This is a perfect example of everything wrong with the entertainment industry (aside from all the rape). Whatever company that owns the rights to the Addams Family should be falling over themselves to hire Melissa to make more videos with a bigger budget rather than trying to remove her work from the internet.
This is the letter I received from them regarding this when I petitioned them to allow this show. Perhaps this can help you understand that closing down “The Adult Wednesday Addams" is not, nor never has been about money. It is about understanding licensing and legalities, and the only way we could prevent Melissa Hunter from continuing with her unlicensed series, and not get sued by an enormously powerful movie studio, was to issue a notice of copyright infringement. Melissa Hunter has never bothered to tell the truth, either on her web site or on her Facebook site, and so we continue to respond to her fan base on her behalf, still at this point, more than three years after we were forced to shut her down as owners of the underlying rights to all things Addams. This Foundation is in its fourth year of a contract with MGM to produce a full-length animated feature film of The Addams Family®. Within that contract no one but those licensees who were listed, that is to whom we had previously licensed permission, i.e. the Broadway Musical, could portray staged/scripted programs in any media until after the release of the film or the resolution of the contract. Period. This supersedes parody and fair play issues. All Melissa Hunter would have had to do was contact us for permission and it would have been a free license until such time as a network were to pick up her program, exactly what she had hoped would happen. Melissa and her agent were advised of this and did nothing to explain the situation to her fan base. She has moved on to "Wolfgirl" which may be picked up by television so everyone will be happy again. In the meantime, this Foundation is perceived as the bully when, in actuality, we were forced to shut down a perfectly good series that continued to keep the brand alive, as does the worldwide Musical, until this film is released on 11 October 2019. Understandably, the studios do not see it this way. It is about money. The studio is investing millions, while Melissa invested possible hundreds. As well, her show could have been picked up for television, etc. and then the lawyers would start swinging their axes at one another with us in the middle. We trust this may explain our inability to move any further on this issue, that we are doing our utmost to carry the Addams name and oeuvre forward, that the lack of responsibility by the creator of the TH-cam program is the cause of the end of her program. skonkfactory It isn't even that. Its all because youtube has a broken policy towards copyright complaints that allows the holders to abuse the hell out of the system. You don't even need money when youtube considers the most frivilous of claims to be sacrosanct.
xingcat The trouble with "fair use" is that none of it is defined by law, it's all from a series of court decisions--and it's all very subjective. So when you get down to it, absolutely nothing counts as "fair use" until a judge has ruled that it is. It really is some bullshit.

"why should they care" I totally sympathize, but there is actually really good reason. If they turn a blind eye to any infringement on their proprietary rights, they risk putting all of those rights in jeopardy. That's the way the law works.
tetsubo57 (IANAL but) the law gets a little murky here; enough so that lawyers may advise to pursue a cease-and-desist and be willing to go to court over it. There are two cruxes, 1) That Melissa is making it seem as though she has permission to use the character when she doesn't, and 2) that it is outside the realm of parody and is in fact fan-fiction; which is alright, so long as you don't actually profit from it, and Melissa fairly clearly is profiting (both through ad-revenue, and a rather successful patreon).
tetsubo57 (IANAL but) The Supreme Court actually made a specific distinction between parody (protected) and satire (not protected), where parody is something which is commenting on the original work, and satire is something that makes use of the original work to comment on something else. The case for protection is also stronger if there's no chance of confusing it for the original. The lines are often murky, in which case you get into expensive litigation (or threat thereof). Kenneth Lu - It's nothing so complicated. The show, which is based on someone else's creative material, was making money without the consent of the proper people. I don't know why everyone thinks it has to do with *just* parody. It's money. It's nearly ALWAYS about money.

At the time she was monetizing the show without a license from the copyright holder. That is not permitted. At the time, if you made a fan film / series, copyright holders were inclined to turn a blind eye to it, as long as you were not doing it to make money. There is a post earlier by William Hall that explains it better. The short version is the copyright owners were in a contract with a couple of studios. Melissa Hunter was doing an unlicensed series. The TEE AND CHARLES ADDAMS FOUNDATION told her and her agent to hold off for now in case she was sued by a major studio. She ignored the Foundation so it hit her with a copyright notice. She didn't pass that information on to her viewers. (I remember at the time she always maintained the copyright holders had stomped on her for no reason)

A legalist would be able to tell us for sure, but I recall something about losing one's own rights if you do not do enough to protect them (meaning addressing violations). I do hope it gets sorted out though. Adult Wednesday is the best thing to happen to the Addams in years.

