    Thank you for posting this video;Ive Been having a bit of a hard time. Finding a lawyer. My discrimination case In spite of an overwhelming amount of evidence which definitively proves my former employer violated numerous EEOC laws; This video was very helpful in clarifying the process and will definitely prove useful if it turns out that I have to represent myself. Thank you again for posting.

    Thank you for explaining this so simply. Sadly I filed in 2021 and case was lost by the EEO office. They are now trying to mediate again, after it was denied initially by the employer. I will be obtaining an attorney as I believe that they are in violation. Thank you for this very informative video.

    Great video sir. I have two questions.
    1. Who is generally asked first if they agree to a mediation, the employer or the employee?
    2. In the unlikely event that the employer does not actually follow through with the agreed settlement, what would be the next step for the employee, or what are the possible consequences for the employer?

      It’s the same process except instead of being in person you are just on the phone.

      Thanks, how does the Mediator coordinate with both parties? I am suppose to phone in? Dont know how to coordinate with attorney on phone mediation. Thanks again.

    Soo..does that "confidentiality clause" mean you can't sue, or use what they did or said to sue them?? I'm confused.

      the clause just states that anything brought up during the mediation can't be used in court. If you don't agree with the outcome you can fight it in court.

    I was asked to attend a mediation. I agreed . Then I was informed by the EEOC that they did not employ a mediator to meditate my case at their office. They wanted to know if the EEOC intake could just kinda do the job of a mediator over the phone. Calling me then my ex employer back and fourth.

    To me, this sounds like you go into mediation as an employee, lay all your cards on the table, and then no matter what happens, you can’t use anything that your employer says during meditation in court against them, even if they flat out admitted that they discriminated against you! This seems like you just tip your hand and then they find out what your position is, so they can use it to screw you over even more. Why on earth would any employee agree to this, especially if they can’t afford a lawyer?

      That's what I'm thinking.... they might want to see all my cards so they are better prepared in court not so they want to settle.

    I said yes to mediation; but Atty Kelvin Little discouraged it. Because unbeknownst to me, he malicious sabotaged ans helped PRL at every level of due process.
