Marital Rape Status In India | Centre Opposes Criminalisation Of Marital Rape

Attracting the crime in the nature of “rape” as recognised in India to the institution of marriage can be arguably considered to be excessively harsh and therefore, disproportionate.
This was the crux of the centre’s argument on the question of marital rape which is exempt from most rape legislations, which it submitted to the supreme court, In a 49-page long affidavit opposing the criminalisation of marital rape, the centre gave a multitude of examples on how a marriage, especially in a country like India, is such a unique concept that ‘mathematical niceties’ of law cannot be applied here.
One of the primary petitioners in the case, All India Democratic Women's Association’s General Secretary, Mariam Dhawale speaks with NDTV’s Anwiti on the centre’s affidavit which argues criminalisation of marital rape is not needed in a society like India.

Marriage as an institution has always served the interests of men. High time that our society recognises marital rape as "rape". This is important if this institution needs to be saved. Otherwise women will feel more safe and comfortable to "live-in" rather than "marry". By criminalising marital rape every man will get a message that consent of a woman is important whether they are in a marital relationship or not. They will learn that they are wrong in feeling entitled. Even today rapes happen because men think they don't need to take a woman's consent.