@@maddyl5649 One of the nice things about a series is that you get to explore a character in depth. Melissa stayed true to the character, and gave us the grown tree that was shown as a sapling. The best thing the IP holder could have done was to give her a hundred grand as a wage, and a couple of million for the production. They'd have made a hundred million! As low budget as the Adult Wednesday films were, they all dealt with character issues, and pointed out the same pattern that show and the movies presented; functional insanity that was unaware that anything was wrong.

Melissa, I've just found the A.W.A. series you did and I know you did Adult Wednesday Addams years ago, I just want to say you are one talented writer and actor, I think you've captured the Spirit of Wednesday Addams perfectly as if we were fortunate enough to see her grow into adulthood, through the original series and later movies. I hope you've gone on to better things in your chosen field of endeavour. Yeah it sucks that people with more money than brains can ruin a good thing, but never, ever lose sight of your dream.
It is absolutely worth fighting this. Because the Adult Wednesday Addams show falls under Fair Use and Parody, you're totally within your legal rights as an entertainer so long as you include the disclaimer "the character Wednesday Addams belongs to so-and-so, this is a parody, et cetera". Seriously, you are in no legal danger- that's how Cracked can get away with doing massive parody series, as well. We miss you and Wednesday, Melissa, and we're totally on your side.
The Adams Family theme has sat on the dusty self for decades without any new material, at least none worth watching and now when someone does something that springs life into a character (you Necromancer you) censorship raises its UGLY head (Without a BODY). They should pay you to do this. We, the fans of good taste and top notch material salute you.
It wasn't censorship. It was copyright declaration. The owners of the copyright don't want anyone doing anything with their intellectual property. If you were a content creator, and had intellectual property, you certainly wouldn't want someone stealing your material and profiting from it, now would you? No, you woulnd't. Having said that, a really good flesh-eating lawyer could make the case that this is a Fair Use derivative, since the original character was perpetually nine years old, and that any adult version of it is not the same thing, but unfortunately, in corporate America, the oligarchy usually wins. @@lancer525 I think there is a big difference between IP "Creator" and "Owner"....the current owners are not the creators. I have a lot of sympathy for creators, because they are often the victims of the "owner" of the IP.
It might be because she had her settings so views gave her money or even a copyright strike from the company that currently owns the Addams Family franchise. Could even just be youtube's stupid new rules. Either way, she can combat this by making the series non-profit and using her other videos to gain the monetary value if she does indeed use it for that.
welles This is really late but I'm commenting in case others have the same question. The owners of the Addams Family copyright personally flagged her videos for removal. Star Wars, however, is a franchise that is known for being welcoming to fan content creators. I think they even recently did a fan film contest. The reason hers was pulled and theirs wasn't is simply that it was up to the discretion of the copyright owner, the Addams Foundation just happens to care more about it than Disney/Lucas Studios.

It comes down to copyright laws actually. Parodies/satires are protected under copyright laws. A "what if story" (like the Adult Wednesday Adams) wouldn't be considered either and would not be protected. But, as someone else pointed out, LucasFilm has always been open to fans making Star Wars vids. Even once held contests for the best fan made one (don't know if they still do or not). I have no idea if Disney will allow that trend to continue (here's hoping they do since Lucas himself liked that fans did that).
Parodies/satire AND depictions which are part of ANY sort of commentary are protected as fair use. I really think IF it went to court (unlikely), Melissa Hunter would win. The definition of satire and commentary is pretty broad. Whatever threats she received were just meant to bully her into stopping. Too bad it worked. I think she should ignore them - maybe even shop the series to a network which has lawyers who understand that there’s nothing to the threats.

It simply has to bear significant similarities such that a reasonable person would say that there is a nexus between the original copyrighted material and the alleged infringement. For example, Harlan Ellison made an Outer Limits episode ("Soldier") where two soldiers from opposite sides of a future war used a time machine and continued to fight their war in the past, endangering a family that one of the soldiers comes to live with. Harlan Ellison then sued the principals of Terminator because of the similarities between the projects under copyright, because even though there were a number of differences, there was a clear nexus. TL;DR: Doing those four things together would be similar enough to the copyright to have it flagged.

I was looking for the trailer to the Wednesday Addams series on Netflix and stumble on your videos. I watched both seasons and was sad to find out there aren't anymore. I just started watching Adult Wednesday Addams on 5/14/2021 and I love it. I enjoy seeing what happens to one of my favorite characters after the show is over and she's grown up.
I am so glad i found this... Wednesday addams has been one of my absolute favorite fictional characters since i watched young Christina ricci as a kid. This woman absolutely nails her role so well. I can't wait to see more of her!!

