The AR hysteria actually began in the mid 1980s with Ronald Reagan's Firearm Owners Protection Act and the "Machine Gun USA" article published by Newsweek.
*The problem* SBRs, SBSs, and Suppressors are restricted by LAW, not by ATF regulation. The ATF Director cannot 'exempt' any of them from the LAW any more than the ATF Director can change the LAW to ban bumpstocks, FRTs, 80% receivers, or pistol braces. Even Brandon Herrera can't do that. *The solution* 1. Legislation passed by Congress (won't happen) OR 2. A Supreme Court order. What Herrera CAN do, as ATF Director, is sue the government and challenge the NFA, either completely or in part. He could FORCE the matter and get an abbreviated timeline to challenge the laws. He can also rescind ALL ATF 'rules' restricting firearms beyond what is mandated in the LAW.
Your missing the point. The Supreme Court is supposed to determine what is constitutional before a law is passed due to Marbury v Madison which was a hearing that said any law repugnant to the constitution is null and void. They obviously failed to do their jobs back in the early mid 1900’s. This law on these weapons should already be nulled and voided by every court.
Clearly the Director sets the tone from an enforcement perspective. Until such time as the Supreme Court rules on existing legislation, the culture of ATF can surely be shifted.

@@JesusPerez-ux9zw Its cause they use private businesses "rules" as if they were laws, And use those rules to try and convict someone of a felony so they can "legally" confiscate any firearms from that person and even if those charges are dropped it'll take months/years to get any of those guns back and by the time you do get any of them back most of them will probably end up "missing" or were "destroyed" (aka stolen) and you can't do anything about it except move on or they'll try and get you for a harassment charge.

I was in the Marines , got out and struggled with addiction . I have a non violent felony drug possession and now can’t own a firearm . I wish them made a law for people with non violent charges to own a firearm . Haven’t been in trouble for 7 years now and it sucks .

*The problem*
SBRs, SBSs, and Suppressors are restricted by LAW, not by ATF regulation. The ATF Director cannot 'exempt' any of them from the LAW any more than the ATF Director can change the LAW to ban bumpstocks, FRTs, 80% receivers, or pistol braces.
Even Brandon Herrera can't do that.
*The solution*
1. Legislation passed by Congress (won't happen)
OR
2. A Supreme Court order.
What Herrera CAN do, as ATF Director, is sue the government and challenge the NFA, either completely or in part. He could FORCE the matter and get an abbreviated timeline to challenge the laws.
He can also rescind ALL ATF 'rules' restricting firearms beyond what is mandated in the LAW.
Your missing the point. The Supreme Court is supposed to determine what is constitutional before a law is passed due to Marbury v Madison which was a hearing that said any law repugnant to the constitution is null and void. They obviously failed to do their jobs back in the early mid 1900’s.
This law on these weapons should already be nulled and voided by every court.
Clearly the Director sets the tone from an enforcement perspective. Until such time as the Supreme Court rules on existing legislation, the culture of ATF can surely be shifted.

The Supreme Court reviews 70-80 cases per year. Out of about 8000 seeking certiorari. Out of 10s of thousands of laws passed nationwide every year.
