang kailangan to apply for a Building Permit. Yun kasi hiningi sa amin nung tinayo namin ang apartment project na kahit hindi pa natransfer sa owner ang title dahil naka-hold ang transfer dito sa Palawan sa ngayon.

      Hello! Best po to ask Rgistry of Deeds (RD) for the process. Kasi ipapa-subdivide po nila. Ipapa-resurvey po kung kanino mapupunta ang aling size and saan and kung agree po sila, apply lang po for new title. Pls ask RD for the process and requirements before you start kasi yung samin yung ni-cut na lot na pina-survey ulit ay pina-approve pa sa LRA sa Manila before naiprocess for new title.

      Hello sis! Yes, kung hindi physically present ang Owner kung kanino nakapangalan ang title, yung naka-SPA niya, yun ang pipirma sa Deed of Sale. But yung maglalakad ng transfer, depende sa mapag-agreehan niyo. Pwede rin siya, pwedeng yung taong iauthorize mo. Hope this helps. 😊

    hi, may bibilhin akong lupa dyan sa palawan . Napacheck ko na yung title at yung lupa . Magbabayad na lang ako pero nasa ibang bansa ako at wala akong kamaganak sa palawan. Natatakot naman ako magsend ng pera sa agent , any advice ano pwede ko gawin? since gusto ng seller cash ang payment.

      Hi Jhon! Naku sorry for the late reply. Baka tapos na ang transaction nyo. Pero sagutin ko pa rin. Bale depende yan sa usapan and yung usual na na ginagawa sa Village. Usually sila na lahat. So magbabayad ka na lang same sa lawyer. Pero always ask the head ha and make sure it is in writing.

      Hi Insoy Inside! Ang alam ko kapag mag-loan ka dito sa Philippines kailangan mo ng collateral under your name. So I'm not sure if pwede i-loan ang both para sa lipa and construction. Best to check with the loaning agency kasi baka mali ako. Ayaw ko naman magkamali ka. Sensya na ha.