This is the letter I received from them regarding this when I petitioned them to allow this show.
Perhaps this can help you understand that closing down “The Adult Wednesday Addams" is not, nor never has been about money. It is about understanding licensing and legalities, and the only way we could prevent Melissa Hunter from continuing with her unlicensed series, and not get sued by an enormously powerful movie studio, was to issue a notice of copyright infringement. Melissa Hunter has never bothered to tell the truth, either on her web site or on her Facebook site, and so we continue to respond to her fan base on her behalf, still at this point, more than three years after we were forced to shut her down as owners of the underlying rights to all things Addams.
This Foundation is in its fourth year of a contract with MGM to produce a full-length animated feature film of The Addams Family®. Within that contract no one but those licensees who were listed, that is to whom we had previously licensed permission, i.e. the Broadway Musical, could portray staged/scripted programs in any media until after the release of the film or the resolution of the contract. Period. This supersedes parody and fair play issues. All Melissa Hunter would have had to do was contact us for permission and it would have been a free license until such time as a network were to pick up her program, exactly what she had hoped would happen.
Melissa and her agent were advised of this and did nothing to explain the situation to her fan base. She has moved on to "Wolfgirl" which may be picked up by television so everyone will be happy again.
In the meantime, this Foundation is perceived as the bully when, in actuality, we were forced to shut down a perfectly good series that continued to keep the brand alive, as does the worldwide Musical, until this film is released on 11 October 2019. Understandably, the studios do not see it this way. It is about money. The studio is investing millions, while Melissa invested possible hundreds. As well, her show could have been picked up for television, etc. and then the lawyers would start swinging their axes at one another with us in the middle.
We trust this may explain our inability to move any further on this issue, that we are doing our utmost to carry the Addams name and oeuvre forward, that the lack of responsibility by the creator of the TH-cam program is the cause of the end of her program.

I totally sympathize, but there is actually really good reason. If they turn a blind eye to any infringement on their proprietary rights, they risk putting all of those rights in jeopardy. That's the way the law works.

tetsubo57 (IANAL but) the law gets a little murky here; enough so that lawyers may advise to pursue a cease-and-desist and be willing to go to court over it. There are two cruxes, 1) That Melissa is making it seem as though she has permission to use the character when she doesn't, and 2) that it is outside the realm of parody and is in fact fan-fiction; which is alright, so long as you don't actually profit from it, and Melissa fairly clearly is profiting (both through ad-revenue, and a rather successful patreon).

tetsubo57 (IANAL but) The Supreme Court actually made a specific distinction between parody (protected) and satire (not protected), where parody is something which is commenting on the original work, and satire is something that makes use of the original work to comment on something else. The case for protection is also stronger if there's no chance of confusing it for the original. The lines are often murky, in which case you get into expensive litigation (or threat thereof). How this all applies to the content from this channel is an exercise left for the lawyer, I mean reader. :P

At the time she was monetizing the show without a license from the copyright holder. That is not permitted. At the time, if you made a fan film / series, copyright holders were inclined to turn a blind eye to it, as long as you were not doing it to make money.
There is a post earlier by William Hall that explains it better. The short version is the copyright owners were in a contract with a couple of studios. Melissa Hunter was doing an unlicensed series.
The TEE AND CHARLES ADDAMS FOUNDATION told her and her agent to hold off for now in case she was sued by a major studio. She ignored the Foundation so it hit her with a copyright notice. She didn't pass that information on to her viewers. (I remember at the time she always maintained the copyright holders had stomped on her for no reason)
I really loved your Adult Wednesday concept, so sad the owners of the Adam’s family franchise didn’t reach out to want to be a part of this awesome series. Im so hooked on this and now disappeared.

@@maddyl5649 One of the nice things about a series is that you get to explore a character in depth. Melissa stayed true to the character, and gave us the grown tree that was shown as a sapling. The best thing the IP holder could have done was to give her a hundred grand as a wage, and a couple of million for the production. They'd have made a hundred million! As low budget as the Adult Wednesday films were, they all dealt with character issues, and pointed out the same pattern that show and the movies presented; functional insanity that was unaware that anything was wrong.

Melissa, I've just found the A.W.A. series you did and I know you did Adult Wednesday Addams years ago, I just want to say you are one talented writer and actor, I think you've captured the Spirit of Wednesday Addams perfectly as if we were fortunate enough to see her grow into adulthood, through the original series and later movies. I hope you've gone on to better things in your chosen field of endeavour. Yeah it sucks that people with more money than brains can ruin a good thing, but never, ever lose sight of your dream.
It is absolutely worth fighting this. Because the Adult Wednesday Addams show falls under Fair Use and Parody, you're totally within your legal rights as an entertainer so long as you include the disclaimer "the character Wednesday Addams belongs to so-and-so, this is a parody, et cetera". Seriously, you are in no legal danger- that's how Cracked can get away with doing massive parody series, as well.

