The rest of yall in this thread and whoever liked OP's comment. It's called an "accident" not an "on purpose", get over yourselves. The kid is 18 (NOW that is, as who's to fucking say he was when this happened, not you) and he automatically responded with "I'm sorry" and made direct eye contact as soon as he was given the public chance. A Crooked Cop fixed 2 tickets for a friend who caused an accident destroying private property and then the kid who caused the accident didn’t even apologize to the innocent person.
That’s Pathetic. Obviously the mother of the kid didn’t teach him how to apologize, or even own up to what he did.

@@NickyMay16 Yeah, the whole thing was so unfair to the plaintiff. She was the victim in all of that, and she's the one being basically punished because the defendants are buddy-buddy with the cops, and the judge wouldn't even award her the amount she was quoted to build a new mailbox pillar.
The new pillar will cost 1300.00, she had to pay a 500.00 deductible on her car and a 50.00 deductible on the rental car, and the judge only awarded 1500.00. So this debacle cost the plaintiff time, aggravation, a brand new car that's now been wrecked, and $350.00.
She needs to file a formal complaint against the cop. They are obviously seriously CROOKED in that police department. That cop needs to be investigated.

my 10 year old was roller blading couldn’t stop and hit a neighbors mailbox…he still knocked on the door and apologized and said if it was damaged he would pay…the neighbor looked and said there was a tiny dent in the mailbox and to not worry about it and thanked my son for telling him…now this was only a mailbox but to do that much damage and not apologize is sick

Outrageous he wasn't tested for alcohol/drugs. And the tickets magically dismissed? Even more outrageous. And the judge lowered her monetary judgement? Only $1500 when they had to pay a $500 deductible on the car insurance?!And a $50 deductible for the rental insurance?! And she wouldn't give her $9 for the police report?! No police report would be needed if he hadn't wrecked their place and their car!! Judge Millie was waaay off on this one.
That gave her $950 for landscaping & remounting the mailbox. It was fair. I think.

I hang out woth my friends ans don't drink. Just because theirs a hang out doesn't mean a person has to drink. I'm tired every day and I been blessed a couple of times that I haven't wrecked.

Imagine getting an estimate to repair damages you didn't cause and have the judge tell you,"nahhhhh... I think thats too much", and now you are out money out of your own pocket. Plaintiff got screwed on this case.

Because you're suppose to get multiple estimates in a lawsuit to ensure that you're not going to the best of the best of the best that overcharges. When I had to take someone to small claims for crashing into a fence with their car, I got three estimates; one was 400, one was 700, and one was 1600. The 1600 was insanely high and the 400 was dangerously low. Yea, it's extra work for the victim to do but it's to ensure someone doesn't take the highest estimate they can find.
You're supposed to get atleast 2 different estimates not just 1.. its always been like that.. yes she has a right to be angry atkeast he wasn't drunk oe under influence of drugs

I want to go with the company who repair the damage and restore it to the way it was before the idiot plowed into it. $1300 is very reasonable. @jayburris6252 1300 is reasonable but I think it's just best practice to get multiple estimates what's stopping someone from going to court with an estimate of 5000 to fix that should they be awarded the 5k off of one estimate

Here in Canada we apologize as a way of life! Lmaol. In fact in my province, Ontario, an apology is not an admission of guilt in the legal sense. It’s called EMPATHY. It’s just something we do.

As a stepdaughter of a police officer the reason why he probably got off is because if the cop did not show up for the ticket the judge probably threw it out so they probably ask the cop not to show up for the ticket even though the cop had to cover his self and write the ticket that's probably why they got dropped.

And if you listened carefully the tickets he received were for minor offenses. How fishy that no breathalyzer was done at that hour of the morning for someone who was disoriented.

The defendants knew someone in that police department for sure- to just take their "word for it that he wasn't drinking - really? not even a breathalizer test? and didn't even get charged with those tickets. Also...masonery work is expensive (for the mailbox) - how does JM know it really wouldn't have cost that much? (I know her family was in construction, but different areas of the country could have different costs) Glad plaintiff at least got $1500 back however.

I'm sure the vehicle is in her name, and so is the insurance. He is an adult, but I would go to court with my 18 year old too. Young adults still need support & guidance from their parents. She could definitely pipe down, but I would have been there, too.

That’s not fair. I have two boys (17 and 20) and you absolutely should have the support of your mom at that age. You don’t stop teaching your kids the second they turn 18 wtf. My best friend treated her son (same age as the defendant) the same way that mom did.. when she died unexpectedly at the age of 40, he was lost as a goose in a hailstorm because she made every decision for him! How can children learn to be responsible adults if they aren’t allowed to make any decisions on their own? And learn from the bad ones?

if you've got cheap insurance and their damages are capped. you can be sued for the rest. Got off at midnight was with his friends until he crashed at 5:30 in the morning.

You can absolutely fall asleep at the wheel with no drug or alcohol interaction. I started falling asleep at the wheel on a long business trip. I pulled over for a nap until I could trust myself to drive without falling asleep again. You don't know unless you've been there.

There are multiple police body cams of people falling asleep behind the wheel at a fast-food restaurant drive-thru line late at night or early AM and then getting investigated for suspected DWI because that is considered unusual behavior. This guy falls asleep while driving down the road causing a crash with property damage and is not investigated at all for possible DWI simply because per the mother the cops did not note the smells of alcohol on his breath even though the guy admitted he was not all there even after the police arrived and could not remember much that happened afterwards that night.
When the judge goes into a “this happened to me too” story, is the verdict unbiased?

I thought when an insurance company pays out they make you sign a document saying this you can't come back and try to get more. I also thought it covered the insured as well as the company.
Limited insurance and you can sue for the balance, at least in California, may be different in other states.
