      If false statements or perjury was used as the basis for the warrant, then the judge would not necessarily be criminally liable. Stupid maybe, but not criminaly involved... Unless,of course, like a few other lawyers in the news have rediscovered lately, she was part of a criminal conspiracy, and knew the basis for the warrant she was issuing to be false. This is just getting fun, make some popcorn, sit back, and watch... With the writers strike on, this is some of the best comedy available rignt now.... Except for the unfortunate body count.... Maybe the Chief had "better call? Saul"....?

    I feel very sorry about that old woman who was probably so disturbed with police coming into her house that she was overwhelmed and couldn't take that intrusion into her life and probably died of stress the very next day. So awful.

      They took her Alexa which was the only way she was able to call for help if she fell is what I heard. I do not know her cause of death but surely the entirety of the raid was partially to blame.

    I'll tell you, folks, Marion County is darn lucky to have a newspaper at all and to have journalists of the quality of those at the Marion County Record. We're seeing true grassroots integrity here. The main stream media can't hold a candle to these fine, traditional journalists. As far as the local police department, well, there's some jail time seriously warranted here, not least for 3rd degree manslaughter.

    As someone who lives in Wichita. Thank you for being the ones to confront them. It’s beyond frustrating that here in Wichita where we have 3 tv news stations and a news paper limping along that they don’t even report on this issue like a news station 2.5 hours from Marion. Insane!

      I too am from Wichita, and I agree with this. It's truly quite shocking that corruption happens like this in the state of Kansas at all! Local citizens should be picketing the police dept and city hall right now demanding answers. (Not burning it down like they did in Minnesota. The city/county council should be oversighting their loaw enforcment and subpoena them for questioning. Remember, it's legal for law enforcment to lie to you, but not to elected officials.

      Corruption in small towns is nothing new, it has been done for hundreds of years.
      "Magistrate Judge Laura Viar, who signed the warrant authorizing Friday’s raid, did so because of allegations that the newspaper had improperly obtained information about a local restaurant owner’s past DUI conviction.
      But Judge Viar has a DUI history of her own. She has been arrested at least twice for driving under the influence in two different Kansas counties, an investigation by the Wichita Eagle reported Wednesday.
      During a 2012 incident in Morris County, she allegedly drove off-road with a suspended license and crashed into a school building while under the influence. She was running unopposed for Morris County Attorney at the time - and won."
      All a DUI cover up caused this.

    The Wichita Eagle reported that the judge that signed off on the search warrant, Laura Viar, had two DUIs in 2012. Kari Newell, the restaurateur who set the raid in motion was trying to protect her DUI from being publicized. Small town corruption in full force in Marion County, Kansas.

    My faith in TV journalism is restored. The reporter is a credit to her profession, and the interviews, story construction, and editing are all first rate. I will be subscribing to the Marion KS newspaper as a show of support for their print journalism as well.

    This reminds me of when the Adams Co Sheriff's Department raided Afroman's home for evidence of kidnapping... and nobody has a clue what the probable cause was for such a random charge... and there never was evidence seized either.
    People can make stuff up to get a warrant all the time.
    It's ironic that the police protect their sources and probable cause, while invading a newspaper for their sources.
    Hope the next stations keep up on this. The police have blood on their hands now.

    What really needs to be investigated is the search warrant and all documents submitted along with it to a judge. Also the judge needs to be investigated to determine if he or she really considered the facts presented or was it just a rubber stamp job for the police.

    The state AG or a higher court needs to intervene and appoint a special prosecutor and custodian of all the seized computers to prevent destruction or access which at this point is obviously in violation of both the First Amendment and NY Times v Sullivan which prohibits prior restraint on newspapers by government

    Four States Legislators have wised up and reversed Qualified Immunity for Career Criminal Police Officers, Colorado, Nevada, New Mexico, and Montana. Smart decisions because they are tired of the Tax Payers paying for LEO's cowardice ways. Qualified Immunity needs to be reversed in all states. Cops have gone rouge, they don't care if you sue because the tax payers pay for the suit, you and I. Not only do they not deserve Qualified Immunity but they should be required by law to submit to at least two psych evaluations a year paid from their own pockets to keep their job, done by Qualified Professionals not affiliated with any police association or union. This will weed out the bad cops. A northern California sheriff’s department stripped 47 deputies - 10% of the force - of their guns and arrest powers because they failed psychological exams, it was reported on September of 2022.They have become nothing but Career Criminals with badges! In John 10:10 we're told that Satan has come to steal, kill and destroy. I think he has recruited most of the LEO's, Judges and Prosecuting Attorney's in this Country! In some states an officer is only required to take 600 hours of training but to become a barber it take 4000 hours, 6.6 times longer. How right is that? The only sane conclusion you can come up with is that LEO's are stupid, corrupt and evil!

    Did it sound anyone else like the unlawful rid of that woman’s home cause her to have a heart attack and she died. Someone dies in the commission of a crime that’s murder, correct. Unlawfully reading a Home is a crime, correct? Which makes murder a charge that should be on the table. Conspiracy to commit murder, indict all the law-enforcement officers, the judge that signed the warrant and the district attorney that isn’t seeking charges, and therefore is a accessory after the fact and co-conspirator

      I think if you robbed a bank and threatened an old woman and she died of a heart attack you are correct.
      I think police will hide behind qualified immunity and have other excuses and tricks to try and show they did not intend to break the law.
      I think in any case they have to show that you intended to at least break some law, and they might have to show that you intended to do the exact crime they are charging you with.

      Surely we should have seen the warrant application by now. Either the police lied and should go to prison for it, or the judge rubber stamped it and should go to prison for it. I suppose there's the remote possibility that the newspaper really was a nefarious criminal enterprise, but this is not how they'd be acting if that were the case.