It wasn't censorship. It was copyright declaration. The owners of the copyright don't want anyone doing anything with their intellectual property. If you were a content creator, and had intellectual property, you certainly wouldn't want someone stealing your material and profiting from it, now would you? No, you woulnd't. Having said that, a really good flesh-eating lawyer could make the case that this is a Fair Use derivative, since the original character was perpetually nine years old, and that any adult version of it is not the same thing, but unfortunately, in corporate America, the oligarchy usually wins.

How does Cracked get away with having a whole Star Wars parody series but your parody series gets taken down?
It might be because she had her settings so views gave her money or even a copyright strike from the company that currently owns the Addams Family franchise. Could even just be youtube's stupid new rules. Either way, she can combat this by making the series non-profit and using her other videos to gain the monetary value if she does indeed use it for that.
welles This is really late but I'm commenting in case others have the same question. The owners of the Addams Family copyright personally flagged her videos for removal. Star Wars, however, is a franchise that is known for being welcoming to fan content creators. I think they even recently did a fan film contest. The reason hers was pulled and theirs wasn't is simply that it was up to the discretion of the copyright owner, the Addams Foundation just happens to care more about it than Disney/Lucas Studios.
Thanks for sharing Rhia. I understand the legal need for owners to protect IP, but it still sucks, especially since it's not like they've been DOING anything with the Addams brand.
It comes down to copyright laws actually. Parodies/satires are protected under copyright laws. A "what if story" (like the Adult Wednesday Adams) wouldn't be considered either and would not be protected. But, as someone else pointed out, LucasFilm has always been open to fans making Star Wars vids. Even once held contests for the best fan made one (don't know if they still do or not). I have no idea if Disney will allow that trend to continue (here's hoping they do since Lucas himself liked that fans did that).
Parodies/satire AND depictions which are part of ANY sort of commentary are protected as fair use. I really think IF it went to court (unlikely), Melissa Hunter would win. The definition of satire and commentary is pretty broad. Whatever threats she received were just meant to bully her into stopping. Too bad it worked. I think she should ignore them - maybe even shop the series to a network which has lawyers who understand that there’s nothing to the threats.

It's MGM's loss they could be striking a bargain for acquiring Melissa and her crew to draw some positive ratings and all the merchandise that they could move with her edition of the Addams character since the cartoon they released flopped.

Estate administrators aren't interested in your art. They have two concerns:
1. Is your use of their source material making you any money which could be theirs?
2. Are your interpretations of those aforementioned materials in any way damaging the demand for their product?
In other words, it's all about money, so spare yourself the strain of making arguments about art.

1) The dress is your own, and you can wear it anyway that you want.
2) Your hair is your own, and you can wear it anyway that you want.
3) Your comedy is your own, and you can do it anyway you want.
4) As long as you don't use the name Wednesday Addams, spelled just the way it is here, then you can use any name that you want.
Then, why not use all three of those at the same time? ;-)
Under US Copyright Laws, a plaintiff does NOT have to prove that the alleged copyright infringement is exactly what was copyrighted. It simply has to bear significant similarities such that a reasonable person would say that there is a nexus between the original copyrighted material and the alleged infringement. For example, Harlan Ellison made an Outer Limits episode ("Soldier") where two soldiers from opposite sides of a future war used a time machine and continued to fight their war in the past, endangering a family that one of the soldiers comes to live with. Harlan Ellison then sued the principals of Terminator because of the similarities between the projects under copyright, because even though there were a number of differences, there was a clear nexus.
TL;DR: Doing those four things together would be similar enough to the copyright to have it flagged.

Adult Wednesday Addams is so obviously a parody (as the original creation is always depicted as a child) and thus protected under "fair use". Even the updated version in the Addams musical she is only 18.

I was looking for the trailer to the Wednesday Addams series on Netflix and stumble on your videos. I watched both seasons and was sad to find out there aren't anymore. I agree with AlexGolem's comment, your videos are clever and well done, whoever owns the rights to the Addams family should have offered you a big contract to continue this series!

Hi Melissa, may be you should contact Blame Society, the guys who made "Chad Vader Day Shift Manager". I think they can give you some advise to circumvent the obstacles with this issue. I wish you all the best and looking forward to see more of this dark humor. IMHO the best solution would be one, where you don't have to deal with the Addams Foundation but rather one where you can show them the finger.
